How did you get the expedite ??? My wife is in the Philippines and we just had a baby - we are about to file our for the CRBA for the baby - My I-130 went to Vermont in 1/30/09 and K-3 2/20/09 (we will not pursue the K-3 after researching it). Any input on an expedite would be apprecated. Thank you.
OP - how long have you known this lady ??? A baby is a life changing event. Without getting judgemental - here it is. If your fiance gets pregnant - she has a good chance of having the baby in the Philippines. Once that occurs you need to file with the embassy in manila for a CRBA (Citizens Report of Birth Abroad). The CRBA will take 90 days minimum from the date the child is born because of logistics. Your primary delay will be getting a National Statistics Office birth certificate on the new baby. Once that is obtained you can file the application and associated paperwork and get an interview in a short period of time. However, they can demand a DNA test and you will be stuck waiting on the results.
CRBA has lots of documentation requirements - original birth certificate of child, original marriage certificate of parents (if you are not married ie fiance then they really scrutinize things and you have even more documents to provide - that is the sticky situation you may be putting yourself in) , last original divorce papers of both spouces, your original passpot pages showing you were with her during conception, medical records from the doctor who treated her, a sonogram of the pregnancy, proof that you were a resident of the USA for the last few years, an original birth certificate of your's, and probably some more stuff - I am going from memory.
OP - if she gets pregnant - you might be better off getting married if the baby will be born in Philippines - that complicates things if you are in the middle of a K-1 filing - a withdrawal of the K-1 will cast doubt on the relationship - but being unmarried casts doubt on the paternity of the baby - see the trap ???
Anyways - good luck with your lady - I wish you and her all the best - but if you are blessed with a child - my advice is to skip the K-1 get married and file the I-130.

Well what I did was this. I called NVC and found that we had a RFE, after talking with the lady on the phone for a few minutes I asked her about a expidite based on my wife being preggy. She told me to send a email to Sue@nvc who is the boss for the Phills but she stated that they never grant them based on being pregant. So I sent her a email with pdf scans of the records from my wifes doctor in the phils and she granted our expidite.
From that point USEM handled the rfe and my wife had a interview in 2 weeks from the point that I found out we were granted a expididte. Here is the email I sent:
Hello, I am writing to you in regards to my wife's case, xxxxxxx xxxx xxxx xxxxxx xxxxxxxxxxxxxxx. On September 16, 2008 I talked with a NVC operator and she suggested I write you a letter and told me I can also send you a email. So I am sending you this and I will also send a hard copy of my request.
My wife is currently pregnant with our first child and based on the speed that our I-130 was approved and the speed at which you fine people are working on your sometimes overwhelming case loads, I see the possibility of getting our case complete far ahead of what we could ever imagine. Based on the research I have done to get our case this far, I have found that the US Embassy in Manila is usually booked out about 2 months in advanced. For my wife and I, before we ever started this process, we knew we wanted to start a family together as soon as possible with the full understanding that a CR1 visa would take around 10 to 12 months. Due to the speed at which the USCIS and the NVC are moving we see the possibility of being done with everything in December. I am asking if there is any way we can put in a request to get the earliest interview possible, early December maybe even the end of November, barring all of our remaining paperwork is in order (DS230). As I stated, my wife is currently pregnant with a projected due date from her last exam of February 6, 2009 and a on line calculation of January 27, 2009. As per airlines policy most wont allow a pregnant woman fly about 4-6weeks prior to her due date. A quick calculation shows that if we was to get a early interview date and we had no issues with our documentation, my wife could be here about 1 ½ months before her due date. As we researched the implications our having a child we knew the that after the baby was born, we would have to file for a birth abroad and also file for a US passport for our child. This process can take from 1-2 months and most airlines will not let a child under the age of 3 months fly. Also to compound this issue the paperwork in the Philippines moves at a snail pace and sometimes it can several months to get a official birth certificate. As you can see if we could get a early interview date, we could avoid this un-lengthy delay.

Dude, seriously, are you like 13 or something? Use a condom, pull that little winkie you call a ####### out of that hole and release it some other place but dont try to use a pregancy to speed up the process. This would back fire on you 100% and besides what happens if you break up, now you put this woman who happens to come from a poorer country into a bad finacial situation, she will also be looked down upon by other pinoy (loss of reputation). Come on man you the head on your shoulders, not the other one.
And in our case, I was able to get a expidite filed based on my wife being preggy....the key word here is WIFE. They could care less for a non-family based petition.

The AOS stopped when youor ex-wife became a USC. A waiver might be for a K1 if that what you filled for your ex-wife and what you want to file for your new girl. Your only allowed 1 K1 so a waiver would be required.

A few months of chats will work, most important is pics of you together, passport stamps..proff that you have met in the last 2 years. Heck I met my wife January 2008, got married april 2008 and she was here in november 2008. As you can see leangth of chatting really has no bearing.

Its her getting up at 5am every morning taking care of my morning wood and making me b-fast...her driving 100 miles every day to bring me lunch and having dinner ready at 6pm, its having the house spotless, the baby in bed asleep and a cold beer waiting for me the second I walk in the door, it's her sitting on the floor at my feet and being quite waiting for me to finish my 7th beer so we can go to bed and take care of MY needs...God it's good to be King!

On to what I love about my wife for real...
Accually its her faults that I love the most, it's her ability to keep me calm with just her being in the room, it's how she gets me (the only other female in the world to get me was my mom). Accually my list is small but its the small things that matter the most as the small things become big problems later in a relationship.

Your right you should quit your job and move there and wait and wait and wait....without income for AOS you be waiting a life time. If I got your attention now you just need to be patient, your time will come soon enough. Im assuming you already have everything ready for the next phase of your journey, I found this helped my wife and I out as it gave us something to focus on besides missing each other. Good luck.

Well we were expidited and from start to finish my wife got here 4 1/2 months from our filing date but its a moot point being you was denied.

Off topic whos going to win the cup this year ehh!!! Employers are allowed to charge a resonable fee to proccess child support payments so there isn't any valid reason anyone would get fired for that. Lets stay on topic shall we.
OP as many has said and as pshbrk has stated (listen to him he is a good resource) you should really have a heart to heart with your bf. God I love my wife and would of never brought her here and put this burdon on her but instead I ended up paying a attny almost $5000 to get my child support straitened out, as I stated, my ex was trying to screw me over like your bf's ex. If he really loves you he wouldn't be trying to get you here untill he had his life straited out. Good luck.

no he said he pay $80 for the back support monthly and $350 weekly and just recently his ex ask for 5% increase and the court grant it based on his income.
Sounds like he needs a better laywer. Truthfully it sounds like there is more going on here then meets they eye. In all my life I have never heard of a man who pays child support to ask for a 5% increase. Besides, you dont have to ask the ex or the courts for permission...He can make extra payments at any time to child support services and they will apply it to any amounts that are in the rears. Don't become a statistic here and mess your life up, remember if you do get married to this man and it ends up bad and you go home, you'll be branded aka second hand goods.

Accually 350 a week in child support isnt that much when you figure in a few factors. Being her SO is behind in support, child support services is authorized by law to take up to 50% of his wages although they usually wont do that unless he is in the rears a lot, say more then 5k. I know this as at one point I was $19,000 in the rears on child support according to my ex (I accually wasnt my exwife lied) but child support service was taking 50% of my wages. In my case I was able to hire a attny and after the smoke cleared my ex owed me back a few thousound but thats like getting blood from a turnip. My point is if he is in the rears on support they can take 50% of his wages,take his drivers licence, any professional licence and his passport and there isnt much he can do but he may be able to hire a attny and get some modifications done. Your situation is grim and you should do some soul searching if you really want to get involved with a man paying this kind of money per month till his child(ren) turn 19...

My wife had dsl in the Phils so I sent her a packet8 phone so she had a local US number in the Phils so we could talk anytime and she could also talk to her family that was already here! Now that she is here she is able to call and talk to her family when ever she wants and doesnt cost a thing besides our monthly rate.

I do beleive that if you do the K3 path, once you get to the states you would have to fly back home to your coutry of orgin to proccess the I-130 for a cr1. As was stated before you cant work right away with a K3. Why not wait another 1-2 months and do a CR1 instead? It's better in every single regards and cheaper to boot.

I use the best AV on the market...called my brain. If people would be smart on how they surf the net and not open every peice of ####### that jumps into their email inbox you wouldnt need av. My windows installation has been up and running for 1 1/2 years now (vista 64bit) and not one infection. My prior install was win xp and it was running for 3 years with no infection.
My wife on the other hand always has infections and she uses AVG...they come from friendster and the other crappy websites pinoy seem to like to use

Man if I were you I would grow up,grow a set of balls and pull your AOS. Every day you wait the harder its going to be to stop the process. You may love her but what is one sided love? She may fake loving you back but you have the evidence right before you as to what her intentensions are and if you ignore it (a slap in the face) then what happens to you IS your fault. Here is a possibility...she gets her 2yr gc, divorces you,she gets knocked up by some random guy,files for medicare~food stamps~goverment housing and what other benifits are out there and lets jump foward a few years or so after the baby is 3 years old. All of a sudden the GOV comes back on you for all the public assistance your Ex just used...this could be 50,000 60,000 70,000 dollars or more and being the Federal Goverment they step in and garnish your wages (law states they can take up to 50% if I remember right) I don't know about you but to lose upto 50% of my wages would hurt just a little. The ball is in your court what happens from here on is on you.

BTW I'm kidding about my wife...I dont beleive in paying for insurance so I pay for all her medical related expenses out right. I cant see paying premiums to insurance companies so they can get richer and cut our coverage every time you use the policy. F them

I pay nothing...I'm a service connected vet...first gulf war so all my medical is free and my wife is on medicare/caid through the Department of Health and Welfare...got to love the free medical...thanks to all the tax payers for that!!!!!!!

The AR-11 is for an LPR to complete if they move while residing in the US. The document that immigrants receive at the POE is the I-94. I have no idea if your wife, because of the visa you petitioned for, is required to do an I-94. I am sure someone here will know.

Well that was taken care of accually. I had a insurance policy with my wife being the benificary. In the event of my death she would of been very rich by pinoy standards.
