And One thing more my family is in canada, before my approval for my visa to US my mom cancelled her petition for me to go there so there wont be any conflict in my US visa application before. There is no reason to try to salvage this marriage. Your husband is a "player". Ditch him.

You haven't done anything at this point that would result in you being banned from the US. As long as you're still married to your husband, then your conditional green card is still valid. If you are divorced by the time your conditional green card expires, then you can file to remove conditions and get an unconditional green card on your own - you won't need your ex-husbands cooperation. However, once you get the divorce you should file to remove conditions immediately - don't wait for the conditional green card to expire. Understand that the divorce has to be final - you need the divorce decree in order to file on your own.

You do NOT have to remain with your husband. Your legal status is not dependent on your living with him. As long as you're still married, your green card remains valid. USCIS will not take any steps to revoke your status while you are still married, even if you are separated or have a divorce pending. Once the divorce is final then USCIS may take steps to revoke your status, which is why you should file immediately after the divorce.

If you move, be sure to notify USCIS of your new address. I recommend you don't leave the US until your divorce is final and your conditions are lifted, though. If your husband files any report or claim with USCIS while you're gone, it could put your legal status in temporary limbo, and you could have problems getting back into the country.

Minor point, but "fight for your right" is a bad choice of words. Immigration is not a "right" you can fight for. It is a privilege you request from the US government. From what you describe, it doesn't sound like you've done anything that would result in you not deserving this privilege. Collect your evidence of good faith marriage, file for a divorce, and move on with your life.

Revenge is ALWAYS bad advice in a divorce. Nobody is immune to retaliation. Seeking revenge only escalates the fight, and often comes back to bite you. My ex-wife's attorney tried this tactic with me, but she didn't know the "dirt" I had on my ex-wife. I told my ex-wife she'd win the fight if she continued, but she'd leave the court in hand cuffs. She fired her attorney, and we had an amicable settlement.

Apparently, you don't fully understand community property laws. The only thing that is "half hers" are assets that were acquired AFTER they became married. Anything he owned separately before the marriage is still his separate property. You don't automatically assume half of someone's assets when you marry them.

With her situation, and two kids already, she is probably already receiving public assistance. Every state also provides health care for pregnant unmarried and poor women, at no charge to them. She probably already knows this anyway, unless she is not very smart. Yet she was smart enough to pay her way to Morocco and back.

She is the one who must pay the $355 and file the I-130. But if no one earning enough money can sponsor you, then this is a lost cause.

It sounds like there was a failure of research here, she visits you, get married, get pregant and she already has 2 kids. She can barely afford to pay rent and eat so how is she going to qualify? Here is the link to the I864P, Poverty Guidlines, If its her, 2 kids with one on the way plus you...that will prolly be a family size of 5 by the time you guys get to NVC she is going to have to be making $32,237 a year. It really sounds like there was a massive failure going on here. Bad situation for you guys and even worse for your wife. You havn't even files the I130 or G325's yet and wanting to know how to expidite this...not good. Your looking at least 6 months at the USCIS then off the NVC were from what I understand you will be going into AP for background checks being your from Morocco so this could end up taking you guys well over a year to get approved.

Aucually, the USCIS could be employing people to come on sites such as this looking for people wanting to skate immigration laws, in which case a court order would force VJ to turn over the IP Address of the computer you are using and in turn another court order to said ISP would result in a name and there you go, they know who you are. This would take just a few days. Not saying that this would happen but you neve know...Heck anyone could get your ip address and whois you and use that ip to map your exact location in the world.

You said soemthing about foodstamps and medicaid. If you are receiving those benifits they how and the heck can you even think of bringing a foriegner here? If you can afford this process then why are you taking away benifits from a needy family, that is enless you are defrauding the goverment, in which case they will catch you and then the piper will be paid. My husband used to joke about how long the process was taking that I should just become a 'snowback' - that's a Canadian wetback . You should be able to remove conditions on your own. If I may say it almost sounds like you are in the marriage for the gc. I quote "(1) if i stay with hubby and he signs my 1-751, do i have to notify uscis that he is in jail?

If it was love, you would be forgiving of him and give him the benifit of the doubt and not asking if you could remove conditions if you divorce him. I am not making,passing or any such thing, judgement on you, just making a point. Maybe I am just misreading this.

I am a little shocked that people want this to continue in this manner? Sure everyone who already has their loved one can sit back now and lay low. But would you want someone else to go through the same heartache and trouble as you did before when you went through this process? I wish I could live in the land of milk and honey but I live in the land of taxes and big government and with that comes a government who doesn't care. Depending on the family size living in the house hold...if its mom,dad,future husband and you then you would need to be at $27,562 in income. For every other person living in the house you have to include them as well.

Keep in mind if they sign the I-864 then they are signing support for upto 10 years for you husband, regardless of divorce.

I would stay away from the K3 as it is much more expensive in the long run. The only advantage is it's a little faster 1-2 months but a CR1 is much much better.

Contrary to other postings, it is very possible to get expidited due to pregancy, I know, I was able to get my wife here prolly a whole 2-3 months early and I am not military. BUT your situation is different, your the USC so it may fall under a different catagory but hey it's worth a try, As I say "your the only one it hurts to never try". I do not think you can get expidited at the USCIS level though but I am not sure about this as I tried at the NVC level and was approved.

You can use WIC with no problems (it's means tested but NOT goverment funded). You can also use private not for profit services for your medical care. You can also apply for emerngcy medicare when it comes time to give birth. You apply for that like the day of or day after birth. You are allowed to apply for that but nothing else. This will save you $20,000+....the cost of the birth and hospital visit and all related cost for your hospital visit. My wife ended up being in the ICU after giving birth and our grand total was over 50k....all paid for by emegency medicare. Your able to get medicare for your child also as the AOS doesnt apply.

Take this from someone who has been dragged through the court system for violating a no-contact order. (my reason was over $19,000 in child support my ex was trying to screw me over, and the sale of our house....long story, but it was just to ask her something and I sent to jail for 7 days) DON"T DO IT by any means...txt message,friend,phone,email,IM,letter, 3rd party, ####### it doesn't matter YOU can not have any contact with him at all.The cops might let it pass one time but after that YOU will go to jail, even if you have kids. This is not something to $%^& around with.

As for your stuff you have all the legal right to it with or without a lawyer. Contact your local police (sheriff works better sometimes) and they must allow you 15 minutes to get your stuff. This is the LAW. What will happen here is they will escort you onto the property and you have 15 minutes to get your stuff. It must be your stuff...clothing,papers with your name, stuff that is obviously a yours and not his. Things you cant take...tv's,guns,computers,food that sort of stuff. The rest you have to fight it out in court. You had better start making a list of community property that you either want or want sold.
