  3. Hello, I read some older topics on VJ but wanted to check with recent travelers to see if anything had changed (higher tax, fees, etc.).

    What docs are needed at the airport for an e-ticket? I purchased the tickets from expedia with credit card so does she need a copy of the card? Does she need to go by the airline, NWA, before the flight?

    Also, I've read the travel tax is 1650 php and the airport fee is 750; is this still the same?

    Are there porters available to help with bags?

    When she go to the counter to get a boarding pass, she just need to show the email regarding the confirmation of E-ticket.. No need to show the credit card or anything. Once she gets the boarding pass, and she is ready to go inside,and check in, there is another counter where she will need to have pay the counter for travel Tax before they allow her to get inside.

    I always travel with E-ticket back and forth to US/Asia/Europe.... they just need the confirmation number to verify details.

    The bottom line is always have a pocket money when leaving the country.

    It's of course natural for a Spanish Filipino to bestow his devotion to the land of his ancestors. And it's true that not many Mexicans truly revere Spain because not too many Mexicans are of Spanish lineage. What, do you expect the Mayans or the Aztecs or the Tapatios to allude to Spain as their mother land?

    It would be as odd as me fondly talking about England as the motherland of the USA. It's one thing to embrace one's heritage, but let's be real here - no matter how much Spaniard blood any Filipino wants to lay claim to, chances are they're as mixed as most Americans.....Chinese, Malay, Japanese. I suppose there are groups of Filipinos who think so fondly of Spain, but from what I've understood, a great majority of Filipinos look at the history of the Spanish Conquest with less than positive feelings. While I don't hold any grudges against England, I also don't refer to it as the motherland.

  6. My wife received her CR1 visa and we'd like to backpack around the world for a few months before we enter the US for good. The problem is that then we would be entering the US outside the 6 month window of her CR1 visa.

    So, we plan on entering the US on her CR1 visa, staying for a week or so, and then taking off on our backpacking trip. We'd probably get back to the US 8 months later.

    Are there any hidden gotcha's with our plan? Something we should avoid? Might they not allow her to re-enter the US after 8 months?

    If she received her visa, I would advise that she go ahead and enter the US and stay for 3 weeks or till she received her greencard, this way the green card will be processed and you have it before travelling. Once she received the greencard, you can travel anywhere, provided that she will come back in the US before 11 months.

    Now, prior to travelling, probably you should ask also if your wife need a visa to the country you are travelling, as she is still considered as Foreign national even she has a greencard..

  9. I went to my local USCIS office today to ask some questions about expedited naturalization. The person answering questions had no idea what I was talking about and claimed its not possible even though I was holding a USCIS document in my hand explaining it. I've called the USCIS customer service number a few times and get the same response. At least today she agreed to have a "USCIS lawyer" call me. I asked if I'd get a phone call today and the response was, "ha, yeah right." I'm attempting to do this without hiring a lawyer, but it is looking like I'll have to get one anyway.

    Hi I just did my Naturalization under 319b last March and did get an interview on june 08 and have the oath at the same day.. There is a lot of people that are not aware about 319 b. If you are a contractor working overseas, and your wife is coming with you A letter of Authorization or LOA, LOI will support her application for her. I did try asking a lot of question to different people before I filed the n400 in March 08.. I figure since nobody can give me information I will just go ahead and submit all the requirements they were asking.. I dont care if I will lose hundred dollars what matters is I tried it, since my GC will expired in Nov 08, I just told myself I will give it a try and I've made it.

    Here is what I enclosed in the packet (in order)

    1. Cover letter (stating you are working overseas and you are applying under 319b, your job, your company) I can send you sample if you want.

    2. Filled N400

    3. PICTURE

    4. Tax info (for for years, joint or not)

    5. a letter from the company (notarized)

    6. employment letter (job offer-notarized)

    7. Employment agreement (notarized)

    8. (2 )fingerprint card (done in US Embassy overseas)

    9. Greencard (photocopy)

    9. Passport (copy)

    10 CAC (DOD id of my husband) or any ID from the US company you work for overseas.

    11. LOI or a letter authorizing you to deployed overseas.

    12. husband passport

    13. marriage certificate

    14. if you have a child include a copy of his birth certificate/

I am a Greencard Holder and my husband is a US Citizen. We are now living in China (overseas) as my husband was assigned here and working in American own firm. And now we are sorting it out on my Expedited Naturalization process. I have couple of question in my mind and I hope you or other members will be able to help me.

    2. Where did you notarized above item 5-7? My husband's company already have given us Company Letter from US but was not notarized. Can we just notarized this here in China or any place? Does it matter?

    Below is the answer to your question:

    1. Where can I get/request those fingerprint cards? For COMPLETELY - did you do this in Philippines?

    answer: Call the nearest US embassy in your area where you reside and ask them if they do FINGERPRINTS.. I would prefer to just go to the US embassy personally to get this done.. The FP cards is FD-258.. Tell them that you will be using this for N400 Application.. Once they did FP for you, they will put this in the envelope and seal it and put a stamp on it and mark is for N400. You will pay a certain amount of fee.. I am not sure how much, but I did pay 100$ i think.. I did this at the Embassy in the Middle East.

    2. Where did you notarized above item 5-7? My husband's company already have given us Company Letter from US but was not notarized. Can we just notarized this here in China or any place? Does it matter?

    Since I work inside the base in the Middle East, I brought all my documents to the military legal office and they did it for me. For you, you can bring this to the Embassy when you do FP, and have your husband go to American Citizen services, I believe they do notarization there.

    3. With regards to item 10 - Department of Defense Certificate of Overseas Assignment - where did you get this? I assumed at US Embassy where your husband is stationed?

    The company issued this to my husband when he gets stationed in the Middle East.. We both work as civilian, so we both have this.

    What type of company does your husband works for? Is he a contractor for the US Government? If he is working in a commercial firm that deals with the US Trade..

    This is what your husband need to include in your application:

    A letter on official letterhead which states:

    o The title of the official attesting to the facts in the letter;

    o The name of the institution, firm or corporation and whether the official has access to the company’s records;

    o The nature of the business that the employer conducts;

    o The name of the State under the laws of which the employer was organized and the date of incorporation, etc.;

    o The ownership structure of the enterprise; and

    o The facts of your spouse’s employment, the basis of your spouse’s hire (contract, permanent employee, etc.), and the length of your spouse’s overseas employment.

    4. Who will issue this LOI? We are now living overseas and will just start process from here. so maybe this one does not apply for me as we are now living overseas?

    if he work in american owned firm, disregard LOI, this is only for US Government contractors .

    APO maill takes a while.. It is better to use the US address..if you have someone that you can trust to open the USCIS mail for you, to scan and send it by email so you can plan ahead for the trip... There are times that Service Center scheduled interview after 3 weeks of receiving the notice.. With the APO mail system, sometimes mail gets too slow to come.. You might miss the interview..

    Been there done that...dont want to happen to others.

    Hi guys! Thank you so much for your useful info. I am trying to fill up my N-400 based on 319(B) and it's really good to know about the address since it will really make a big difference. We are living overseas now but have an address in US. So we will use our US address. By the way, to all of you particularly COMPLETELY :dance: who seem to be an expert on 319(B) :yes: , have a question with regards to N-400 PART 7. TIME OUTSIDE THE UNITED STATES. My situation is that I am an Permanent Resident in US since May 2008 and my husband is a US Citizen working in Abroad with a contract of 3 years. I didn't process anything in the US before I left on June 2008 as we were planning to do the process from overseas. We are living now overseas for like 7 months now and we just started our process as we were still gathering our requirements. Now my question would be:

    1. N400 Part 7 -Time outside the US, they asked this questions: How many total days did you spend outside of the United States during the past five years? - In my case, 7 months now since I left the US. So, do I have to put 7 months?

    I am very confident that somebody will give me a clear answer with regards to this topic ESPECIALLY those of you who are applying for 319(B). Would really appreciate your help and enlightenment. :)

    US ENTRY: 11/09/2006

    DEPART US: 12/9/2006

    2ND ENTRY TO THE US: AUG/1/2007

    DEPART US: AUG/10/2007

    DATE OF FILING

    COUNT THE DATES FROM DEC 9, 2006 TO AUG 1,2007 - THIS IS THE TIME YOU WERE OUTSIDE THE US,

    THEN I HAVE ADDED THE DAYS FROM AUG 10, 2007 - UP TO THE DATE I SENT THE N400 APPLICATION

    the total of this will be the days you are outside the US.

    Since I did 2 trips, I put 2 trips in letter B in Part 7. then 443 days outside the US

    You have to list down as well the countries you have visited while outside the US.

    Please be noted that if you are overseas for 7 months already, make sure that you travel back again in the US before May 2009... As we are not sure, when the USCIS will send us the dates of interview.. I wish you did not wait till 7 months, before you file the application, this will be a lot easier for you. Remember you havent sent the application yet, meaning you still have to leave and enter the US in a yearly basis..

    I see what you mean about the 45-day rule. I was thinking that, in our case, we are "moving" back to the US on 23 January and the "moving back" overseas on 5 April, but we could make a very good case to the IO that we are already "residing overseas" and we just came back for the interview, in which case they may not mind if our return is 51 days after the oath. We'll see!!! I can't wait....we only have 3 and a half weeks to wait, and my wife is studying all the time! The new English test looks weird. It's all words that have to do with US history, like "George Washington" and "father of our country." Being able to pronounce the founding fathers is a different test than the old "My dog has fleas," or "She goes to the supermarket to buy groceries" tests. We are going to have a lot of new citizens who know all about US history but can't find their way to the grocery store. ;)

    I hope everything will turn out great for you all.. I am also nervous even I am done with this that some officers does not have much knowledge in 319b act.

  14. Seriously, I am filipina but I dont like to see topic like this.. Admit it or not, some people will get offended.. We Filipinos dont want to be generalized, dont want to be treated badly, but let us respect also others that does not want to be generalized as well. I love equality and hate prejudism...This is how racism starts. Of course some people will react and the more people will respond to this topic..

    Lets just say, that we never looked for someone outside,, it is just coincidence that God gave us different person with different values in life that will understand us more.

    I never questioned my husband as why he chose me, as I believe it was destiny that brought us together.

    This topic is becoming non sense as it seems like proving who is better than the others.. I believe wherever you came from or wherever I came from has nothing to do with being a good wife... Everyone is capable of being a good one... No offense meant to every one.. Bad apples and oranges are everywhere..

    We Filipinos hate to be discriminated but we should stop bashing and proclaiming that we are better than others.. This topic needs to be closed as people will respond and respond more and will just offend more people.. I do not disagree to everyone.. this is a regional forum, but everyone can read everything we post here. And everyone has the right to react....

    It is not right to bring up the past from ex's, what happen before should be forgotten and just think that everything did not work for both of you..     Based on the requirement above.. from what I understand and interpreted is that, if a person is still in the US at the time of filing 319b, she needs to show the evidence that she will be joining her husband overseas within 45 days of her naturalization... Our case is different, as we are already overseas, when we filed 319b... Try to read this 3 time "You must show evidence that you will depart to join your U.S. citizen spouse within 45 days of your naturalization" and you will be able to have some shed of light on this.

  17. so my fiance and i are overseas presently and we applied for a K-1 in november. we've decided to stay overseas but obviously we still have the visa in progress. if we get approved, we'll still get married in the US, but we'll just head back abroad instead of living there and applying for the green card.

    does anyone think this will have an impact on them approving or denying the visa?

    we couldn't get a tourist visa for him, we didn't even try...single guy, no assets, etc.

    Do you work for american company overseas? Because I have a friend here, shes under K1 Visa got approved and came back in the middle east after being in the US for 3 weeks.. They got married there and came back here and applied for Advance Parole. Now she is holding a Conditional Greencard.

  18. I don't think you're allowed to bring a camera into the building. Does anyone take a picture at the oath ceremony? It would seem they would be allowed at such a meaningful event.

    Yes you can.. A couple next to me brought a camera and took pictures same as the others.. I regret that I did not able to bring mine as I was alone and not allowed to bring the electronic device inside even cellphone at the time of interview.. But they did allow it at the oathtaking ceremony.

  19. Yes, you can come with her at the time of her interview.. But you can not come inside the office when the officer interview her.. You can be there as moral support for your wife..

    Remember your wife filed for herself, you are not the one who filed for her to be a citizen.. so therefore your appearance is not really needed but it is great for her for you to be there, while waiting for her name to be called.

    I am writing because one of our fellow 319b applicants was declined at the last minute (after a 7 month wait), because the officer that interviewed his wife said they had not been married for 3 years. His immigration lawyer is now making his case to the officer, and hopefully there will be a happy ending.

    I read the Immigration and Naturalization act many times before filing and talked with a few lawyers. Being married for three years has nothing to do with citizenship! Being a resident of the US for 3 years is a requirement and being physically present for 18 months is a requirement, but both of these are waived if you apply under 319b.

    I am especially concerned because my wife and I are going to her interview in Atlanta in three weeks, and do not want the same thing to happen to us!!!!! Yikes!!!

    Thoughts, anyone?

    The officer might be new and do not know what she/he is doing.... When you applied for 319b, it waives all the physical presence in the US provided that you have strong reason why you live overseas..

    My co worker did get approve first before me, and they are not even married for 2 years.

    I reside in Cambodia and filed for citizenship under 319b in November, and if anyone can help me with these questions I'd be really grateful. This is all so stressful!

    1. My fingerprints were rejected, because apparently the US Embassy in Bangkok is giving out the wrong forms. Anyway, I resubmitted straightaway. Did anyone else have this experience? How did it effect your application? How long do fingerprints normally take to process?

    You are not the one who can choose the date of interview, the Service Center will do.. So you dont have any choice if they gave you an appointment date after 3 months or so.. You have to cancel all your personal appointment, and take this interview as the first priority.. Once you re scheduled this appointment, it will take a while before they gave you another date of interview...(based from experience from some of the people I know...) Until now, they have not gotten any dates.. since 2007

    They said the USCIS website is up to date.. But for me, my file never been updated online.. I received my notice last minute.. and if my sister in law did pocrastinate sending my mail, probably I missed the interview.. My advice is if you used the US address, make sure the receiver opened the letter for you and scan to you and send it to you by email.. So you can plan ahead if the dates were to early.. Unlike mine, I have to buy a last minute ticket.. and it way so expensive...

    You can apply anytime after the oath, I would recommend that apply the passport while you are in the US.. Some passport agency has rush service, the fees may be doubled but you will get the passport quick.. I did apply passport overseas, but I have experienced a hard time from the consul, said a lot but later released my passport.. So better do it in the states, and also adjust the citizenship status in SSA Office as well for your SSN.

    5. Which brings me to my final question: due to my husband's US Gov't contract, my interview needs to take place before March 31. However, we need to come back to the US in May for a friend's wedding. This unfortunately puts me out of range of the 45 day rule under 319b, meaning I'd have to make two trips. Since my husband will be coming to the States on May 8, is there any way an officer would allow me to stay until May 8, if I can show evidence of my husband's trip (a ticket, for example)?

    I dont know where did you all get this information that you have to leave the states within 45 days.. I believe that the immigration there does not scrutinize you whether you filed citizenship under 319b or not.. What matter is you have a US passport when you leave and a US passport when you come back.. Officer wont ask anything about this as you are already a citizen of UNITED STATES.

    1. No, my wife's fingerprints seemed to work fine. We had them made at the Embassy in La Paz, Bolivia.

    2. As far as adjusting your availability I do not think that is possible. You will get an interview when they give it to you and you have to be there or you will have a hard time getting a new one. This is at least what I heard from people who had tried to change their interviews or ask for specific dates.

    3. The only way I know of that you can check the status is by emailing or calling your US representative's office (or senator). They have a way to find out quickly. That's how I found out our interview date two weeks before the letter arrived.

    4. A passport can be gotten within a short period of time. Do a search for "passports" and you will see hundreds of stories. Lately, people seem to be getting them in 6 days, with our without paying the expedited fee, but before you had to pay expedited fee or wait two weeks. My guess is that you can get it in 3-4 days if you were willing to pay for a courier service and expedite fees. I don't know that, however, and we are allowing 2 weeks. There is also the option (of dubious legality) of leaving the country and applying for a US passport at a foreign embassy. One 319b applicant did that and it worked, despite the fact that she was given a hard time by the consular officials.

    5. No idea about that one. One would think you could get citizenship and get the passport and then change your plans due to unforeseen circumstances. At the time of the interview, however, you are supposed to show that you would be leaving within 45 days of the oath. One idea: ask the officer to schedule your oath for April. The only scary part is: what if they don't give you an oath letter until the summer....you would still have to fly back. My guess is that the USCIS will not be pleased if you are not planning on leaving within the 45 days. It is one of the few time constraints on 319b filers, and I can't imagine that are going to be flexible. It is the law, after all, that you be planning to leave. It's all about "good faith," it seems to me. We are in a similar situation b/c our flight back is 51 days after our interview. We are trying to decide whether to move it now or just explain to the officer that it is a flexi-ticket and we will move it when we have the cert of naturalizatoin in hand!!!!) :)

    Thomas I am really curious as where did you get this information?

    Just a note that make sure that your wife can fly at the time of her interview.. I know she is pregnant right now.. The airplane will be asking for a medical certificate.

    Any nationality not only filipinos ccould stay in the cafe just to meet someone on line.. Some are just checking emails and just by coinsidence got bored and log on to YM or any chat rooms..
