we are not submitting : common house ( as she is declaring bankruptcy)

joint insurance ( as we have individual insurance from workplace)

we wd be sending a cover letter explaining the situation.

Let us know about you list of initial evidence. I think you should write a letter that you do not have children. I am not sure why they are asking from marriage date to present. So they are expecting you to send 2 yrs worth of bills ? I thought we are supposed to send only the most current bill.... on the 2nd thought one bill from the time of marriage and one recent bill can also be sent. Did you in any case show taxes file jointly from the time of your marriage ?

I would like some senior members to give some imput here. Thanks

  2. Well I posted in the thread again as we have a new dilemma  . This was our previous evidence list as you can see on my 1st post :

But as my wife is appyling for Bankruptcy most probably we have to split the accounts as showing comingled finances may hurt. What we can do though is put my salary account on my own name. Then open a new joint account, put her retirement money in that. We can show both the accounts to USCIS . We can also show the bankruptcy paper.

Wd that be ok ? Any advices and imputs wd be highly appreciated. Thanks

  3. Thanks Lechatnoir, i did send you a pm regarding some bankruptcy questions.... as you said " scrutinize your payments to "creditors" before you file and if you pay anything that is over 600 dollars in the window of time that they are examining, it might be questioned"

what kind of questioning are you talking about? Explaining that we payed for the bankruptcy wo`nt help ? My wife(USC) is filing for bankruptcy and I am filing for removal of conditions.

    Thanks

  6. As Vanessa&Tony said " It WOULD matter if this was AOS but it doesn't matter for ROC because the Affidavit of Support was approved at the AOS stage and carries through the ROC process. You don't need to prove income at the ROC stage. The contract is still binding." - I am a bit confused about this as they approved me on her sponsoring me on the I-864 on the fact that she has enough earning. The fact is though she is filing bankruptcy her income remains the same.... so ideally they shd not have any problem with that.

Anyone else replying this would be highly appreciated.

  7. Thanks Vanessa&Tony and Anh map. Yes we are waiting to meet her lawyer with a bunch of questions. No we do not have a appartment lease as she owns her house and we have not put my name on it only because her bad credit may affect me and because of the plan for bankruptcy. But we have common tax filing, drivers permit, company hr profile showing the same address and her as my wife, loan account showing my adddress. Hope this wd be fine.

  8. Hi All,

My conditional green card expires in July,2011. Thus we have to apply for ROC in april. I am collecting all evidences. Here is a approximate list :

    1)Joint Bank accounts

    2) Joint Tax Returns

    3) Company online salary account profile showing us husband and wife

    4) NO Joint Ownership of property ( we are stating we cannot as my wife would be decalring bankruptcy and her bad credit may affect me )

    5)Joint car insurance

    6) NO Joint Credit cards ( we are stating we cannot as my wife would be decalring bankruptcy and her bad credit may affect me )

    7) Common address in photo ids

    8) Common utility bills ( electricity, water and trash )

    9) Joint AAA membership

    10) Joint stock holdilting

    11) Common Phone bills

    12) Joint cable bill

    13) We have a small business together

    14) Joint membership in cultural organisation

    15) Joint Dog registration

    16) Hotel receipts and pics of honeymoon.

    17) Letters from friends and her daughter.

    18) Joint loan for buying a washer.

    Here are my questions :

    A) Problem is my wife wants to file bankruptcy and if we do that we have to take my name out of the joint cheking account account we have. I can still pay the AOS money from my salary account but then wd`nt seperating my name from the joint account weaken the fact of joint finances ??

What should we do ? Should we wait until I get the 10 yr card or not showing a joint account account wd really affect ( we can explain the situation on he pictthe cover letter though )

    B) Regarding pictures : Do we need to show pictures from the time I am here ? means the pictures we showed in the last AOS interview can also be included ? or shd we show only the new pictures we have got for the last two years ?

I would appreciate all responses and advices . Thanks a lot

  9. Hi Chipsahoy,

Thanks for consulting visajourney. I personally have not faced any condition that involves any term named IF-1. I am still to apply for my lifting of conditions. I did some research though, looks like its a approval but its just a condition that got changed from a fiance visa , till you dont get your 10 yr green card. I may be wrong. I hope sopme other members wd come in and remark here. You can go through these links and try to understand for yourself.

"IF1 Alien whose record of admission is created upon the conclusion of a valid marriage contract after entering as a fiance or fiancée of a U.S. citizen. Sec. 214(d) of the INA as amended by PL-91-225 (Apr. 7, 1970) - ((Adjusted status))" ...

"When the petition is approved, you will get a letter from USCIS (INS) notifying you of the decision. Your new permanent status will be coded depending on your original status. CR-1 becomes IR-1, CF-1 becomes IF-1 etc. If there is a K2 involved, they will get a separate letter from USCIS (INS) notifying them of their status, which will be a IF2, or "Immigrant Fiance(e) 2". ". I found this at LINK

  10. Ive got to agree with Vanessa&Tony in the fact that everything is so similar but yet different. Yet at the same time this makes it more interesting for me because explaining to the in-laws or friends, how we do this or that instead of the way they do it, its fun to see their reactions sometimes.

The one big thing that gets me about living here and makes me sigh everytime is the fact that people can't understand me most of the time... Now i know this is not there fault, i come from Liverpool, and I have a very strong accent. If you have heard the Scouse accent you will know what im talking about lol. Sometimes I have to explain myself 3-4 times, im dreading going for job interviews or phone interviews :(

Advice? I talk to people from back home quite a lot, parents, family, friends at least 2-3 times a week. Friends/Family a week message on facebook and my parents i give them a phone call or a quick email. For some people its the little things that matter, maybe get some things that she used to enjoy at home. For me I make sure I check on my football team ive supported since i was a kid (Liverpool). Ive got shirts that i wear regularly and also a big flag that needs to go on the wall :)

I walked into Wegmans the other week and noticed they had an international section. I walk over and see a whole aisle of items of imported products from back home i was like "NO F*****G WAY!!" i hadn't even really thought about it haha. So if im ever home sick im going to go buy myself a double decker or bottle of lucozade ;)

I know each to there own but i hope this helps... :)

1stly I want to say what is going on with you Bob. I do somewhat agree with Pumpkinpie and do like the comment from JMR.BUt certainly do not like what Rlogan replied . It is my request to Rlogan- please try to honor thier love and togetherness and say something that would help them instead of giving them frustative words.

American culture and interhuman fellow feeling is unlike Asia. There we comingling a lot and there is lot of fellow feeling and interneighbour interaction. These are mostly unheard about here. I am saying these both from experience and heart as I am going through the same condition as your wife.

She is feeling lonely, alone and lack of feeling of expressions. Some asians do change after coming here and feel so proud to forget all about their motherland, language, culture and becoming americanised.I have seen the same amongst some indians. Some others stick to their old ways and do not try to take anything from here, which is not good either. I try to maintain a good balance to maintain my be proud of myself being an Indian and also gather good values from here. My indian friends in INdia are far more better than americanised indians. So how many friends she has here and how much chinese can can speak outside and with you really does matter a lot. I have limited ways of expressing my core feelings as my wife, who is american, doesnt speak my language. My wife understands that and trying to learn my language too.

She is basically agitated inside and suffering from lack of expression, culture shock, may be some racial factors too.

My colleagues in my office try everyday to humiliate me in every possible form they can find, like calling me 'Curry terrorist'.... thrid world guy etc etc. I sometimes gulp those in and sometimes reply them back with somewhat harsh words. I simply cant talk the imperdinant and nasty worded way some people talk here and they seem to enjoy and make fun of the way I am gentle spoken and well behaved. I am taking all these as i love my wife.Feeling unwanted and feeling secluded in terms of language, culture etc etc does seriously affect some people. I am sure she like american food....just wont eat them as other factors have got her deppressed her a lot inside.

Try to have more in chinese culture with her more often. As my wife tries to a lot of Indian things at home, we go to indian temple and festivals together, she and I cook Indian food and watch Indian movies.. I dont know about you , but if you dont try to learn some of her language and culture if you love her. That would certainly help. Hope this helps and i would try to comment some more here in future.

    Take Care.

  11. I teach HS and it is terribly difficult for a student to enter from another country into an English school. Not only is the language barrier an issue, but the cultural differences are HUGE. Often these experiences are very negative and takes a huge emotional toll on the student. If she doesn't NEED to enroll, I suggest you find an ESL school near where you live and enroll her in one of those.

Moving countries when you are only 18 is difficult enough, let alone going to a school with people who have been in school together for 4 years, in English, within US standards. And with budget cuts in US schools, she may not receive the benefits (ESL teacher etc) that she normaly would

    Good luck

I agree to her. The cultural difference is huge. Then depending on where she is from there wd be other adverse things like racial ignorant comments etc etc.Adjusting to USA is a life time work, its still very racial country. Some succeeds, some dont. Enrolling her somewhere near to her wdbe th best. Good luck
