Hello everyone,

I have a problem that I hope someone can give some feedback on. My fiance will be arriving in the states on a K-1 visa, after which we will get married and file for AOS. I have had significant credit problems and am considering filing a form of bankruptcy in the near future. My question is, how will this bankruptcy filing affect his AOS approval? When we submit the support papers for the AOS, I will have a co-sponsor. I actually had to submit a notarized I-864 from myself and my co-sponsor back in June to the Embassy in Accra, Ghana, in order for our case to be approved. Will I have to submit this again for AOS or will the government have it from when my fiance submitted it to the Embassy? Will my filing bankruptcy cause a denial for AOS?

Two separate processes (AOS vs K-1 Interview) - for AOS, you'll need to submit all new forms.

I can't see how bankruptcy would affect your AOS - might affect your credit rating, but USCIS doesn't run a TRW on sponsors.

A bankruptcy will not affect the AOS. They don't care if you default to creditors. If you can prove sufficient income they are happy. They do not care because all the poverty guidelines ####### is to cover their @ss. If your SO becaimes a public charge they want someone who's income they can garnish. They garnish wages ahead of everyone, including income tax, so they do not care about your debts etc. They will get THEIRS first. Your other financial problems are your problems. Just in case you ever thought the government was doing this for your own good. That will be the day!
