  1. Shame you didn't adjust while she was here in the U.S. That is what me and my husband did successfully (we married on the spur of the moment on my last visit). However you will be ok (as you mentioned Spain is not a 3rd world country with high fraud rate) and I'm sure it won't take that long for your K3 to be approved.

    Unfortunately I have no idea about how the embassy in Spain works. Never been there (I was a UK resident so my situation was different since I was not living in Spain) however, the sooner you guys start with the process the better. Good thing is that she will be able to travel freely in the VWP.

  2. I hear you... Loud and clear... I come from the UK and I had an awesome job in there, I worked as a university lecturer for years, I hold two BAs and a Masters degree not to mention I speak a few languages and have very good recommendations and credentials... My current job in the US is underpaid and very much beneath my experience, skills and education but such is life, we all take and give and make sacrifices for our loved ones. I suggest you keep on pressing forward and eventually you'll find a job that will match your expertise and qualifications. GOOD LUCK!

If you are already in the US I would say get married and adjust status (that is what myself and others on this site did successfully), however if you had the intention to immigrate when you entered that would be considered visa fraud. If you came here on vacation and the two of you decided to get married in the spur of the moment and adjust status it is ok to go ahead, but you will have to take into account the fact that if you wish to proceed with this route you won't be able to leave the U.S until your case has been resolved. Also bare in mind that you'll have to prove that you didn't intent to immigrate at the POE by showing proof of your ties to Ireland.

    For what I'm ready it seems the better option would be to apply for a K-1 (fiance visa) and start the process from abroad. Since you are from Ireland obtaining a K-1 visa won't be so tough and therefore you won't be jeopardizing your chances to immigrate to the U.S.

  4. I am wondering if other users have had the same experience.... I received my I-797 Notice of Action on October 10th with the request to show up for our AOS interview on November 12th. So far so good. Surprisingly, this doesn't show up in my Case Status on the CRIS website. In fact, none of the related applications I-130 and I-485 were even touched since they were first received by USCIS. If the I-797 had been lost in the mail I wouldn't even know this interview was already scheduled or a letter had been mailed. I can hardly believe this is how it is supposed to work!

    Did your NoA letter for the interview show up on your records?

    It is not unusual. The interview would not show up online. I had the same experience. I was scheduled for my interview and neither my I-485 or I-130 were touched, I just received the NOA in the mail.

  5. Hi there, just a quickie...

    My husband and I just relocated to a new address. I had my AOS approved on the 8th October and I already have my conditional gc.

    At the interview we explained to the immigration officer we were going to be moving to a new address and she told us to do a change of address online (which we did), however she never mentioned anything about sending another affidavit of support.

    Do we have to submit a new one even though I have been approved? I'm a little bit confused about this. Do you guys know?

  6. March filers have been processing for a while now... I applied in March for example and I already have the green card in my hands, others who applied same time as me where done way before I did, so it all really depends of the local office and the backlog of work. Maybe you case is delayed for some reason, I noticed you had a RFE that might've delayed your processing time.

  7. We did almost the same exact thing. We got married while hubby was on a VW. We called the Australian consulate here in Denver and they said that the liklihood of them approving us was slim. Hubby had to go home. He left in July and we are still waiting. I don't want to ruin your hopes but you should be prepared for the fact that you may have to return home. We thought that it was going to be easy to adjust but since the intent of the VW is very clearly stated, it is hard to prove your intentions. It really sucks. You don't want to overstay that waiver or it could cause some real problems. Hubby overstayed by two days and so far everything has gone smooth but I say stick to going home and then coming back on a K1 or K3 or CR1. Best of luck in whatever you decide to do.

    How sad! You guys could've adjusted from the US. That is what I did. Inever had any intention of immigrating at the port of entry, I just came on vacation and later on my then boybfriend (now husband) proposed to me....

    I'm afraid to tell you the Australian consulate gave you wrong advice. It is perfecly legal to adjust from VWP if there is no immigration intent at the POE... I wish you guys a speedy immigration journey. Good luck!

  8. Sorry to hear about your experience. It is important to be REALLY prepared at the interview and take into consideration EVERYTHING. You never know what they are gonna ask, what documents what pieces of evidence and I believe being prepared is imperative.

    However, in the event of you getting a denial I believe you can get a motion to re-open your case, sometimes they might ask for the couple to attend a second interview.

    If I was you I would try to collect as much information, documentation, evidence, etc... try to make an infopass also if you don't hear from them in a few days. I wish you all the best of luck! I'm sure everything will be ok.

  9. When I had my interview and was approved the officer told me that she had to tell me that the card will arrive in 90 days, however that they do arrive normally within a couple of weeks after being approved.

    Did you get the approval notice in the mail? You should be getting a letter and soon after that your green card will show up. I'm crossing my fingers for you mate! Good luck!

    My interview was fast and painless. The longest time was spent at the waiting room.

    The questions asked:

    Date of Birth

    Passport and ID (she asked for my passport an my husband's ID)

    SSN

    Where did you meet?

    Have you ever been arrested?
