I'm curious, and have a question of my own related to this topic. Since the beneficiary will be immigrating to the US...and if the beneficiary is not reqired to work, does that mean that the beneficiary's income is not considered while going through the K1 process/looked into at the consulate/embasy interview?I know the petitioners income is required, but I was just wondering.

I was told that the affidavit of support gets filed with the information in package 3 when you receive it(I posted a similar topic). That it is also used for the consulate/embasy interview. As for the poverty guidlines it is 125%. You should check out the links that Karin und Otto posted, it should be able to clear things up for you. I found the links to be helpful to me. Good Luck!

Thank you both very much, and here I was all worried that since I have not heard anyting yet that I would have to apply for an extension. I just thought since it seems like my process thus far is taking longer than it should(at this point), that I should have heard something from the montreal consulate by now? To my knowledge my lawyers have said that the consulate has received my petition, and is processing it. So I'm waiting on Montreal. Would this change anything?(if the consulate already has it?)or do they issue a new validity date once they send the required information to me?(if the orignal one is close to expiry?)

In theory it means the petition approval expires. The visa application must be submitted during the validity period or the beneficiary is no eligibile. Practically speaking, the consulate can extend the validity period (in 4 month blocks) if need be.
Thanks for that info. Just out of curiousity, when should one contact the consulate to extend the validity period? and the visa application you are referring to is packet 3? or everything including and after packet 3 that the consulate mails? I just dont want to take any chances, and want to be prepaired incase I have to extend, if need be.

Hey All,
I was wondering what the validity date means? and what happens when it comes close to or on the date of expiriy? (the I-797) I'm still waiting for my information from the Montreal Consulate, and my I-797 is Valid until November. Realistically November is not that far away. Just curious.

You haven't recieved your packet 3 yet?? And you got approved in July?
I would be calling NVC to see if it had left in July, and if it had, I would be emailing Montreal or Vancouver (whichever you are going through)
I got our NOA2 on Sept 1, and had my packet 3 by Sept 20....
You and your SO need to make some calls to see if it is in Security checks or something at NVC, or to see if your packet 3 got lost in the mail from Montreal or Van...that seems like a long wait.
Did the USC get a letter from NVC saying that your case had been forwarded to the US Consulate in Canada?

I thought that it is a long wait as well. We have been making calls as well as our lawyers. My fiance and I received a letter saying that the NVC received the approved petition, and within a few weeks will be forwarded to the Montral Consulate. Since, I received that letter, I have been in contact with my lawyer every 2 weeks or so(sometimes sooner). Last week I e-maild my lawyer, and he got back to me right away saying that he would contact the NVC and Montreal to see whats going on. On the same day I got a phone call from his assistant saying that it has left the NVC, Montreal has received it and are pocessing it. Montreal has not given them(my lawyers) a date as to when I will get the info, but told them (my lawyers) not much longer. So, I know the petition/information is in montreal...Im just waiting on them. I still can't help but worry(I hope it has not gotten lost), and I wanted to see if anyone else out there was in a similar situaton. What do you mean by security checks?

back to the topic though... I was wondering if there were still March 2008 filers out there waiting for their package/interview date? (not necessairly canadians applying to go to the us) but anyone? Im anxious and worried that I havn't heard anything yet

does the customs officer need to know that you are visiting your fiance?
The customs officer does not care. Everyone is subject to refusal. The more information that causes the immigration or border post officer to believe you are at risk of not returning to Canada, increases your chance of denial.
So can I just tell him I am going for a short vacation to visit friends? I am coming back. I have a return ticket, employment letter, etc. etc.
If you're worried about getting stopped at the border/by customs, you can always bring proof/evidence of your ties to Canada that will show that you will be comming back to Canada
But, I see that you have mentioned these things. Good Luck!

I'm a little confused and was wondering if someone would be able to help me? I was wondering at what part of the process the Affidavit of Support will be filled in? is this something to be filled in once the K1 visa is approved and has been activated? Is this the Affidavit of Support used for my fiance (petitioner) as well as a co-signer if need be? I was also wondering if there was a difference between a joint sponsor and a co-signer?

The beneficiary will have to bring in form I-134 signed and notarized along with financial documents to the interview. If the petitioner doesn't make enough, he/she will need a co-sponsor. The co-sponsor will also have to fill out, sign and notarize a separate I-134 along with financial documents.

Glad to hear you haven't had any problems so far, reassuring me like I said! How long ago did you guys first file?
I filed in march, have received my NOA1&NOA2 just waiting on my interview date now. The montreal consulate has received my information from the NVC and its being processed. I know this because my lawyers have contacted the montreal consulate and my lawyers were told it shouldn't be much longer. So I'm anxiously waiting. I also heard somewhere that montreal is delayed(not sure if this is accurate or not?). Other than that I was told that my process thus far is where it should be. Hope my experiences are able to help you somewhat. Best of Luck!

I printed mine on a home inkjet using 4x6" photo paper. I bought address labels, I think they were like 3x4" stickers and printed the date, location, and made comments on who was in the picture, what was happening, etc.
Those photos seemed to be fine as part of the documented proof of having met in 2-years as well as proof of our ongoing relationship.
We got our NOA2 and my wife passed her interview at the embassy.
Congrats on your wife passing her interview! I do agree with alot of these other posts, It doesnt matter as long as they can see the pictures, and that they represent a genuine relationship and that you will be able to provide them if need be for the interview.
Thanks! I only happened to mention it because a few previous posts said they had used their home printer, but have not received their NOA2. So I only mentioned it as a data point to the fact that home-printed pics seems to be acceptable.
No problem! I have received my NOA2 as well and I used my home printer, Im just waiting on an interview date at the moment.
We did, but we are still waiting on our noa2, so can't give you a complete success story yet.I had ours printed from my home printer and sent it off to USCIS. We received our NOA2.
At least it will be reasuring to others...knowing that photos printed at home seem to be acceptable!

I was thinking of taking the train as well to get to the interview...but I was also debating on driving. Right now the means of transportation seems to be higher in cost because of the rising fuel costs, well here in Ontario anyways. For the time being Im just anxiously awaiting to find out when my interview date is to begin with. Best of luck to you!

Well... it's 'possible' because she can leave the Coutry any time she likes. The problem is she wont get back in. The K1 is a one time entry visa. If she leaves the Country before she has AP (advanced parole) you will have to start the process over with a spousal visa.
After you are married you will file for AOS (adjustment of status/2 yr gc). There is a $1,010 fee that covers AP and EAD (work authorization) as well. I think the timeline for getting these right now is about 2-3 months. She will need this before you travel out of the Country.

I never knew that either, it never showed on mine...mine still says that they received my information and that my case is pending since march 12,2008.... since then i have gotten both of my NOA'S and im waiting on montreal for my interview. Or maybe things show up differently for me because im going through a lawyer?Ah well. Thanks for the info!
