  1. This entirely depends on the embassy you are dealing with and the appointment system they use. I would reschedule the appointment to fix the issue - otherwise you might be refused at entry.

  4. I (and the others) implore you: Do not perform any ceremonies of any kind, official or unofficial, if you are going for a fiancé visa (K1). This can end with a denial of the visa because you are "too married", even if you are not officially married (!). Celebrate your relationship, but ensure that it doesn't even come close to looking like a wedding (so no special dress and suit, no walking down the aisle, no holding flowers, etc).

  7. Hey everybody, So I did get an appointment notice for my biometrics..but I am unsure whether I am supposed to go or not since my case has been rejected? The USCIS live agents are no help unfortunately.
  8. Rule of thumb is to spend twice as much time away from the US as compared to the time in the US. You seem to be under the impression that there is a notion of fairness and equal exchange when it comes to access to the US for visitors. This is most decidedly not the case. Visitors are always assumed to have immigrant intent and the visitor is burdened with the task to prove that they will leave the country in a timely manner and that they will adhere to the visa that has been given to them. The manner of conduct of the CBP officer is annoying, but not out of the ordinary. The way that your fiancée used the tourist visa is out of the ordinary (staying longer than intended and returning very quickly after the long stay) and the CBP is right to suspect abuse of the tourist visa. Remember, the burden is on the visitor to prove otherwise.

I am almost done with the new packet :). question I am doubting about, maybe someone can help: On page 8, Part 4, Item 5 I am asked if i previously applied for permanent residence while in the US. Now, I know rejected packets are seen as "never arrived at USCIS", so I'd expect to answer "no". Would that be the correct response?

  11. Alright my friends, for the concluding chapter of this particular ordeal.... After chatting with a very helpful live agent through Emma, we found the issue. When we opened a joint checking account at our friendly local credit union, the union printed us checks. These checks only had my husband's name on them. To ensure that the checks could be cashed, my husband signed these checks. This would be our doom. USCIS does NOT accept checks in your spouse's name. The applicant and ONLY the applicant can make the payment. We feel silly and stupid to not have thought about this issue beforehand. It is an easy fix, fortunately. USCIS will NOT be returning our packet. It has been destroyed. We made a (partial) copy that we are going to finalize and send.
  12. Today I got my rejection notices in the mail. It says that USCIS will take no further actions. We were under the impression that rejected packets would be returned to the sender. This notice seems to state otherwise. Should we assemble and send a new packet or should we wait to see if our rejected packet will be returned?
  13. We wrote two checks - one for the I-485 and one for the I-765.
  14. We just received an update that notifies us that the case is rejected due to the check not going through - we are mystified by this as we filled everything in according to USCIS instructions. What is even more mysterious, is that we also received two NOAs in the mail which explicitly state that they did get the money (Total Balance Due: 0). We have no idea what's going on but we will keep y'all informed.

  16. The saga continues! My USCIS updated last night (at 3 in the morning) to tell us that there is a payment issue (which is surprising). We are quite sure that both checks are correct with the correct payment amount. I called our bank and they said that no attempts have been made to cash a check. I also contacted USCIS and they scheduled a Tier 2 callback......so fingers crossed that it's an issue on their side and our forms don't get rejected...
  17. Update: My NOA arrived! In a surprising turn of events, our checks have not been cashed but our NOA has arrived. I accessed the online account and it says the biometrics appointment was scheduled and an appointment notice has been sent. That notice has not arrived yet. Still, good news!
  18. I would say that that is not necessary - it would be fairly unreasonable for them to expect that. Remember, "I don't know" is a perfectly legitimate answer (if the interviewee doesn't say that too often). *edit: The general story should be enough, not exact dates.
  19. This is indeed a big yes. The officer could (and probably will) ask about it and assumes that your current wife knows. This kind of openness is expected of a bona fide marriage.
  20. Can she travel/enter to USA without me? Yes Do we have to enter the USA together? No Is there a risk of spouse entering the USA alone? Not really, but that depends on how well-informed the spouse is and on their level of English proficiency. The CBP will ask some questions during her entry.
  21. I did the same as Edward & Jaycel just to be on the safe side. Some people have been rejected due to not including the medical exam form even though k1 adjusters are not required to provide it. This letter points that out.
