One last question...would a lawyer benefit her at all with getting a tourist visa?
Thanks to this website and many others, I was lucky enough to get through the the K1 Visa process for my husband & him becoming a citizen by myself, no lawyers help. But maybe a lawyer could help my MIL in this situation...?
-
Thanks everyone for chiming in. I'm really having a hard time digesting all this info when I had originally thought this would have been a simple process.
I just don't see my MIL getting approved for a Tourist Visa. Of course it could happen but I just do not see them approving her, which is completely screwed up.
My MIL was counting on me to help her with this, hopefully my support will be enough for her to go get that visa herself.
Thanks again for all the advice.

She should at least try to get a visitor visa.
She should say that she has no intention of living in the US.
I have seem cases in which parents with no property, retired, etc. got visitor visas. So it is possible.
I totally get what you say. It is dumb to deny visas to parents who could get a green card in a year. They should be able to visit and go back to their home.
Thanks Coco8. That is the first step we will take, hopefully it works and she'll get a visa, if not, we'll come up with a plan B.
I found this article, is this something I can do rather than my MIL do this on her own:

You can't sponsor her for a visitor visa. You cannot change a green card for a visitor visa. Your husband's mother can apply for a visitor visa online.
Show me where it states you can't receive a visitors visa once you receive a green card.
I asked for help, not what I can not do....advise me on what I need to do to get my MIL a visitors visa

This makes absolutely NO sense, ZERO.
My husband becomes a US citizen and he can now file a form to GRANT his immediate family to live in the US. Sounds pretty simple and takes a few months to do so, if I'm wrong, whatever.
BUT in our case, we have a family member that would just like to visit from time to time rather than add another permanent resident to this country. I would assume that this country would rather have a visitor than for someone else coming into 'their' country to live.
Sorry but this is absolutely insane and this was the response I was actually expecting because it's all I've read throughout this website and researched online.
What I'll do is file for the i-130 for my MIL, give the USCIS more of my money and go from there. See what happens. At least we'll get a couple of visits from it.
-
My husband became a US citizen last year and we are wanting to start the process of having his mother come to the US. She does not want to live here, she wants to visit us yearly.
I've read about the green card process and filing for the I-130 but I don't think that's the process we need to take. I've read that filing for just a visitor visa will more than likely get declined because she will have the 'intent of residing' in the US. Which makes no sense to me because if she wanted to live here, it seems like a very simple process by filing the I130 to get her a green card to live here permanently.
She currently lives in Mexico, not married, we can sponsor her but she can also self sponsor if that's what is necessary.
Would we have more success filing for permanent residency and then she can go to the embassy in Mexico and exchange for a visitors visa to have for yearly visits?
Can anyone share an experience or explain what the steps to getting my husband's mother a visitors visa?
TIA!

Update on our case from Atlanta:
Our application was received Feb. 2nd. Biometrics was Feb 23. Then in line until July!
My husband received a letter July 7th for interview date. Interview was scheduled for Saturday (this was GREAT news, since he didn't have to miss work!) Aug 12 @ 12:30pm
And he passed!!!!!!!!!!!!!!!!!!! woooooohooooooo so excited!
I checked our status online and today it says we are 'In-line for Oath Ceremony'
There weren't many people there while we were there, I was expecting a mad house. THere were 2 women we saw come out very excited because they passed.
My husband's interviewer was extremely professional and got right into the interview: Asked 6 questions, which he got all right, then moved onto the reading part, then writing. He asked him a lot of questions such as, do you have a problem with alcohol? Drugs? I think most of these questions are on the original application that we answered already.
He also asked if he was married, have kids? Have you left the country recently?
My husband didn't have to bring much evidence because he's been a resident for 9 years. We were prepared to show everything but all they asked for was the green card, letter and passport. (maybe even drivers license?)
Once interview was over, he told him not to celebrate just yet and don't get in any kind of trouble, it's not over until the Oath Ceremony. He walked my husband out, opened the door, shook his hand and said congratulations and they both had big smiles on their faces. =D

Got our interview date in the mail today! It's for August 12, which is a Saturday! So excited!

I checked our status today and read this:
"On July 6, 2017, we scheduled an interview for your Form N-400, Application for Naturalization..."
We are so excited, FINALLY!!! We are in the Atlanta office, so everyone in Atlanta, keep checking, it's moving along!

@Amber824 when you got acceptance of application?Because we applied in feb,FP in march and In line for Iv in April.
We received a text msg on Feb 3 saying our application has been accepted, couple days later, we received that letter. Appointment for FP was Feb 24, then I checked the USCIS site daily and it said on March 6 that we were in line for interview.

Same here as well. FP was done mid-Feb. We've been 'in line for an interview' since March 6. We're trying to be patient but it's hard!!

Anyone going thru ATL and moving at a snails pace?
I filed February 12, for anniversary date of May 14, and I had fingerprints taken mid-March. The case tracker still shows "we scheduled your fingerprinting".
Is this slow pace typical of other ATL filers?
We are in the same boat!
They cashed our check Feb. 2, then biometrics came mid-feb. Now we have been "in line for interview" since March 6. I check daily in hopes our status has updated.
We have a cruise coming up in November, I really hope this doesn't fall on that 1 week out of the year we will be going on vacation!!

Thank you for the quick response and advice!!

My husband has been 'in line' for the citizenship interview since March 6, 2017 (in Atlanta). His Mexico passport expires July this year. If we schedule an appointment at our local consulate to renew his passport, will this affect him at all before the interview?
Does anyone know how renewing Mexico passports works in the U.S.? Do they mail us the passport?
-
Yes, she applies on her own.
Strong ties may be: a spouse in Mexico, other children in Mexico, properties under her name (land, house, apartment, car), a stable job, bank accounts/savings
Thanks, she has all of those except for a spouse.
-
Basically she has to do this on her own in Mexico? My husband can't start the process once he becomes a citizen?
What are some examples of important strong ties?
-
Sorry if this is a repeated question but every situation is different.
We are wanting my Mother in law to come visit us sometimes. How can we get her a tourist visa? She is coming from Mexico, she has no intent on living in the U.S. My husband is a permanent resident (5 years now), about to apply for citizenship. He came here illegally years ago, so we filed for the I-129F and I-601 Waiver. With him entering illegally, will this affect her eligibility for a tourist Visa?
Any links and info will be much appreciated
-
How did they get approved in less than 1 month? Approvals are taking 5-6 months. Is there some special condition with the case?
Not sure...he went to his interview and then a couple weeks later, he got an approval letter, then the lawyer set up an appt for the 2nd appt for Aug 3rd, then she said it could take 30-60 days to find out if he's approved or not.
-
A friend of mine is doing the K3 Visa process and she's doing it through a lawyer...the times her lawyer is telling her for the appt's seem a little too long and much different from when I did the process...I did the K1 Visa but I remember the K1 and K3 being very similar.
Her husband went to Mexico for his 1st appt that their lawyer set up for them...the appt was on May 2nd..they then got their approval letter May 22, so now their lawyer can set up the 2nd appointment. Their lawyer sets up their 2nd appt. for Aug 3rd and then after that they will have to wait 30-60 days for an approval.
When I did the K Visa process in 2007, it was nothing like that. We had an 'open appt' in Juarez, we missed a few things, so he got to go back and then after that, they said he had to apply for the i-601 waiver. We did that through infopass, once I made the appointment (online), we had an appt for the i601 waiver in 2 weeks. On that day of that appointment, my husband was approved, received his K1 Visa that day and then later that night we crossed the border.
Is the process still the same as it was back in '07 or has it completely changed? Should my friend do this process on her own or just listen to her lawyer and wait?
-
you'll receive a Biometrics appointment about a month after you send in your I-751 packet

Need advice for work visas:
My husbands nephew has a degree in communication and advertising and would like to come to the US under a work visa. I work for a company that could hire him for sales and is willing to help with this process.
what’s the visa that he would need to apply for? And can we do this process on our own without a lawyer? I was able to get my husband citizenship without a lawyer, but that was over 10 years ago. Hope I can do this for our nephew a save some $$$
