It’s none of my business and really I’m musing out loud (so please don’t feel you have to answer) but I’m wondering why you are putting yourself through this when you could holiday somewhere else? Paris has a Disney too, my kids loved it, more than the one in Florida. And you wouldn’t have to worry the whole way there. It just seems like a lot of stress, hassle and anxiety, is it really worth it?

Typically validity will be for 5-10 years (each visit up to 6 months - you can be given less though). And yes, a visa doesn't guarantee entry.

Do they perhaps mean the info you're given about it when you get sent the GC in the first place? Rather than a separate letter about it. AFAIK, they don't send out reminders.

Send them all together. Not sure what you mean about a cover sheet listing everyone's name? All you need it the cover sheet that they've already sent you which you're asked to put on the top of your package - that has the case number on it, and that's all they need. Good luck, and please fill in your timeline when you get a chance to. There aren't many of us EB applicants around, so the more EB timelines we have the better.

There’s no educational requirement for family sponsorship. And far more people get the opportunity to immigrate via family sponsorship than the poor illegal immigrants who risk their lives for the same opportunity that your brother has an easy (albeit lengthy) route to.

Service centre isn't likely to have anything to do with it, it would take a long time wherever it was sent because other categories that do have visas available to them are prioritised. And it's not outside normal processing times until the PD is one year before the date on the VB, which is why your enquiries have been ignored thus far. As @milimelo has said, most people want their I-130's to take as long as possible if they are in a family based preference category. Somebody whose I-130 was approved in a year won't be able to take their dependent children with them, whereas your brother probably could (if he has any). So others who had their I-130 approved quickly may think you've been far luckier than them!

You don't all have to enter at the same time - the principal applicant can enter before the derivatives, or at the same time as them (derivatives just can't enter first).

Yep, this. Although I’d put it at at least 10 years rather than 5 - currently June 2007 on the VB (6.5 years from the OP’s PD). But it’s also only moved forwards 3 months in the past two years. So unless things suddenly speed up it’ll be a heck of a lot longer IMO.

There’s no need to ‘shout’. You said above she’d leave and re-enter another time, as long as you’re aware she can’t apply for AOS if she does that then that’s fine. That’s all Boiler was pointing out.

It's random AFAIK. And sorry for the duff info on the wait time for an interview at Manila, I didn't think it was a long wait but @Boiler knows more than me. Hope the backlog reduces a bit by the time your I-824 is processed anyway.

Obviously nobody knows what the queue for an interview will be like in a year or so, but I think Manila is fairly good at the moment - a search of the country sub forum will give you more info though. Best of luck.

Which consulate is it? Next year is doable assuming it’s not one with a long wait for an interview date (Lagos, Islamabad, etc).

It would cost more though, and could take longer (depending on if the OP gets lucky with the service centre for the I-824 or not). If money isn’t a consideration then could both be filed perhaps? And see which gets to NVC first?

Yes, but not until you have the Welcome Letter (after the case is at NVC). And depending on the processing for the I-824 you might want to hold off doing that for whichever parent is approved first - depending on the service centre they’re sent to the processing time could be wildly different. So if they want to interview and move together you might want to slow down the NVC process for whoever is approved first.

You won’t need to pay any fee twice, but you’ll need to pay USCIS a fee for the I-824. https://www.uscis.gov/i-824 I’m sorry, I know it’s a total pain and waiting longer and spending more money will be the last thing you want right now. But hopefully this is just a blip and the rest of the process will go smoothly. Good luck.

No, you have to submit the I-824. There is no other way to fix this. Unfortunately you can expect a request for one for your mother too if you put the same thing on her application.

OK. All you can do is pay the fee and submit the I-824 as requested (if you haven’t already). Unfortunately it will add quite a bit of time to the process but your mother can pause things at NVC to allow time for your fathers case to catch up. Good luck.

If they’ve asked you to do the I-824 then it’s because there is some confusion about whether your father is applying via consular processing outside the US, or adjustment of status inside the US. The question is is that your error, or USCIS’s error. What did you put for questions 61 & 62 on the I-130? And have you submitted the I-824 as requested?

Everybody's case is different, it will depend on the checks they are doing and the countries involved. Which consulate?

Not really, it's just background checks which they have to do - and unfortunately some countries take much longer than others to respond to any request. Were the documents missing (i.e. you should have taken them to the interview) or have they asked for something you weren't expecting?
