Quick Update, My attorney called me today that he was able to plead with the Judge to reduce the driving too close citation to Ordinance Violations so that it won't affect my insurance or they won't report to DMV/DDS no point will be added to my license. Also, the Hit and Run citation to Duty to report the accident and that it won't suspend my license BUT  that they want me to pay a $600 fine and closed the case.  He said if I refused the offer and we loose in court I may face jail terms or higher fees plus license suspension for 6 months plus they will report to my DDS which will affect my insurance. He also said it won't affect my N-400 either.

@family you are amazing. And yes IO did as she promised. but she told me on that day of my interview that it is beyond her control otherwise she will proceed with approval but she  assured  me approval if I turn in the documents after she asked me if this was my first arrest.
 
My immigration lawyer said he also read criminal law and that he can handle the arrest case ... He called the prosecutor and they gave him appointment to see if he can settle the case asap. He collected a letter from my insurance company stating they have fixed the other driver car and uscis RF letter that he want to use them facilitate the case I pray everything work out for him as he planned.

Just a quick update... I got my 10 years GC today in the mail. But got an RFE requesting for the disposition of the arrest and how it was settled in order for them to proceed with N-400 review they gave me up to April 4th  to submit the request. My question is April 3rd is too close for me to complete my court case I saw on USCIS website that due to covid if they send request for evidence on or before January 3rd , 2023 it will automatically add additional 2 months : My question is
 
1. How do I add the additional 2 months
2. Should I just withdraw my N-400 ?

Wording is standard template…nothing is guaranteed but you know your in good shape post interview.
Your ISO even made sure to issue RFE before 1/24 so u can catch a break w 60 days more…so til June…but count physical days from April .

No need to withdraw, play it by ear and 2-3 days before June deadline send in a plea for additional time ( ask for 90 days example) stating traffic court calendar is back up and court anticipated date is xxx. , thus circumstances out of your control…If they grant it then you get more time , if they deny, no harm done.

Good day everyone, I owe everyone one here a very big thank you and my today's Combo INTERVIEW update...... I showed up with my wife, did my fingerprint, and waited for about 1 hr before the IO called US. when I stood up with my wife, she said NO my wife should not come in with me..... I got in with her and took the oath of I will tell the truth, I immediately started with the civic test and passed both of them and she asked me lots of questions about my marriage, etc, we did some updates on my N-400 form, I asked her about my I-751 she said she is going to waive the interview and approved it. My Green card is about to expire she asked me why did not I get a stamp all this while, told her because my interview is this month I decided to wait for my passport.  They did not ask my wife any questions.

We continue to YES and NO questions and we got a point where she asked me if I have been arrested before and she looked at me as if she did not see anything, well I did not know if she saw my arrest already. I answered yes, and she said do I know the meaning of arrest she is not talking about a citation I said yes I was arrested last week, she became weak and sat up and asked me what happened while I was talking she asked for the citation ticket and said why will they arrest me and at the same time give me a ticket that is unclear, she asked for the citation letter and I told her they are with my lawyer…… I immediate my lawyer came in and explained everything to her that he will take care of the arrest next month if she can give us RF today for the disposition she said no and that she won’t take that chance because she know the court case can be longer and the letter will have a time frame that she will wait and send the RF letter next month to give me more time to get the disposition document before they can approve my case. she print a letter for me and marked case can not be approved today and that as soon as she receives the disposition document and is not a red flag to immigration law, she will approve it and schedule me for the oath ceremony. She said as per my I-751 do I need a 10 years green card stamp or the card since my 2 years greed card extension will expire before my court date I told her I preferred the card and she said I will get the 10-year green card in 2 weeks. She told me congratulation and I left. The whole process took like 45 min.

My Lawyer said he will go to the court and see if he can move the court case backward or reduce the charges. I asked him to let me know before he makes any decision that I want to plead not guilty. I can apply for N-400 anytime if I did not meet up their time frame or I am thinking of plea nolo the lawyer advised.

I strongly believe I will win this case, but my Immigration Lawyer said that it will badly delay my N-400 because we did not know when the case will end to get a disposition USCIS will need a disposition of the case and that with Nolo plea we can get disposition same day. Other Criminal defense Lawyer said they can defend the case no time frame but they are not aware of my N-400 how badly I need a disposition ASAP.

I have not hired a lawyer yet BUT as you said same my Immigration Lawyer said that it will only delay my N-400 that he have an experienced defense lawyer that will represent me to clean up the case in court but that it will cost me $5000. The other defense lawyer I talked to said the same thing that he can defend the case in court with $2000 the 3rd Lawyer said $4,000 I just do not know the one to use. Money is not a challenge I just need an experience lawyer.

The police officer was so nice but he said he have do his job, he said from the look of things he did not see any reason why I should run since i have a valid driver license , tag and full coverage insurance and that they do not come arresting me at home  I turned  myself in immediately  BUT that the fact that I leave the location without collecting the driver number means hit and run. But he said is going to be a misdemeanor since it is my first offense, no injury , car not tow, valid insurance , tag, license and no recent serious citation. He called my wife and gave her all details on how to bail me out and moved the court date that far to enable me prepare to defense myself. That is what he said. And he was sharing his experience with me when he was involved in similar  situation before the join the police. But that he need to do his job that is why he arrested me since it was a dispatched 911 call recorded. In the citation he marked , Heavy traffic, rain, dark, no injury , vehicle not tow.....  I will Just LOOK INTO GOD WHO sees the heart of MEN.
