  1. Hello, I just recently came across something that says you can add documents as evidence after an I-130 has been submitted? I had a lawyer submit my original I-130, and I’m pretty sure he did it online. I was locked out of my USCIS account, and haven’t been successful in getting their help to unlock it. Anyways, since we submitted the original I-130, I’ve been back too and lived with my wife for 10 months now. Should I add that evidence? Or should I leave as is with current 2.5 month vacation we had? Thanks

  3. Vermont for me. USCIS timelines are extremely discouraging at 16 months, but visa journey and lawfully times are encouraging. My timeline updated me yesterday saying I should be around November 5. We can only hope.
  4. I did not. I asked my lawyer and on here, and apparently it’s ok, but to make sure when it gets to NVC the middle name is done right as that is what will be on her visa. I still haven’t gone AR status. Not sure what’s wrong. Or if anything is wrong haha.

  9. thank you. I’ve been trying today. But it’s hard to find anyone who is sane enough to basically give the government full access to their assets and cash if the immigrant for any reason goes nuts and is evil. Even though it rarely happens, people get scared. My biggest mistake was accidentally speaking near one family member who went to lawyer websites and told everyone else the absolute worst that can happen (but a lot of those lawyer websites purposely scare people.
  10. Sadly I worked for many years as a teenager and young adult for my family’s business without pay. In addition, the constant travel has really impeded me in getting a steady, well paying job. I’ve only been able to cover my basic expenses and no more. If I would have known they were going to back out on me I would have done this differently. Thank you. Yes, my main question now is the timing.
  11. Also, pretty sure this wouldn’t count, but my wife has about $40k (in RMB) in her bank back in China. Pretty sure I understood before we couldn’t use this as evidence. It’s also especially hard to transfer money out of China.
  12. They looked into the possible suing that could happen with the I-864 and how the immigrant could leech on them if they neither worked or left the country. I do agree it’s a very improperly put together contract, that leaves the petitioner open to being exploited by a select few who are evil. They are mainly afraid of their potential financial assets being sought after if sued (since the defendant in a court case also has to pay the immigrants legal fees). I myself…don’t have much concern of this because I know my wife well, and besides her love for me I know she has a high standard of living and could never accept living on welfare. But of course my family has never seen her in person so now they are apprehensive about the possible legal proceedings they could be in. My family is almost all wealthy, and with a lot of wealth usually comes a defensive mindset. I have some assets and cash totaled to about $30k, but like mentioned earlier, I’m starting to run low from living abroad for almost a year now and having very little work. (my mistake) there’s always the option of getting my inheritance early from my family, but like discussed earlier it can look really suspicious thousands of dollars and assets suddenly appearing in my name.
  13. Got it. I can start work for them immediately most likely. As far as this years income, there’s only 3 months left, and I’d only be working for those 3 months (from case processing times, I have 1-2 months until my case hits NVC). So what is the best option: filing before 2022 ends as soon as I get to NVC and provide evidence for 1-2 months worth of income at the new job as proof? Or wait and file 2022 taxes, then use 2023 current year income? I’d be delaying my case by atleast a month, probably more, but what is the best scenario? How many months are good enough for them to accept? Thanks
  14. Ah, I have been trying. I’m also afraid my form of income (in crypto currency), is very new and would probably get plenty of RFEs due to the complexity of how payments are made and converted through the blockchain, exchanges, and bank accounts. I do have a family member who owns a large business I could potentially work for, maybe even online. What are the requirements when using family based business income to prove the ability to sponsor? Thanks
  15. I agree. I was separated for over a year once with her. And then again for 5 months. I’ve lived with her for almost a year now, so I supposed I’m very attached. But if going back and working for a few months will qualify me for NVC, then I will do that. I’ve just seen and heard working for only a few months is not enough, especially being I don’t have a track record.
  16. Yes, I have filed for 2021, and not as foreign income since I make it in crypto and convert it cash, straight to my bank. I also don’t have a bank account in the country I live in currently, but that’s irrelevant to me since I have no problem establishing domicile. Because I have to qualify for the NVC stage in the first place. Which means consistent income before it even gets there. Between NVC and interview that’s not a problem. It’s qualifying for the DHS.
  17. I should also note the only thing my family is willing to do is transfer a house that is trust for me to my name, along with some cash. But I’ve heard it is definitely suspicious to do this just weeks before NVC, and even if they weren’t suspicious that some people were getting denied at interviews because COs still wanted to see steady income from a sponsor.
  18. Well, even though I am living abroad right now, my domicile is still in the United States. I still pay basic expenses at my home, with the little income I make online with my current free lance income. I was planning to return in November to to file for NVC and wait out the interview…but there’s no way I’m leaving my wife again like is did before not knowing when and how I could see her again (she is from China…and it’s impossible to get out of China on a tourist visas and increasingly difficulty even for American spousal visas) Also, I’ve heard that they want to see years of work/consistent income. I do not have that what so ever for the past 3 years. Is it not true? You can get a job for 3 months and qualify? Im also nearing the NVC stage within the next month or two, so all of this is going to be hard to line up. in addition, is it possible to work for a US business online and get paid WHILE living abroad and use that income?
  19. Understandable, but at that point I would just permanently move out of the United States and live/work in another country. I love my home, but I love my wife more.
  20. So, it has come to the point where everyone who said they would sponsor for my wife is either too old, or flaked out on us. Now I have little to no income for the past 3 years, only about $30k worth of assets between a few cars and some cash, and no one willing to sponsor because of the potential litigation. What are my options? Is it possible for my wife to attain a student visa, as she’s been wanting to go to college? How about a friend of mine who’s been needing a Chinese translator to work for him? Is it too late since we’ve already filed a CR1 and are married? Im so tired of this. I can’t believe how difficult they make the process for some, while granting easy access to others. Anyways, what are my options?
  21. Thank you. I also looked over the return again for any other mistakes he made that I missed before and noticed my address is one number off and he failed to put my middle name initial. That will be an issue when me and my father have the same name besides a middle initial, and he will probably help sponsor. something else that I’m worried about that I probably shouldn’t be, is my 2020 tax year, same year I got married. I never filed cause I didn’t make enough as a single person, but going back I realize I was supposed to file if I made over $5 (minimum requirement for Married file separately). Now I can try to get my W-2 for 2020 and file, but, correct me if I’m wrong, if I start going back 2 years to file taxes correctly for immigration, that will be more of a red flag to them since it could be contriving evidence.
  22. Well I mean in reference to the reason we would have listed on the DS-160 application. I don’t recall what we put, whether it was family or tourism or even if they combined. But the point there was if they ask about why she was visiting, I hope we answer in line with the DS-160. Also, a side question that I can’t fully find an answer to is, on the CR1 I-130 and/or any other documents we submitted to the USCIS, would we have had to declare the application of a DS-160? If so, we didn’t and forgot if it wasn’t even asked. And what would need to do to rectify that if they did in fact ask for it. Gotcha. We have stayed abroad in another country for longer than six months, but this happened AFTER the B1/B2 visa application and she never even visited another country.(Maybe Hong Kong, but that was just visiting) As we didn’t follow through on the tourist visa due to coming to a third country, there’s no employment or address history involved on the B1/B2. We will have the police certificates though so that’s no worries.
