  3. I called Said on my lunch break today and he told me the consulate called and told him to bring in his passport on monday!!!!I did email the consulate last night to check on the status of the visa and he got the call today, no return email from casa how ever.:dance::dance: Now just need an apartment and a plane ticket.:dance: Im so exicited I couldnt finish my lunch.

  4. Im sorry you got an RFE, I too got one on my I-129f for my K3 and it was because I sent my english translated marriage license and not the one in arabic to go with it. Once I sent that back in about a week i got approved. So its probably something simple that was overlooked. Just wait to see what they need and give them exactly what they ask for. Everything should be ok.Good luck.

  5. I emailed CASA yesterday and I heard back from them already. This is what they told me,

    Madam -

Your husband’s case requires additional admin processing. This processing is required by law and takes place in Washington. We don’t need anything more from you at this time and we will contact him when we are ready to proceed with his case.

    Best Regards,

    IV Unit Casablanca

  7. 2. Background

Section 209 of the Act permits the Secretary of Homeland Security to adjust the status of eligible refugees and asylees to that of lawful permanent resident. Under section 209© of the Act, eligible asylees and refugees seeking adjustment of status are exempt from the following grounds of inadmissibility: sections 212(a)(4) [public charge], 212(a)(5) [labor certification], and 212(a)(7)(A) [immigrant documentation requirements] of the Act. Section 209© of the Act prohibits the Secretary of Homeland Security from waiving a ground of inadmissibility under sections 212(a)(2)© [controlled substance traffickers] and 212(a)(3)(A), (B), ©, and (E) [security and related grounds] of the Act. Notwithstanding, section 209© grants the Secretary of Homeland Security the discretion to waive any other ground of inadmissibility under section 212(a) for humanitarian, family unity, and public interest purposes.

Read this. Does this sound like AP? I can't stand the way they word these things!

well hes a welder and im a cna and they didnt ask for any financial stuff. so im totally lost and confused

  8. ok here is what is says

221(g) when marked this is a return

    212(a)(1) health reasons

    212(a)(4) will become public charge

    212(a)(-) left blank

    other

is this where they marked a 5

yes and it says your case requires additional administrative processing. we require nothing further from you at this time. we will contact you by telephone as soon as we are able to continue with your case.

  9. do you have a copy, if not have him scan one to you and get with chi and let her talk to you and who told him this..............there is a copy on here somewhere of the 221g

ours said return but i will try to find and see what this 5 is

I have a copy but I cant seem to get it on here. The box marked says section 212(a)(5) your case requires additional adminstrative processing. We require nothing further from you at this time. We will contact you by telephone as soon as we are able to continue with your case.

I have not heard about the 212a happening here. The words "additional administrative processing" suggest just that. If it was a hard denial I doubt they would have typed that in. Can you scan and attach it here for us to see? You can black out the personal information. I would email the consulate immediately and express your concern and confusion on this. Don't stress just yet, it could be something so simple. Remain calm and get to the bottom of it.

i cant seem to get it to go on here and i emailed the consulate and finally heard back from one of my congressmen

  11. I don't think there is one BIGGEST issue. Each case is judged on it's own merits and for that reason it's not a good idea to compare cases with each other. Even the age thing boggles my mind, in the sense that I have seen couples with barely any difference have issues, and personally know two couples from Morocco who have a 25 and 27 yr age gap, and aside from the time it took in AP, they had no issues.

Sometimes the consulate asks the most basic questions; other times they ask what appear to be rather bizarre questions. They asked my husband about my son who died as an infant! I don't even know how they knew about that unless when they asked him about my kids, he mentioned them ALL. They proceeded to ask at what age and by what means he died. Sheesh. What does that have to do with the tea in china? (in retrospect I guess him knowing all that detail showed the depth of our communication).

Reda: Yes Google patty Murray, select the link for immigration and there is a form you can print, sign and fax. Once you have an interview date, call and let mary know. other than that you are pretty much all set.

And something that caught my attention but maybe others or an immigration atty can answer you on it: You mentioned that your husband is trying to establish residence in Spain, while he is awaiting a visa interview in Morocco. Might that look like he is just trying to escape his country by whatever means possible? (thinking like the devil here for a moment)

I can not find a link for immigration on the Patty Murray website. Ive emailed her before Said interview and have heard nothing from her. I cant find the form to sign.

  12. u havent???????? already, girl u are supposed to do that before the interview and be ready whack wack give them a phone call or go to the office and do the form asap, they can email/fax it to u, you sign and fax back..casa will be closed now

I emailed them before the interview and I havent heard anything from them at all.

  13. Said said they kept the forms biographical form the marriage license the police record and the court record and translations.

They didn keep his passport and on the form it says to look at for dsl851a for more information. What form is that?? I cant seem to find out what that is.
