Hi guys, I filed my AOS package (I-485, It-864, I-175, I-131) in late April.
My case was received in May and I had my biometrics appointment at the end of May.
What is a realistic timeline to receive EAD? The processing time estimator currently says over a year but that doesn’t seem correct.
My case is currently at NBC.
Thanks!

Stupid question…I will be importing my car at POE.
Am I allowed to have moving boxes in the car? This may be a really stupid question but I’m a little confused on the law.
I read something on CBSA regarding importing cars that said do not use your car as a storage container. Are they just referring to people actually shipping their cars over the border?
Thanks

Glad to let you all know that we got our visas issued and crossed the border. Exactly 1 year after the interview at Montreal. We did not go through the Mandamus route.
I’m so happy for you!

Guys! For fun I checked AIS and it says “Current Status: Send Documents”! I don’t remember it saying this before but I’m not sure.
Does anyone know if it just always said this or if this could be new?
Can one of you who had a 221(g) and send in your docs already check your AIS and tell me what the status is please?
I’m hoping this means they want my medical and passport but I don’t want to get my hopes up.
Thanks to anyone who can help!!!
Maybe someone who asked for their passport back?

Which person was that? I don't recall reading it.
I don’t remember it was a couple pages back. They wrote letters to the most common defendants of WOM cases.

Why? Yes I have my reasons: annoyance just on the principle of the thing, and the extreme amount of money involved. That's it.
One person on this thread wrote a letter directly to the main players at the consulate and DOS and they got approved. Maybe you could try that first.

Last week I got updates almost every day in the CEAC tracker and this week I’ve gotten nothing. I really thought I was going to get an email this week telling me to go redo my medical
For the people who have been asked to to their medical again and are about to be approved: before they emailed you did you get spurts of activity and then no update on CEAC? Or did everything just happen in the same week?

Hi Everyone,
A while back I scoured the interned and I created a spread sheet to keep track of everyone's cases with the Montreal embassy.
I am opening it up to be edited by the pubic so if you don't see your case on here, please add it! It helps everyone get a sense of what is going on with AP.
I had removed usernames for everyone's privacy. If you'd like to add your user name instead please feel free to do so.
I couldn't keep up with maintain it so much so I apologize for missing some cases. I won't be maintaining the spread sheet so feel free to save backups incase anything gets altered or ruined (hopefully not).
I hope this spreadsheet helps you feel a sense of control or understanding on what is going on with your case. Love you guys; remember you're not alone.

Yes, there was one created by @herecomestherain but it hasn't been maintained, and no one new added since June. @herecomestherain perhaps you could put screen names back in, put a WOM column in it and open it up to be maintained by individuals if they wish?
Hi yes I can do that. I won’t be adding people’s screen names because it’s a tonne of work for me and personally I believe it is best to keep things more private. People can look up their own cases because they know their dates and compare them to other’s.Give me a couple days and I’ll open it up, though someone should save a copy because strangers mess public sheets up all the time.

How long do you need to file WOM after getting DS 5535?
Some lawyers say minimum 3-4 months. It depends on your circumstances.
-
Just wanted to let you guys know there’s a lot of movement on filed WOM cases. They settled 8 cases in August. Usually they settle 1-2 per month.
They seem to be devoting more resources to old cases so now is the time if you’re looking to file. Don’t love Goldstein.

I waited 11.5 months for my NOA1. They best thing for you to do would be file a Writ of Mandamus lawsuit.

There is no switching. Your employer can file a L1 petition for you and if approved you can apply for the L1 visa then. It has nothing to do with K1. Whichever gets approved first, you can go with that. Depending on your country and the reason behind this years long lengthy AP, you could be put on similar AP again.
Sorry just want to be clear- They can petition for L-1 won my behalf while my K-1 is pending? I’m in Canada and I think my AP is related to my employment in a scientific field. I’ve only been in AP since March.
-
Long story short I applied for the K-1 visa about two years ago. I had my interview in March and was put into administrative processing. We filed a writ of mandamus to finalize this process. I let my employer know I’ll be leaving soon and they would like to offer me an L1 visa instead.
Has anyone ever switched from K-1 to L1?Is it possible to apply for to visas at once? Any advice would be really appreciated.

When filing I-765 with the I-485, there is no extra fee.
I-485 processing times depend on which field office is handling your case.
https://egov.uscis.gov/processing-times/
Current I-765 from the NBC is about 8.5 months for 80% of the cases.
But with California it’s 15.5 months- will that slow down the I-485 processing?
-
Hey guys,
Obviously we need to file for AOS, but is it really necessary to file I-765? The processing time is currently longer than the one for just the I-485.
Seems like a waste of money right? We can work once we have a GreenCard correct?

I'm so angry at what Montreal is doing to you all. This is just so disgusting and a huge mismanagement ever.
I wish there was a way to call them out on this BS. Ombudsman, Senator's/Congressmen's office should lay into them about how only cases that get a WOM are even been looked at and the others are just in a pile being ignored. THey can't be bothered to finish off the ones that have been waiting. THere is no way on earth they can't get those checks done quickly at least for the ones that only have to check Canada. The Canadian government shares practically everything as it is.
Last year there were 19 WoM total. This year I see 25 SO FAR. They are getting slammed and I home it draws the attention of someone who actually cares.

June 3 filed, June 15 case updated to received, June 16 refused, June 19 asked for my passport back, June 30 passport delivered and put into administrative processing, issued July 8. I believe this is my lawsuit timeline. Going off memory but I believe that’s accurate.
I’m so happy for you!

I visited my fiancé in the US last week and got through the border no problem. The customs agent asked me where I was going and who I was meeting. ('Florida and my fiancé). He asked me if we were applying for the K1. I said yes. He clarified if we were planning on getting married during this trip. ('Absolutely not"). He asked how long I planned on staying.
He then gave me a recommendation of a bar to visit at my destination, which I later discovered was a bikini bar lol. Either way, he sent me through and we had a great vacation together!
I just wanted to share the positive outcome so others may also feel comfortable visiting while still in AP!
How long are you staying for? Sorry for the questions lol

I see. Well let us know how the lawsuit goes. I hope you get positive results. Though we shouldn't have to take the government to court just to be reunited with our spouses. But unfortunately, this is what some of us will have to do. I have followed your advice and set a deadline for end of October, meanwhile I have started saving up a pot of money for this purpose, just in case. I hope I won't have to use it because it is going to cause me to go into debt a little even with trying to save up but I can't be without my husband, we have already waited 3 years and I am unwilling to wait anymore.
Good for you for making this decision! You two deserve to be together. No more waiting for answers. October is a great timeline.
If you have the bandwidth, see if you can pick up some gigs or waitress and grind it out. Years ago I did waitressing for 3 months and it helped me get out of debt probably faster than I ever imagined. You can put all your cash tips in your WoM fund and just keep setting aside.

Well I thank you for the compliment. I am not trying to be a hero, but I am very stubbornly attached to principles sometimes. In addition to the whole larger principle, there is also a principle related to sound financial practices here too: I am not going to borrow money for this, it is a red line for me. I am not going load upon myself with consumer debt for a lawsuit--so it is going to have to be cash or nothing. I don't carry balances on credit cards anymore, I pay it in full.
I totally feel you on that.

It's not that I disagree with your assessment--I do agree that is likely to be the only answer. Do I want to do it? Not at all. For the moment, I will try to save some money up and play for time, and hope somehow for a miracle.
You are really strong. Seriously, I commend you because I think you have shown a lot of grace throughout this ordeal.

Yes it seems that they e been I undated with so many they are starting to push back. Generally judges think 2-3 years from filing to approval wait time is reasonable.
