  1. Little bit of background, me and my fiance filed for a k1 back in January of 2022, still waiting on approval. However she is Venezuelan so we applied for the parole program and we were approved came to the USA together in January of 2023. We are planning on getting married in August, what forms do we need to file for AOS. Is it the i130 and i485 together? Or is it just the i485 alone?

    Thanks for the help.

  2. There is a preliminary injunction hearing on April 25th 99% chance the judge grants it. Might take a month or so for him to rule but this is going to get shut down. So everyone needs to get their papers in now.

With older adults, I would 100% do I-134a v. the I-130 given considerations for health insurance. You will need to check the specifics for KY, but the I-134a affidavit is actually unenforceable, so they can conceivably get medicaid, food stamps, and any other program Cubans are eligible for immediately upon receiving parole. With an IR-5 visa, you instead sign a I-864 affidavit of support, which is enforceable, and you are on the hook for 10 years. Filing for AOS via the Cuban Adjustment Act is an additional expense, but if you factor in health insurance, it may actually save you a lot more going this route.

This is probably why the I-134a program is going to get canceled. Hopefully my mother in law gets approved prior to the April 25th hearing.

Anyone see any progress on their I-134a case(s) today? I applied for my Cuban brother-in-law early morning of the 7th but nothing yet. Meanwhile, a friend of his who submitted on Sunday, the 8th has been approved and is already here in the US. How the heck is USCIS prioritizing these applications? Time to call and complain to my congressman. :)

Its completely random how they get approved. My wife talks to a lot of her friends and watches videos from a bunch of Venezuelans and the time of approval is different for everyone.

No way you got a letter from a bank officer and a home appraisal in one day! I just spent two days getting the paperwork together. I can't submit I-134A until the banks open on Tuesday, to get the letter from a bank officer.

You don't need a home appraisal or bank letter. Just send bank statements. Typically if you have tax returns and bank statements and pay stubs you are good to go.

Does your fiance have to live in that country or just have a passport from one of those countries? My fiancé is Haitian but moved to Ecuador. He just has a resident card there but his passport is still from Haiti.

Me and my wife lived in panama together she had temporary residency there and we got approved and traveled to the USA last saturday. Currently we are just waiting on her work papers and she is studying for the exam for her florida physical therapist license

A reason, there are many. The cost to the Federal regime is minimal, the cost is mainly on the States. Is it very Political, of course.

Everything is very political. I wish they both would take some time and fix the broken immigration system.  We have been waiting over a year now for a simple K1 Visa.

    The I 134 is unenforceable.

My first thought is that it varies by State, somewhere like California may provide Medicaid.

Its why the states are suing and the program might end.  We are leaving tomorrow for the usa on our travel authorization

I am not an expert on self-employment immigration cases, however with this process you still need to submit your tax transcripts. Even if you are self-employed you are still filing taxes on the money you earn from being self-employed. Is this income you generate below the poverty line for sponsoring? Personally, I subscribe to the KISS philosophy of life (Keep It Simple Stupid), and try not to make my applications unnecessarily complicated if they don't need to be.

I am guessing what he is saying is he is self employed and writes everything off so he basically pays 0 taxes but also shows almost nothing in wages, aka complicated. Just my guess.
