    Do I need to submit my US passport, divorce decree, birth certificate in the affidavit of support again? I submitted those in I-130. Or would those go in civil documents. Confused why those are listed here

    No I didn't, she was a us born citizen

    I haven't go to the civil documents part yet - assuming that comes after submitting DS460. I thought civil documents was mostly just information about my wife who I am sponsoring. 

  3. Hi guys I am USC filing for my spouse, I decided to file I-864EZ is because she is my only sponsor and I meet the income requirements. However, the form automatically generates "2" household members (see below image) and if I add my spouse, it will be 3 - which would be incorrect...? Should I just leave it as 2? 

     

    Another thing, I the petitioner was divorced few years back - I read somewhere that I have to provide this information again during the NVC stage too.. I don't think I am supposed to upload that in affidavit of support under the "Other" documents (where it shows a long list of documents to upload like proof of USC etc - everything that I already submitted to with my I130...). Or am I supposed to upload all this again?

  4. Hi guys, first of all.. love everyone here. I don't know how I would have made it this far without you guys...seriously. 

     

    My wife and I (petitioner) are at the application of the NVC stage. I have a slight dilemma. I have my 2022 (latest) tax transcript and plan to only submit that (+ W2 and recent paystubs)  on my affidavit of support, instead of the last three years - mainly because my 2021 tax return is still processing due to filing for ITIN number for spouse (regret doing so). How exactly would I fill this out in the form, if I am planning to only submit the latest tax return? It still wants me to fill out the last three adjusted gross income - so does that mean I should still include the 1040 and W2s of all three years?

  5. I am USC filing for my spouse, we just got to the NVC application stage and during the DS260 it asks if she has ever been denied visa and if so to explain in a text box. When she was graduating from school, she applied for a student visa and was denied (low chance to get visa) and was told it was because they didn't believe she would come back after graduation. She doesn't really have any paperwork for this but given it was done in the stated country embassy where NVC interview takes place ..they should have the proof. Do you guys think this is a red flag or should I just omit this? 

  6. To preface, I am filing for my wife as a USC and we just got to the NVC step. I make enough money but the issue is that last year I filed an ITIN for number which took a year + to get approved and as a result I still don't have my 2021 tax return or transcript yet. I e-filed for my 2022 tax return with the ITIN number, the website I filed shows approved but IRS website doesn't show my tax transcript yet (heard can take 21+ days). My dilemma ..... should I just submit 1040 + W2s for this year/maybe last 3 years (I have a full time and part time job) orr hope that IRS updates my latest tax year transcript in 21 days (could be lot longer)?  I know the site recommends TAX TRANSCRIPT, but have you guys seen 1040 + W2s get rejected before? I plan to submit employee verification and pay stubs with the documents...

  7. Hi guys, I have a slight dilemma. I am a USC whose wifes i130 just got approved. We are moving to the NVC stage. Last year, I got overzealous and filed for an ITIN number for my wife with my 2021 tax returns (married filing jointly). Finally after a year, she got that approved few weeks ago however, my 2021 tax return is still not processed and might take another few months per IRS...

     

    I know the requirement is only latest tax year  which would be 2022 returns (correct me if wrong), so I am debating about just e-filing as married filing single this time around to avoid anymore headaches - despite having an ITIN number for her (I will get less refund back but that's ok). Do you think my strategy sounds right? 

     

    P.s - there is no way for me to get a transcript for 2021 as IRS says they are processing it...and I keep hearing that sending last 3 tax returns is safe bet so I'm stressed. Thank you

     

     

     

     

     

  8. I submitted my I-130 and I-130A by filling it online and attaching the PDF in evidence section. Before I submitted it, I opened the file and everything looked fine. However, today on a new computer with Adobe Acrobat DC (full version of adobe reader) I looked through my submitted I130A and it is showing blank because of some security encryption stuff I guess the form comes with. It still opens normally on a website pdf reader/adobe reader on old computer and shows that I filled in everything appropriately. If USCIS uses Adobe Acrobat to open PDF, I am probably screwed... Should I be worried?

     

    Should I just print out the I-130A and add it to the unsolicited evidence just in case?

    nothing to lose: I-129F for K3 is free

    Did you wait till your I-130 was "actively being reviewed" or just filed it after you received receipt? I filed online and wondering when I should do this

    VJ is such a great resource. Like many advised, we already checked the status of our petition via Emma and we found out it was already transferred (from Texas to Vermont).

    Did you file from Texas and get transferred to Vermont or was Emma saying you were in Texas and now in Vermont? 

     

    I just filed this month too. You are lucky... I just found out my case was sent to California (From Texas), meaning I am going to wait another year PLUS compared to other centers...sigh 😕GOOD LUCK TO US

    Instructions are to write full name, not "sign".  Interpret instructions literally.  No "in other words".  No need to deal with the back of the photo when filing online.  That's for filing by mail.

     

    The foreign spouse's passport is not needed at the petition stage, unless  you're using it as evidence of time spent together in person.

     

     

    Thank you @pushbrk, you and everyone have helped me almost finish my application with your guidance. I am a little confused about a specific section in I-130, my wife is a student and doesn't have any employment history. 

    - Part 3 highlighed is confusing me - My wife is a student and has never worked. But it wants us to provide "this information??" in Part 7? 

    - So far I have left Part 7 completely blank because I don't have any additional information to add. I planned to submit it that way.

    - She is not signing because she doesn't live in US, but should she date in the space below the signature?

  12. Hi guys, I am filing an I-130 for my spouse online. Do I need to scan every page of my passport to prove US citizenship or will the front page suffice? Same thing for her passport?

     

    Also regarding the passport photo, I uploaded a front photo of us but it asks us to "sign the back". Do I just take a picture of the back and upload it in a PDF? Or will it need to be a certain size etc
