BC format requirement is the same for K1s and K2s.  Note that for Canada, the DOS website explicitly states that short-form BCs are not acceptable for visa purposes.

We are good to go. I have long form BC's for all 3 of us. Had me wondering so I double checked.

Our lawyer is sending us some form that now asks for assets and such, im confused and anxiously awaiting the papers to figure out what our next steps are now. The consulate should be receiving our file within the next few days

Figured, congrats! If you're not already in it, join the k1 montreal Facebook. Canada needs a specific type of birth certificate and the police cert people often get the wrong type. Pinned are tons of guides on all the steps which will help, as every consulate has different steps.

Thank you! I'm in that group, and went and got the criminal record check that doesn't have finger prints on it etc, I have the long form birth cert. Hoping thats the one they want?

To NVC can take about a month (at least in my recent experience). So lets say your case arrived June 25th

The shipping date had already passed on the 21st. Even if it arrived on the 19th, its possible it wasnt proccessed by the time the shipping date came.

The next shipping date is tomorrow and Wednesday. Due to the holiday, it might be Wednesday thursday but who knows.

I wouldn't consider your case stuck yet. This would likely be your first shipping week since reaching NVC. Everyone I've seen recently at the Montreal consulate was in transit the first shipping week, so following that formula its pretty likely you'll hear back this week unless things somehow slowed down again.

If you look at my timeline, mine took almost a month and a half too.

We got our NVC number today and it says in transit 🤗🤗🤗

You can send a public inquiry but last I heard that takes 2 months.

NVC doesn't seem to hold onto cases from Canada anymore, it'll go to nvc and likely ship the next shipping day so id assume this shipping day or the next you'd hear something.

    My timeline is

    Noa1: April 5th 2021

    Noa2: April 7th 2022

    Arrived at NVC: May 5th

    Case # recieved: May 11th

    Case in transit: May 24

    Case Ready: June 6th

    P2: June 13th

    P3: June 21

Been still waiting for P4 which lets me book an interview. People who recieved it, were able to book for August 2, 4, and 9. Unfortunately despite being the first in my contacts to send p3, they all heard back with p4 and not me 😕 thanks Montreal.

seems like approx 4 months from NOA2 to visa in hand in Montreal. sometimes slightly longer, sometimes slightly shorter.

I'm praying its only 4 months. Ours is

    NOA1 April 23 2021

    NOA2 May 25 2022

I have yet to hear anything from NVC and its been almost a month and a half. I'm scared it'll get stuck there now. 🤷‍♀️

  5. Just curious how I would go about finding out if NVC has received our file, or if its been processed?  NOA2 May 26, is there any way to find out somehow? As I understand it you can't phone them anymore to get your file number?

Also... for anyone in Canada, how long is it taking roughly from NVC to interview, on average in the last few months?

this led to low approval rate so far for Apr filers, also not sure if "RFE Received" column is updated on a daily basis, that low number compared to how much RFE been sent out is another astonishing fact for both March and April.

I think this has been asked before but... for all these RFE's... when they receive the information they've requested, do they then stop processing, to go back to those files? Does this stop new files from being approved for the time they have to review the RFE files?

Wondering if this will slow down our applications. I'm at 385 days today, this wait is infuriating, I hate them for how they've put our entire lives on hold like this with no end in sight

  7. 5 minutes ago, MissLadyRea said:

I totally understand that feeling. I got lucky with 367 days seeing a lot of people who have the same noa1 date still waiting, which is weird because I also feel unlucky about the whole extension thing but nothing one can do.

But the waits just awful. I was panicking and reading over the requirements again wondering if we even sent what was needed

they love creating unnecessary anxiety I guess

The wait is BS. I can't find one actual valid excuse for the garbage they're pulling. Hire more staff. Send some over to the Vermont office or wherever, like I don't care just do something. This is inhumane. They won't let us pay for expedites/premium processing, yet they will for other visa types, they won't answer questions, there's no rhyme or reason so its not in sequence where they can say like "there are x number cases ahead of you" its all over the place. All I know is, if I did my job as inefficiently as they do there's.... I wouldn't have a job.

Yeah really all of this. I wish I could just drive down

In person we've only managed to spend 1 month and 2 weeks together total, in the 3 and a half year almost relationship.

but somehow ig were still not long distance and I can move down easy xD /s

Since Covid hit, we've spent a total of 10 weeks together, since beginning of 2020. Thats like 5 weeks a year on average now. And we're 2300 miles apart, Alberta to Mississippi.... but definitely not long distance enough right 😆🤦‍♀️ We only have seen eachother about every 6-7 months. Its been nearly 4 months already and the next time we see eachother will be whenever we get moved, which is who knows when. I feel like they've just discarded our file in some junk drawer somewhere. FML.

I knew right away id never qualify, I work part time at an adult store xD

professional Work in a specific field? yeah couldnt be me

second time in this forum that someones just hshdhd about Canada

weird because I don't experience these kinda claims in any immigration Facebook im in or the multiple long distance discords so really wasnt expecting it from here

I've owned and operated my own horse farm for over a decade with 30+ years in the horse industry. I did business management professionally, and now between the kids and farm I also work at a small store. Makes so I dont qualify either

I've seen a LOT of comments of "why don't you just drive down cause you're canadian" I think a lot of times, people that are further away have the idea that its just that simple because we "can" physically drive there, and because there's so much BS about "sister countries" "neighbours" etc so it gives off the idea that its all the same when its not. (Which I hate but, can't do anything about it) There's a lot of misinformation I think, out there about how "easy" it is between Canada and US.

My Canadian friend has this nafta visa where all he needed was a job offer letter and no USCIS.  Apparently, it's reciprocal and I could do the same thing to work in Canada.

Anyways, I have to post this:

That falls under NAFTA and TN visa and is dependant on the type of work etc. It's not like just anyone can pick up and move once they get any old job in the US. Trust me, we weighed every option and contacted several lawyers on both sides of the border a couple years ago....

  11. 2 minutes ago, MissLadyRea said:

My waiting was 367 days, I saw someone on reddit previously discussing their job at uscis and mentioned though they can put off a petition on the side of their desk, they cannot just not do it indefinitely.

So I can see that causing a small delay but based off what ive seen people say on those anon uscis forms, itd doubt yours will be just not touched

I think theyre just not processing very fast in general and so they cant keep up, so people keep waiting longer longer and longer

367 days would have us approved on my Fiance's birthday, on Monday.

I wish, but I feel like maybe we should have a plan B of how to just go through life as is if they don't ever put this through.. or for whatever reason don't approve us. (We clearly have more than enough to qualify but who knows with these jerks, I'm so tired of them not giving AF how they're affecting people's lives)

I'm really shocked Canadian's apply for this visa category, Rea and Southbound.  Can't you just walk, drive or fly across the border visa free?

If only it were that easy. Its not. We can stay in the US for 6 months at a time as a tourist/visitor but to just stay and go get married... not a chance.

If we do anything they deem Visa Fraud, you can be deported and banned from re entry for something like 5 years. Its BS in my eyes. Some invisible line on the ground has destroyed my life and put everything on hold for years now.... and when we go to do things the "right way", the "legal way"... they pull this BS of taking over a year for just the first step. Perso ally i feel like they're holding off approving anyone to see how many they can get to break up and drop their applications.

Now I'm worried because of the ridiculous amount our lawyers made us send in

I looked once again at our application last night, and literally half of the 230 pages... is blank pages that just say "exhibit A" "exhibit B" ... etc. For each item we sent in.

So now I'm scared they won't approve us because its way way too long 🤷‍♀️ tomorrow marks 365 days of waiting.... maybe this is why?!

I think I figured out why ours is so much longer! Lol.... our lawyers had me include my criminal.record check, divorce decrees for the both of us, my Fiances military records, and all information for two K2 visas for the kids, so much more than a typical application, so that kind of makes sense.

Still..... 364 days and no response is driving me crazy ! Feels like it'll never come through for us.

  14. 10 hours ago, MissLadyRea said:

This is the reason I sent the bare minimum. Literally exactly everything they ask for without extras (Had one extra and it was one page)

    was approved just fine

I can only imagine being the adjucator and picking up a petition with hundreds of pages

probably sucks as much as working grocery and someone comes up with two shopping carts full of food 😭 pure misery I swear

I've also been skeptical about the 15 minute timeframe. Of course, a lot of the system is automated (the officer themselves isn't sending out the letter), but as you said, people routinely send 50+ page packets which require not only reading, but scanning into the computer. If someone dumps 100 pages of call logs and love letters, the adjudicator might as well order a pizza while standing next to the copier.

The real way to speed up I-129F is to make us be able to send the packet electronically, just as it is for I-130. RFEs should have an extremely quick turnaround, too; the amount of cases looked at twice is quite substantial. The RFE should, ideally, be transmitted over email, allowing the Petitioner to immediately upload the required evidence into the cabinet that night.

Nonetheless, my solutions are neither here-nor-there. I just doubt the I-129F takes that little time to go through, because once the adjudicator needs to issue an RFE, there's most certainly an added 5-10 minutes tacked on. Perhaps it takes 10-15 minutes to get through a perfect case. But, alas, the I-129F is largely DIY and lacks a set outline.

50 pages.... our lawyers that we hired asked us for SO much stuff its over 230 pages. Texts, calls, letters, receipts flights, photos, like literally everything but the kitchen sink!!  I've been wondering if that's why they haven't touched ours.... no one wants to read through so much S***. 🤷‍♀️

I figured it was a typo or currency difference but your response has me laughing too much

just the thought of having 80k of disposable income and it costing that much for a k1, thatd be an AMAZING down payment on a house instead

    Right???

$80,000 is a LOT of money OMG. I get that it must be hard dealing with the distance etc but at that point I think I'd be looking for a country we could both pack and move to. 🤷‍♀️

Yes, at least you have 6 months living together without much cost. My fiancé and her 10 year old daughter traveled 35 hours from her Russia hometown to mexico, and I need wait hours in the Mexican America border every day crossing the border to work in America, we lived two times altogether for 3.5 months in Mexico, and I goto Moscow to meet her for Christmas and new year’s holiday, with Covid, I lost 3000$ for flight tickets and hotels, I already spent 50000$ on this K visa related issues, and at least 20000$ more to bring them in, they need goto Warsaw to do the interview and Poland refuse to issue Russia any visa, so we need spend in Greece for sometime and then goto Warsaw, they need fly to Moscow to Istanbul to Athens and to Warsaw and I don’t know if she can get the package 3 or not since she lives in belgorod which was attacked by Ukraine helicopters. Everything is suffering

Living together "without much cost" -- what does this mean? You realize for Canadians we need to continue to have not only an income of something to pay our bills, but also an address up here. Meaning for me to go stay for 6 months, I have to still pay the bills here as well. Which is unreasonable. Everyone has it rough in the K1 situation.

If yours has cost you 50,000 you may want to consult a lawyer.... sounds steep, perhaps you would be better off if you moved to them?

Canada and the US are both HUGE countries, I'm not sure why you would say that they don't count as long distance? The few Canada -> US couples I know are separated by over 1500km, some are even over 3500km apart. They don't get any more time to visit than people with B-2 visas, and even then, people have obligations that keep them from being able to visit frequently, like work, school, and family. As others have said, they don't have rights to live in America simply by being Canadian. They still have to qualify to move through work or family. If it were that easy, there wouldn't be hundreds of Canadians on VJ waiting on a K-1 or CR-1 just like you are.

It's not fair to tell other couples that have also had to deal with many months of separation and a visa process that they can't feel hopeless and desperate too. It isn't a competition.

    ^^ exactly this.

We are Alberta and Mississippi. 2450 miles apart. Flights are difficult due to covid, and now the increase in flight prices. We see eachother every 6 months the last few years but now its been 3 months and we have no idea when we will see eachother again, not u til our move. Our NOA1 was April 23 2021 and we have yet to hear a word. We have 2 children eagerly waiting to move and be with Dad and in our new home. Its incredibly difficult and just as long distance as any other. If only it were so simple between Canada and the US. 🙄 It's not... and now it's being held back because of Ukraine expedites etc as well from what I've seen.
