I would argue that marrying right away, even, is probably dangerous considering the recent K1 refusal and how it would appear down-the-road. Spending more time together and then marrying seems like the best option. From the CO's perspective, it likely seemed as if she was 'doing you a favor' by reconnecting and starting the K1 process. 

     

    I'm glad to hear you are both full steam ahead on making this still work. 

    we plan to get married in July.  in another neighboring country since my country is not really safe!  will it be too early in July?

    The US Government does not believe your relationship is real.  How are you going to prove that your relationship is real?  BY SPENDING TIME TOGETHER.  THAT IS THE ONLY SOLUTION.

    that's Exactly what i'm going to do, i'm even going to move to the dominican republic because my country has too many armed gangs, she's going to come to see me more often, and spend about a month each time, we're also going to get married.

    @Jules Joniel, now, it is becoming perfectly clear.  The Consulate Officer denied your case based on very little time actually together.  A call from the officer will not help.  There is no appeal.  There is only one solution, imo:  Spend a LOT of time together, marry, and then start the spousal visa process  Actually, the best way to convince the next CO of your relationship is for the US citizen to move to your country for a year or two and live as a married couple.  

    she couldn't move we can just spend could just spend more time together.  Could I just marry, and ignore the k1 file, or close it

    I think there was just information I didn't know about her, like how long she's been living in Orlando, when she graduated, and how long she's been employed since 2019. they also  focused on the time we spent together. we spent 8 days together both times, it's mainly for security reasons in my country, kidnappings, etc.  I live in Haiti.  At first USCIS told me there was nothing they could do if the embassy didn't give the instruction, we kept calling, eventually they put us on hold, told us within 30 days  that an officer would call us, what do you think I should expect

    It sounds like you were denied. You will either need to start over with another K1 or marry and file for a spousal visa (this one is a better option).

    Both your petitioner and the joint support (the mother) may each need to complete an I-134 and send to you for your interview.

    So you should have two I-134s with each having its own supporting documents to take with you to the interview.

     

    For the Checklist of Required Initial Evidence, I would include as much and more of what is required to avoid the 221g.

  8. hello I live in Haiti, I am a k1 visa applicant, my interview is for the end of this month, The Embassy recommends an Affidavit, the problem is that my fiancée does not work she receives the  help from the government (SSI) his mother will sponsor us.  she earns 31,000 a year.  will his mother be enough?  The other question the form asks his mother for a letter from his employer, we won't have it by the interview, could the last three paystubs replace the letter?  I need your help please

    As @Mike E said in his earlier post, some people end up needing it and some don’t. It’s impossible to predict what kind of IO you would get, maybe passport isn’t enough for them, who knows. I’d personally request the certificate of citizenship because it’s an important document to have in your possession, you might need it in the future for other things too. Again, it’s up to you to make the decision.

     

    I’d like to add that USCIS often gives inaccurate information. I wouldn’t rely on them too often. Just an FYI for the future.

    The applicable document is a certificate of citizenship. Form n-600. 

    i just called uscis they said i don't have to worry about the citizenship certificate as long as i have my passport i don't know if that matters.

    if USCIS sends me an RFE letter on the 8th of this month, how many days do you expect I will receive it?
