If you've already applied and been approved for for K1 and K2 VisaS (plural) why would he need to...

It's a very long story. To make a long story short, his kids don't have their IDs and passports yet. This is something my fiance has been working on for years. He's been making progress on this lately, but it might still take several months to complete.

You don’t need to put any reason and where it asks for travel plans you would put TBD.

*** Topic moved from AOS K1 forum to Working & Traveling during US Immigration forum where AP questions are discussed ***

I think I need to re-word the question or explain a little bit more. My fiance would need to travel back to his country within a few months of coming here on his K1 visa so that he can work on getting the children's passports(It's a long story, but he's been working on getting their IDs and passports for years now.) So that they can come to the US with him on K2 visas. This would need to happen within a year from when my fiance gets his K1 visa. Right now, my fiance can send in his passport and get his K1 visa anytime. We're trying to get the issue with the kids passports settled first so that they can all travel together, but it's taking a long time.

    1) It may take many months to receive AP

    2) Why not just marry, file I-130 and consular process?

K-1 and AOS are primarily for those who want to come to the US and go through immigration while living in the US. It's more expensive, more restrictive in terms of travel than CR-1 / IR-1

What do you mean by consular process? What's that?

We've already applied for the K1 visa in September 2021. He's already had his interview and the visas are just being held up by some of the paperwork for his kids.

  4. My fiance had his interview in KL. He never received anything in the mail beforehand. He received a similar email. Just answer the questions they ask. If the case is ready, you can go ahead and schedule your medical and interview. To be honest, I'm not even sure what "the packet" refers to. I've heard it mentioned many times in the forums. The closest we ever received was this email.

According to your timeline, you received the K1 visa and the interview was May 2023.

    Where is your partner now?

Do you want to abandon the the K1 and adjustment of status or does your partner need to remain in Malaysia for some reason?

Yes, the interview was in May. He was giving verbal approval pending a couple things he needs to submit, one of them being paperwork for his children which looks like it may take months or years to get. So we are contemplating options.

I entered the US in August 2020, the vaccine wasn't available till Jan 2021 and the travel restriction till after that.

I am unsure if the vaccine requirement for entry to the US may or may not still affect those entering on K1.

The good news is that the state of emergency has ended and HR185 is in the US congress to remove the restriction.

Thanks for your reply! Yes, hopefully they remove the restriction soon.

I just wanted to write up a quick report of my experience applying for a vaccine exemption on religious grounds as when I was filing it in early 2021 there was little to no information on personal experiences with this particular waiver.

I filed I-601 simply by completing the provided lines for explanation with a summary of my religious beliefs and why, in no uncertain terms, getting a vaccination would be a contradiction of my religious convictions.

I also had as many friends and family as I could, write signed and dated letters attesting to the fact that they know me to hold this conviction/belief and sent those along with my I-601 filing.

I was filing for AOS and not K1 and so did not go through the waiver in a embassy interview process.

I heard nothing on my I-601, other than a notice of receipt, until my AOS interview. At the very end of my interview, my interviewer brought up the subject matter of the I-601. He said that I had been in the Army and so as he was prior military knows that I must have got lots of vaccines (I did before I came to faith in God) and so it seemed like a tough sell to him. I told him that on my medical records from the Army that I provided with my AOS medical paperwork, there is record of me declining a vaccine after the date I came to faith in God. He said that was good enough for him and approved my I-601.

I know that is not a lot of information and so if anyone has any questions, please feel free to ask.

How did you enter the US without being vaxxed for COVID? Also, if you entered on a K1 visa, how did you get past the requirement to show proof of COVID vaccination before the medical check up?

The two answers are more or less the same:  awaiting adjudication/case assign to an officer and is being reviewed.

"Correspondence soon"  is based on USCIS time, sort of the reverse of the scene from Star Trek 2:  "hours seem like days, days seem like weeks".  For USCIS, their "days" tend to be weeks and "weeks" tend to be months.

That's what I was afraid of. Thanks for your answer!

  9. I've sent two inquires to the USCIS myself the wording on the responses I got basically said my case was waiting adjudication. I just got a response from the inquiry my senator did for me, and the wording on that one sounds more hopeful. It said that our case has been assigned to an officer and it's being reviewed and to expect correspondence soon. Does this mean that our case is making progress, or do they just give better sounding responses to congressional inquires?

    Weekly Update (Nov 18th, 2022)

As usual, no real activity, for all of December Filers this week.  My scan observed:

         3 Withdrawals:
         3 Expedite Denials
         1 Approval 😲 (Surprise and congratulations  👏 DEC 13-17 range / WAC2290028xxx)

Also ran the unopened case script to see where activity is at USCIS.
This is the 3rd week in a a row where the bulk of new opened cases has moved towards the end of year by one week.
It appears USCIS is into opening September cases now even though there are still a considerable number of untouched cases in August.

         Week:    Was:     Now:    Delta:
         08/06    64         63             1
         08/13    122       83           39
         08/20    243      171         72
         08/27    442      344         98
         09/03    612      359         253   (Most this week)
         09/10    559      407         152
         09/17    740      712          28
         09/24    724      717           7

    Observations suggest:
    1) October will start seeing a few cases opened sometime next week.

    2) December 1-3 receipt date may see a few cases opened  in 10-11 weeks (Late January)
