  4. I haven't submitted forms to NVC yet, we are still waiting for NOA2. But, I emailed AFP asking them to confirm the the police check I got matches the instructions at https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country/australia.html and they replied saying "I had a look at the application provided and the information you have sent through. You have selected the correct purpose code per the instructions, code 33 immigration/citizenship for supply to the department of home affairs." Could you try getting an email like that and forwarding to NVC?
  5. Hello, I am working on filling out the I-864. I am the USC petitioning for my husband, we are both overseas. I am planning to use assets not income to qualify, and I have (hopefully) sufficient documents to prove "intent to re-establish domicile". My question is, since my income is foreign and can't be used for the I-864, which box do I tick in Part 6, if any? There are boxes next to items 1, 4, 5, and 6. I am thinking I should tick none of the boxes (I am employed, so I shouldn't tick "unemployed" even though my income will not be counted for the I-864) and then write a 0 for item 7. Or should I tick the box for item #1 and also write a 0 for item 7? The options are: 1. Employed as a/an.... 2. Name of Employer 1 3. Name of Employer 2 (if applicable) 4. Self employed as a/an (Occupation) 5. Retired since (mm/dd/yyyy) 6. Unemployed Since (mm/dd/yyyy) 7. My current individual income is: Thank you very much for your help!
  6. I am in that group as well. I'm still waiting for NOA2 but I'm watching this and it's sooooo disheartening that there's probably another huge wait coming up due to the delays at Sydney consulate.
  7. That's what I read too, they changed the wording and it doesn't say "Complete disclosure" anymore and NVC rejects it.
  8. This is really good information, I wonder if we should call AFP preemptively and ask them to also write us letters saying that the NVC steps produces the police check we receive.

  10. We submitted I-130 in Sept 2021 so I'm still waiting on that before going to NVC. I've just seen a few people having problems with the Police Check so I thought I would check. I hope they review yours soon and accept it, good luck!
  11. Agree, I am super anxious about this step since NVC removed the option to call them. I just ordered the AFP and I'll let you know how it goes at NVC.

  13. Sorry about that, I have quoted the wrong post! Anyway, AFP = Australian Federal Police NOA2 = it's the second notice that you get after filing I-130 and means it's time to go to the next stage where we would be submitting the police check RFE = request for evidence

  17. What did you send when you got your RFE? I am going to be sending tax transcripts with an explanation of why I don't have W2s and I'm afraid of this happening to me as well.
  18. I agree with the above that points 2 and 3 are not needed until the NVC stage and so you should go ahead an do your I-130 as you will be waiting many months for that to go through. That said, you and your partner can start working on the domicile stuff now. Are you guys planning to stay together in Malaysia and move together? Or is your partner going to move ahead of you, establish domicile, and then you come over later? If you need to prove intent to re-establish domicile, your partner can get quotes for moving your shared belongings, quotes for moving any pets you might have, send emails to schools inquiring about enrolling children, send emails to apartment complexes inquiring about renting an apartment, open a bank account, and try to get a US driver's license.

  20. Hi everyone, I am a dual US/Australian citizen who is sponsoring my Aussie husband. I am reading the instructions for the I-864 and on page 8 it says "You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year." My question is what is the most recent tax year? I have my tax transcript from 2020 but my 2021 tax transcript is not ready yet because we had to file an extension when I did my taxes this year (bad thing to do on the year you are immigrating, I know, but we live overseas and this is as soon as my US accountant could do it). Can I submit my 2020 tax transcript or should I wait until the 2021 tax transcript is available? Should I submit the I-864 now and upload the 2021 tax transcript when it becomes available? I am not using income to meet the 125% guideline, if that matters, we are using assets instead. Thank you for your input and good luck to everyone!
  21. I saw a few posts on the K1/CR1 FB group and the Yanks Down Under FB group (I don't know how to link to posts). I think they are only doing maybe expedited appointments or something because I haven't seen anything come from the Consulate, just FB posts of people going for CR1 and E3 appointments.
  22. Hi everyone, I am a dual US/Australian citizen who is petitioning for my Aussie husband. We are currently waiting for NOA2 but now that the Sydney Consulate is back open I'd like to get prepared for the interview. I am wondering if anyone went through the Sydney Consulate and has experience with proving that domicile was maintained while abroad and/or the intent to re-establish domicile. I have lived in Australia for 5 years, starting as PR and then I got citizenship last year. While away, I have maintained a storage unit in the US, a checking account, an investment account, an IRA, and I have records of voting, but I have not maintained my driver's license. I use my father's house as my permanent mailing address. I have got quotes for moving our belongings from Australia to US and a quote for relocating our cat from Australia to US. Prior to the interview, I will have correspondence between me and the landlord where we give our notice to move out and emails from work showing that I am leaving my job here (and transferring to US with the company). Based on these, do you think I have enough evidence to prove that I have maintained domicile or the intent to re-establish domicile? And if so, which one? Is there anything else that I could add that I'm not thinking of? Or do you think I don't have sufficient evidence for either and will need to move ahead of my partner and start working and get an apartment and prove domicile that way? My work will allow me to transfer from Australia to the US, but I know that job offers cannot count towards the income requirement so I will be using assets to prove the financial part.   23. It looks like Sydney Consulate might have reopened but who knows how long it'll take to get through the backlog.
