My fiancee and I are getting prepared for her interview, and we are getting really worried about the documents for Financial Support.
We met while we were both living in Japan. I moved back to the US in April of last year. I need to earn $19,600 to meet the 125% guideline. My tax return shows only $18,000. If you consider that is only 9 months and prorate it out, it is well over the amount I need. Will they consider that?
I am working crazy overtime now so I can actually show a pay stub that shows I have earned $40k so far this year. Do they look at ANYTHING other than that Tax Return Transcript?
Also double checking... I need to count her when I do my family size right? I would have enough for 1 person, but 2 people is what needs the $19.6k

If you can get a copy of the W-2 from last years job, it would have your date of hire on it. I think you can get the w-2 copy from the IRS (same form as tax transcript request, I think). This with a letter stating your were hired mid-year along with the last 6 months of pay stubs would be sufficient.
Yes, you need to count your fiance as a member of your household. So just you and her would be 2.

I went to my local police station and no one seems to know the procedure for issuing a police certificate - went to a few different stations and got varying stories. Any help or advice on this matter would be greatly appreciated.

Write a letter to the Chief of Police and tell him that his lower level staff don't understand your request. Explain you need a certificate or letter from the police department in the locality where you live stating you have no record of criminal convictions. They have to research their records and then just write a letter on official letterhead.

I have two questions:
1.) First, my fiancee is self employed but the problem is he's still cannot met the 125% poverty line.He said he just started the business and so the income is not that big.So we're getting a co-sponsor and his mom is willing to do it.Now is it ok to have a co-sponsor? I've heard that in the Philippines they don't accept a co-sponsor?
2.)Second, I wanna know if it's enough for the Affidavit of support?

Hello all,
I've paid my I-864 fee bill and received a receipt, but have yet to receive the package. I have received the DS-230 package as the agent for my wife. On the instructions to the DS230 it says that the petitioner should pay the fee and complete the I-864. Do I send it in the same package? I'm frustrated because I don't want to delay the process by sending too much, but it has been 2 months since I paid the fee bill.
Can I send these items together?
If you read the instructions they give, they state DO NOT SEND FORMS TOGETHER.

Standard response from the NVC is that it takes them 6 to 8 weeks to generate any kind of notification

We are in the process of getting our wifes CR-1 and are at the NVC stage. We have submitted her DS-230 with all supporting documents. Since she lives in COLOMBIA we could not get an original birth certificate rather a certified copy (copia de folio) along with a translation. It is legit, has a stamp/signature on the back and the reciprocity site (http://travel.state.gov/visa/reciprocity/index.htm) says its the document to get for Colombia. However we have recieved a checklist letter saying the certificate is NOT an original or a certified copy. What is the deal? Did they not look at the back and see the stamp/signature or do we need to get an apostille?
Please help us out, thank you!
If it is a copy of the original birth certificate with a transalation, it must bear a stamp or seal from a government department that either issued the document stating the copy and translated document are true and accurate.
(I made copies of my marriage certificate and had it notarized by a notary public. This was insufficient for the NVC. They wanted to see that the local government has verified the documents as correct copies and translations)

I am reading all your pieces of advice and have noticed that one may send to NVC certified copies of birth and marriage certificates.
And what about the police certificate? Can I send also a certified copy?
Just to have the original with me and take it to the interview later?

myself beneficiary( in india)......husband (USC)petitioner
husband send DS-3032 form and AOS fee bill 17th sept......and i sent DS-3032 form on 1st oct
as far our knowledge.....when NVC will receive my DS-3032 form.....then NVC sud generate Immigartion visa fee bill
but when i called NVC...the automated response system syas...."IV fee bill generated and will be sent within few weeks"
now i wanna know it is normal.... .as the beneficiary or agent appointed by beneficiary receive the visa fee bill

I am sponsoring my husband in Iran for immigration. I am the PETITIONER and my husband, BENIFICIARY/APPLICANT.
My husband signed the DS-3032 which nominated me to be the AGENT to receive all his mail from the NVC. He then sent this form back to me and I forwarded it onto the NVC.
So now the NVC mails all the forms, letters, INVOICES to me on behalf of my husband (who is in Iran).
I think once you get to the interview stage (case complete at the NVC) then it may be your wife will get a packet from the Embassy in India. But as an Agent you may get a duplicate packet, just in case.

Muslim men can marry outside of their faith. To women who also have a montheistic faith. That is believing in one god versus a pantheon of gods or spirits.
However, the issue really comes down to culture, family and attitude.
One thing you must know, muslim families are close. It's all about group harmony and pleasing the parents. So when it comes to issues of marriage, it isn't a private affair between you and your sweetie. It's about what's good for all.
If the parents are old fashioned, they may act as match makers. Ensuring the new bride is muslim and "fits in with the family."
In my case, I married an Iranian. However, his family never questioned or disliked me. They loved my and accept me totally (a christian).
I have Indian muslim friends and they say their parents would never tolerate their sons marrying outside their religion and even outside of the region they live (Kashmir).

Who else is waiting since 2006 or even before that? I always feel forgotton on this forum because people are worried about having to wait for 6 months or 3 months. I am sure that there are more people waiting like I have been. And please dont give me the advice that I should contact people to help. Trust me I have contacted everyone that I can. The problem with Senators and Congressman is they can only do an inquiry on your file. I can do my own inquiry. Also anyone from MENA- has anyone successfully claimed descriminination and won that anyone is aware of?
Well, I filed in December 2006 and at this point waiting for my case to be complete at the NVC and forwarded to Embassy.
What I would like to know is why you have not considered having an attorney to file a Writ of Mandamus for you?
There are hundreds of people ALREADY IN USA who are being denied timely process of their citizenship because of their names have not cleared the FBI checks. They are all filing Writ of Mandamus law suits as a last resort.

You Can easily marry in Egypt , The Problem is The US Embassy doesnt give the affidivat that show that the embassy doesnot object the marriage , so You Can easily go through your marriage by a lawyer and then you will be able to authorized your marriage in the Court house by a lwayer too , Marriage in Egypt is available , The Egyptian Laws allow marriage of forigeners in Egypt . don`t worry it`s okay ..
Why wouldn't the US Embassy provide a letter stating the American citizen is free to marry?
My husband and I married in a third country. I just needed to provide a certified copy (certified by the Courthouse where my divorce occured) that I was single and free to marry. The US Embassy gave it to me after waiting a few hours.

and she asked me if we had a weeding and asked how many gusts were there and asked for pictures.I showed her the pictures (60 pic) she went though them quickly and she asked for emails so I gave her our emails and skype phone calls history.(she looked at them quickly too).ok till here everything is fine.
then in the end of the interview she said my wife doesn't make enough money so we have to get a cosponsor and she gave me a paper said ;
section 221(g) wich prohibits the issuance of a visa to anyone whose application doesnt comply with the provisions of the immigration and nationality act or regulations issued pursuant thereto.the following remarks apply in your case:*
please bring an I-864 affidavit of support for petitioner.also please bring an I-864 affidivat of support,supporting documents and W-2 forms,and proof of U.S citizenship or LPR status,for a cosponsor.
and she asked me to bring those papers to the reception.that's all.so what you think ? is that bad or good ?
Would be great IF you can get a co-sponsor. It is much better to know that you are being delayed for financial issue rather than being held in limbo because your name gets caught up in AR.
But please answer me these questions:
Does your wife work?
Does she make enough to be the primary sponsor for you? She should make at least $17,112 (for you and her).

Here are some suggestions how.
First make copies of his payroll transfers to new accounts.
2nd if he is hanging out @ his x wife's, call the police to the location and make them file a report.
If he gets rude with you at all, call the police every time and make them file a report.
get it on paper, everything he does.
and if he gets violent, make sure you call the police and put his BUTT in jail.
as for support.
He signed the AOS, He is required to support you for many years to come, it is a fully binding agreement regaurdless of which state you live in.
It is cases like this that made USCIS require the AOS to begin with.

I am in a horrible situation. I married only 9 month ago, gave up everything in switzerland for my husband. Everything was fine, until we where married and had daily routine. He chanced completly, and since 5 weeks doesnt talk to me anymore at all. he transfered all the payrolls to his own account. I work only temporary and have to use this money now for food and gas and my child. He is out most of the off days with his ex wife again. He treats me like a peace of dirt now. I loved this guy with all my heart. My lawyer told me to ask for divorce so he must pay me alimony. I am still in his house. I cant go back to switzerland, I have nothing there anymore. I want to stay here. My permanent card expires in february 2009. First I dont even know if its a conditional resident card or not. All what is written is permanent resident card, expires after 2 years. Is this a conditional resident card? Can i remove conditions if i will be divorced by then? Will i be able to stay in usa or will they send me back? Even if my husband was the one who cheated and treated me like this? Please, please, advice, I am so worried and dont know what to do... I beleive that your card is "conditional." After two years you have the "conditional" status changed to "permanent."
Now, about this marriage situation....I would try to get some counseling first. At least try and see how your husband reacts. If he is willing, then great, maybe you can salvage this marriage.
IMPORTANT POINT - Keep dated notes (records) of each attempt to "reconcile" and "save" the marriage. This means if you call a counselor, than write down the number, name, date and reason for the call.
Later on, if you must file for a divorce, with these records you can show you made every effort to save the marriage and divorce is a last resort for you and that your spouse was unwilling or unhelpful in the matter.
And if you can catch your spouse cheating, then you can divorce also.
There is NO WAY you can get kicked out of the country if you show you married for love and tried to make the marriage work and then had to divorce because there was no option left.
And keep in mind, if your husband was your sponsor, HE REMAINS YOUR FINANCIAL SPONSOR EVEN AFTER DIVORCE.

Yes, you have it right. Your husband would compile your DS-230 with the coversheet (that has the bar code) and ALSO the CHECK LIST. The check list is for supporting documents that need to sent in along with the DS-230.
Supporting documents:
Certified copy of information page of passport
Certified copy of marriage certificate
Certified copy of birth certificate
Police clearance

I am sorry for you. There is a a forum somewhere that lists the different embassies and you might be able to find the number there to change the interview date.
But the main issue is having a FINANCIAL SPONSOR. Your fiance "stopped" working in July? Why?
Since your Dad's (your father-in-law?) future wife does not feel comfortable sponsoring you, you must have your fiance find a new job quickly. Then he can file an affidavit of support.
Being a joint sponsor or co sponsor is a big responsibility. The person who does this is basically saying they will take care of you for years to come if you become financially incapabable of taking care of yourself.

My case was compelted according to the NVC on Oct 1, 2007. What will they do next? If they will send it to the consulate in Pakistan how long will that take? What method do they use to send the case file? DHL, FedEx, U.S Mail is there any way I could track it?
it takes 4 weeks at least to reach to embassy , then u will have to do medical check up by by Dr AHMED RAZA jan that is close to jinah super market in islamabad , along with that , u need 1040s for the past 3 years along with the signed affdavit of support I 864 forum notarized by american notarary public, coz i saw one stupid man there he notarized it from pakistan notaray public cant forget that , i luaghed alot, lolzz along with that , read the packet 3.5 , onething make sure your are qualified in 1040s , if u are not qualified they will deny ur papers and will send u back ur papers, when i sent it took 18 days from them to send me interivew letter, and ur interview is going to be after 6 months if ur lucky and ur interview goes successfull , if not , or some not bad thing happened, they will put u in AP, that will take 3 to 4 months more , ( 3 to 4 buisness days) so ur in wait for atleast 1 year more , so stay calm and do all those things and dont think that much about all that thing coz i am waiting for the last 4 years and i dont know here who is waiting for that much long , my prayers are with you best of luck and Allah bless us all Amin

How would you feel if you made a small mistake (which is easy to do in immigration matters) and people laughed at you and called you stupid?

Dear Harpreet,
You can download them. Or fill them out online and then print. There are two questions where you need to write your full married name in Hindi. Put signature on Part I, DO NOT SIGN PART II (that is to be signed when you meet for interview).
Gather you required documents.
Marriage certificate
Copy of birth certificate
passport page photo
Make sure all copies are certified by government department. If documents are in Hindi, they must be translated into English and then certified by government department that the translated document is accurate.
Then you can mail these to your husband.
Then when your husband gets the forms in the mail, he can just attach the bar code sheet (comes with a packet of forms and has your case # on it for tracking purposes) and check list to the papers you gave him and just mail the whole kit and kaboodle back to the NVC.

Must be translated to english. Also wise to have a government ministry attesting (putting their seal of approval on document) translation is true to the original version.

I am being a pain but I'm freaking because I am visiting family and I'm not close to my residence and that is where the actual copy of my marriage certificate is. I have a scanned copy of the certified copy...is that going to be ok to send with my DS230 or do I have to order another one?
ps...I'm Canadian going through Montreal.

I copied my marriage certificate and had it certified by a notary public and sent those in with my DS-230.
Two weeks later I got a letter saying the NVC wants copies that are certified by the ISSUING GOVERNMENTAL AUTHORITY. Meaning, you can get a copy of the marriage certificate, but the copy has to be certified by the courthouse or agency that issued the original document.
So beware, you could be delaying yourself a few weeks by not catching this.

There is another way albeit a very radical one. Divorce your spouse and then file for a fiance visa. They don't do name checks for that until you file for AOS. By that time your SO is here and at least you can wait together. I know this is probably something you won't consider but it's all I can think of to tell you. Sorry for your hard time. I hope things work out quickly.
It's my understanding the hold up on the case is due to FBI security checks. Fingerprints or name checks. So I don't think divorce and re-filing is a good suggestion because the poster will still have the problem of the FBI delays.
There have been stories of US greencard holders (already living and working in the USA) waiting to become naturalized who have been waiting years for the FBI to finish security checks on them.
Seems rather stupid that it can't be processed sooner for people who already reside in the US.

I am so sorry for your situation! I know how hard this must be for you. It is totally unacceptable to wait six months and then not taken seriously by the people at USCIS.
I have heard that some people have filed law suits against the FBI. Writ of Mandamus. It is for people that have waited an excessively long time. However, you should first exhaust other means of resolving this problem by writing the Immigration Service and State Department. I think an immigration lawyer could draft a good letter - or - you, if you good at legal worded letters. Then send these letters via certified mail so you receive notification of their receiving the letters.
Wait for a response from them. But I would only wait 3 or 4 weeks.
If you do not get some response from them, then it time to contact an immigration lawyer to find out how to proceed with a Write of Mandamus.
Sometimes, I hear the FBI exipidites checks if there is a pending law suit against them on delaying.

My this thread has nothing to do with the legal visa process. I dont know whether i should post this in here. But i want to share my heart. Due to this long process and when it gets delayed due to unnecessary reasons... there is so much stress between me and my wife. My kids miss me a lot. they take my name all the time. I wonder what happens between other couples / relationships... I and my wife have decided not to talk about the NVC and not even take its name in our chats and conversation. It makes all of us frustrated isnt it.... I was about to break my cell phone the other day....... There is no concentration at work...... Our mind is always locating and searching our papers in our NVC offices in our own imaginations.
I wonder what others feeel.... God bless you alll & I hope the next week will bring good news for all of us who are having endless waits....Jigi
It's been such a hard situation....I took a temporary job this year (finished April 17) just to I could re-unite with my husband outside the US for a month. Then I had to come back a hustle and find a job to do the Affidavit of Support.
There are good days and bad days in the waiting process. A lot of day dreams of how our life would be here and lots of memories to reflect on...There is a heaviness of not knowing what will be that shadows everything I do.
My husband is a lot more patient than me.

It is very hard to understand the reasons myself because the denial. But it seems they wanted more evidence from you. What exactly I am unsure of. But I would suggest you contact an immigration lawyer. It could be a very easy thing to overcome.
