Okay, so in the process of booking my husbands flight, I spelled his name Ibraheem, which is the way I have always spelled it. Okay, but on his passport they spelled it Ibrahim. Do you think they will give trouble at check in, or should I attempt to have them change the spelling?
If the flight is booked, but not purchased, I would suggest you try to correct the mispelling now. TThat his ticket name matches that on his passport.
It could be the airline people might give him a difficult time checking in if his name does not match that on his passport AS THE AIRLINE STAFF DO CHECK THIS WHEN ISSUING BOARDING PASSES.

Do we need a joint sponsor if my hubby was making over poverty but under 125% last year (as he spent 5 months with me in Ukraine not working)??

I think I answered you before on this. But I will repeat myself. So please write it down or print it out. YOU DO NOT NEED A JOINT SPONSOR if your huband is CURRENTLY MAKING ENOUGH MONEY!
For year 2006:
1) Your husband will need to provide a copy of an IRS transcript for year 2006 - or - copies of tax returns with supporting w-2, 1099, etc...
2) Write a note: "To whom it may concern, I made ($$$) for year 2006 because I was outside of the US for 5 months and not working during this time.
3) Attach the note to the 2006 taxes.
FOR YEAR 2007:
1) Get 6 months of pay stubs and make copies.
2) Get a letter from husbands employers:
"To whom it may concern,
Mr XXXX has been employed is currently employed with our company
Mr XXXX makes ($ ) annual salary
WITH THIS YOU DO NOT NEED A JOINT SPONSOR!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
Nutty, thanks again. But I asked this question on Oct 10th and got a very clear reply from you on the same day. Seems I have not ask the same question again any more..
But the reason we are still working on this affidavit of support form is that my husband is not making any money right now. He just got a new job in a tiny private company. They pay almost nothing to him right now.
I understand your husband's situation. I am in a similiar situation. I was not working in 2006 and only for the past 6 months for year 2007.
However, that did not prevent me from being the only sponsor for my husband. I got a job a few months ago, waited two weeks and asked my boss for a letter saying that I was a permament employee and I make XXXX amount of dollars a year. It did not matter I have only worked a few weeks with the company.
The company calculated my salary by this:
40 hours a week x 53 weeks = TOTAL GROSS SALARY.
The 125% level of income your husband needs to make now for two people (2) is:
ALASKA - $21,400
HAWAII - $19,687
ALL OTHER STATES - $17,112
GROSS SALARY - BEFORE TAX IS TAKEN OUT.
All your husband needs to do is ask his boss for a letter like I did.

I have been reading posts and websites about what the NVC does. On the affidavit of support once its mailed back to the NVC whats the NVC do with it? Do they go over it or just make sure all forms are there and ships it all to the embassy? Another question if you need a joint sponsor do u need to have that person file the AOS b4 sending it all in to the NVC or will the embassy send us something when it all goes there? thanks
1) The NVC goes over the forms and makes sure you sent all supporting documents.
2) The NVC will then issue an invoice for you to pay for the next set of forms (the DS-230).
3) Once they receive payment for this, you will get a letter saying they received the payment and to download the DS-230 form and complete it with supporting documents.
4) The applicant/beneficiary completes the DS-230 with supporting documents. Sends it back to NVC
5) Then you wait until you get to case complete stage.
6) Once case complete the paperwork (all forms and documents) get sent to the Embassy where the interview will be. You will be notified of interview day and given further instructions.
Joint sponsors should fill out an Affidavit of Support at the same time the petitioner does and send it with the petitioners. Make sure to have the same bar code sheet with the joint sponsors affidavit of support.

It is a form used for income earned by other sources. Interest earning bank accounts, investments, payment for contracted work, etc

Hey!
My husband and I filed for an I-130 petition. We are now trying to gather all the documents so we can schedule our interview. In the affidavit of support it requests proof of income. My husband is a full time PhD student and is living off student loans. I realize that this is probably doesn't classify as income, but he won't be getting a job as his studys take up all his time. Right now I am in Canada working while we wait for all of this to go through. I guess my question is, if he doesn't have an income but has student loans, what do we need to do for a complete affidavit of support? Or are there any other routes we should be exploring?

Your husbands student loans do not qualify as income/assets because they have to repaid.
Your income does not qualify since once you get to USA you won't be working in the same place (more than likely).
If your husband has assets such as investments, real estate that can meet a certain dollar amount (actual dollar amount you would need I don't know, but its on the affidavit of support instructions), then the next option is that he gets someone to be a joint or co sponsor for you.

Every month, the Visa Office (VO) establishes Qualifying Dates that determine if a petition will be eligible for processing. Qualifying Dates are the latest priority dates that can be processed for certain visa categories. An immigrant visa petition can only become ready for further processing when the Qualifying Date in the appropriate visa category has advanced up to the priority date of the petition. Petitions may remain at NVC for several months or for many years depending on the visa category and country of birth of the visa applicant.

NVC asks to send originals or copies of original documents with DS230.. is it enaugh to translate and notarise copies of documents or we need to get apostille that makes documents legal in foreign country- I really don't want to send originals to them.

This means any copies need to be certified by the government department that gave the original document.
RE: Translations
All documents not in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations.
The translation must include a statement signed by the translator that states that the:
Translation is accurate, and
Translator is competent to translate.

Everyday i'm trying to understand better this long process and I still get confused.
We applied through a lawyer for a K-3 visa and are going through the non-ending wait that we all experience...
I read here and there that some people apply directly at a U.S. embassy and things seem to go so fast that I wonder why we didn't go this way. Can anyone apply at a U.S. embassy?
Also, since we are going through the K-3 visa process can we apply for the CR-1 / IR-1 at the same time and can we apply for it directly at a U.S. embassy?
I'm french but live in the south pacific and the nearest U.S. embassy is Fiji for my area.

I think the thing to do is to contact or check the Embassy website in question. Often times, Embassy's will give specific information regarding how they process visas.

Well I have seen 2 cases that almost match yours -- both were CR-1s, both were Iranians processing through Abu Dhabi -- one was male, one was female.
But anyway, RS232 waited about 7 and 1/2 months for an interview date after completion at NVC. He had visa in hand the next day.
Sabr_con_baraye_Azize_delam waited about 5 months between completion at NVC and the interview date. His wife had visa in hand within 2 days.
There are probably more out there if you search the members database.

My husband is Iranian and being processed through Abu Dhabi. Our CR-1 case was completed at the NVC October 11th and is to be forwarded to Abu Dhabi.
Does anyone have a general idea of how long it takes from the NVC to Abu Dhabi and timeframes involved for scheduling interviews?

It was this post that made me bring up the subject. The comment that somehow cheating is "normal" for "their culture."
While I agree with the sentiment that people can't be expected to change "their culture," I don't think affairs or quasi-affairs are an issue of "culture."

Okay, so my husband and I finally got our interview. the only problem is that it's not a month from the day we sent back packet three (as the apparently outdated paperwork implied) but 6 days from now. The worse problem is that his medical interview is on Thursday and the lab takes a week to send out the results from the blood work.
So, #######. Has this happened to anyone else before? What happens if your lab results haven't been received yet in time for the interview, but you have had your medical appointment?
I would contact the Embassy to ask them if you should proceed with the interview and see if they could just accept the medical paperwork afterwards.

In response to the hot thread of Olivia and Waleed.
I know it is very hard for spouses to be seperate for a long time. It does make the "ties that bind" a couple together thin. Given this, do you think it acceptable that spouses maintain "extra" relationships via internet (or other modes of communication)?
My own personal view is that it is very wrong.
Someone suggested on the Olivia and Waleed thread that we should not expect people coming to USA to "change" because their "culture" is different.
However, I think muslims will say that it is not ok for a married muslim man to carry on "close friendship" with another woman who is not his wife. In fact, I think there are more defined rules of behaviour in muslim society preventing male/female socializing compared to that of western society.

Hi Everybody,
Can someone who is not from an English speaking country help me clarify the translation requirements for documents need to be sent to NVC with DS-230? I did not have receive Packet 3, yet but it is likely that it will be generated tomorrow. I would like to get everything prepared before it arrives in the mail.

I have searched this site front to back and looked at the dept of state website and can't find a list of documents needed to be sent to NVC. I am currently in the Philippines visiting with my wife and would like to bring back the ones we will need to send.
Any help would be appreciated

It is not enough to make copies and translations.
There is a special note in the instructions for the DS-230 (look at the instructions for this sentence under each document requested
[b]...."or a certified copy, bearing the appropriate seal or stamp of the issuing authority."[/b]
That means a copy must be certified by the GOVERNMENT department that issues the respective documents.
Or else you will be RFE'd

It is not enough to make copies and translations.
There is a special note in the instructions that state if you have a copy, it must be certified by the legal or issuing authority. That means a copy (with translation) must be certified by a governmental department.
Or else you will be RFE'd

Can I claim him this year on my taxes?

I think you would need to show transfers of money to him in your taxes to claim him as a "dependent."
Secondly, if you applied for the CR-1 visa, on the DS-230 there is a question that specified you should request a social security number be issued once they arrive. Takes about 6 weeks from entry to US, I believe.
I don't know about other visas.

My suggestion is to consult a immigration lawyer.
For extraordinary delays there is something called a Writ of Mandamus. It is basically a law suit. But hopefully, it would compel the USCIS to expidite your application before they would have to go to trial.

I have been reading about this on the web. Some states do prohibit marriage between cousins. Not all. I have found nothing in Federal law that prohibits marriage between cousins.
that's because the states issue marriage licenses, not the federal government.
Well, then I don't see how they would be breaking any FEDERAL LAW by being married cousins. Since there is no law or prohibition against it.

Congratulations on your case completion!
NVC will be sending you (Petitioner) a package containing information as to your spouse's interview, information on medical examine, and what documents are needed for the interview. I am not sure what country your spouse is from.....but NVC does schedule interviews for the Continent of Africa.

Well, now is not the time to be "wigged out and panicing" - but to refocus and be assuring to your fiancee.
So, my suggestion (and the NVC's suggestion somewhere on their website) is to bring 1 set of copies of all documents you already filed.
Affidavit of Support and supporting financial and tax information you filed
Copy of DS-230 you filed with supporting documents (Birth certificate, marriage certificate, passport biographic page, divorce decree if fiancee was previously divorced)
love letters
photos
and proofs of relationship of any other nature (joint ownership in something)
This way....if the consular officer says "oh, I am missing a document," you can provide him with a copy of what was submitted earlier.
