could you share the reason why you needed an I212? Also,  how long after the waiver was approve did you received your appt in the embacy again?

The reason was because of 10 year ban. It took about 8 weeks after I-212 approval for the embassy to email us with further instructions. No 2nd interview (appointment), just had to redo medical and send passport to the embassy.

After I-212 approval, stay proactive and email the embassy letting them know it was approved and send them a copy of the approval (email & upload to CEAC).

  2. Update: our I-212 was approved, 5 weeks after they accepted the form!

We originally hired a lawyer for the whole process but with the long wait I had a lot of time to research and felt confident I could prepare the application so we decided to save some money and file it ourselves. Some cases may benefit from having a lawyer, but it is possible to file and get approved without one. Good luck to everyone on their journey!

We filed our I-212 in April 2021 to a field office according to the instructions on I-212 filing. The latest status is "case was received at another uscis office". We checked some other receipt number and it appears other I-212 cases got processed except for the ones with status "case was received at another uscis office". We couldn’t find any information online regarding this status, whether it means the application is processed at the field office or one of the services centers. Does anyone know the exact meaning of this status and whether it will ever be updated when the application gets approved or denied.

Hello! Did you ever find out what the status meant or where it was processing? My husband filed his I-212 at a field office and we received the same status a day after they accepted the I-212.

It has been some time since I saw a lot of these, possible things have changed and I have not noticed. Not sure how USCIS is involved when it is a DoS issue, perhaps USCIS passes it to DoS via NVC? Do you have a Lawyer involved?

I think things have changed. Currently it depends on the situation (if the application is in the US or not, visa type, other waivers needed, etc). In our case USCIS will adjudicate the waiver.

With the help of a senator, the embassy responded and it looks there is a ban in place.

I-601 Waiver is not needed. CAEC Status is still refused with long text (administrative processing).

The wording on the form is misleading.. they checked the box "no waiver available. Please contact USCIS for permission to reapply". The I-212 is the form one uses to request permission to reapply. Is the I-212 not technically called a "waiver"?

Your lawyer is right and nothing you could have done prior to the interview and a finding of inadmissibility.

ER ( expedited removal) would mean a 5 year ban ban from date his crew visa cancelled and notes . Are you within the 5 years . ? When will the 5 years be up?

I-213 is just one page ..Who paid for airline ticket ..husband or US government?

If the 5 years are not up ..then file I-212 . ..

You cannot file I-601 without the consulate visa refusal sheet that shows he is eligible and it is requested. Likely it will NOT be needed..unless they dig up some misrepresentation/fraud in his file ( original D visa app..prior visa violations )

Your chooses are limite to filing a WOM ..( you can DIY) or pleading with your congressman weekly ( not helpful in this scenario)

If there is a 5 year ban, it will be up Dec 2024.

His employer (Cruise company) paid for the airline ticket.

Who sent him home on a plane?

US government or a cruise ship or airline?

i ask because if on a cruise ship and a rule of the ship is violated,  the ship line will buy a flight from the POE and fly person home

that would automatically cancel  the C1/D visa

There is no waiver for the ds 5535 and the process can be lengthy

There was a lot of miscommunication about the end date of his cruise contract and he didn't board the original flight home with the intent that he will be rejoining the ship to continue work. He made the mistake of leaving the airport while waiting to hear from HR on how to reboard the ship which lead to the interaction with CBP and the cancelled visa. The cruise company paid for the flight.

We understand there is no waiver for the DS-5535.

Why do you think he needs a waiver?  Was he deported?

    His C1/D visa was cancelled.

FOIA Request returned no records except a one page I-213 form but no mention of an inadmissible code or ban, just a short narrative that said he was removed via airline.

We assumed it was an expedited removal.

Our lawyer thought the same and expected we would be asked to fill out waiver(s) at the interview.

  9. Has anyone experienced being in AP for extra background checks (DS-5535) then was asked to submit a waiver?

My husband's interview was in March 2023. We were expecting the CO to state if my husband needed to fill out a waiver or not. Not even sure if he even has a ban. We thought we would receive answers at the interview but the CO just stated he didn't know and needed more time to look into it. A month after the interview the DS-5535 was requested. My thought process is why waste time doing background checks if someone is otherwise inadmissible, so does that mean he doesn't have a ban or need a waiver?

We understand the AP process for the DS-5535 but the waiver process is a little confusing. We tried reaching out to the embassy but no response. FOIA requests didn't help either. We are worried that if he does need a waiver we wasted time and could have submitted it 6 months ago.

Just wondering if anyone has experienced something similar. Thank you in advance!

i emailed them and theyre saying general answers like you are in adminstrative processing and wait for further processing  and updated once after i sent marriage certificate

how long will ap take long??

Hello! AP processing of missing documents is usually completed in 60 days but you also had to fill out a DS-5535 (extra background checks) which can take weeks, months, or sometimes years. It is different for every case. Once AP is complete the embassy will send an email and request passport back.

I am currently in US now with my family. Embassy asked me to submit my passport, new medical report  and 2020 tax return from my wife which i did in January 2022. The embassy held my passport till the Ban expire in April 2022. My visa was issued in May 2022. I think you have to wait for the Ban to elapse. Once the ban is over your visa will surely be issue. Just hold on and have faith.

Hi David. I know this post is old and you have received your visa. Congratulations! I was wondering, were you asked to fill out the form DS-5535 while you were waiting for your ban to expire?

Just wanted to update in case others have questions about the AP process. Luckily after 3 weeks my husband received an email saying his AP was completed and to send his passport back to the embassy. We sent his passport a week ago, and are awaiting a decision. But just today, the visa status on CEAC changed from refused to administrative processing (and on the embassy website it says 'processing completed'). Does anyone know why the CEAC site would say 'administrative processing' when we got an email saying his processing was done? Is there extra processing we have to go through? I thought after getting the email from the embassy saying his processing was completed, we were nearly there, but now we are disheartened by this new status. Is it possible the CEAC site isn't accurate? Thanks for the help!

Thank you for the update and Congratulations on getting through AP so quickly! The CEAC status is accurate. It is kind of confusing but when it shows as "administrative processing" it is the final checks and printing of the visa. It is not the same as the administration processing when it shows as "refused." Once they send his passport back it will change to "issued." Usually takes a day.

    Hi,

Do you know why you were issued that form? Like does your husband have an extensive travel history? Did they ask you to provide any additional documents as well?

I also hope you get out of AP soon!

We can't know for sure why but we are guessing that it is because of his extensive travel history (due to his career), his military service (which is mandatory for Turkish males), or because he lives in a Province bordering Syria.
