  1. Hi, I may be overthinking this but I just want to make sure I am following all the guidelines.

     

    Am I allowed to enter the US between the time I complete the DS-160 and the time of the interview? On the DS-160 it says to state your last 5 visits to the US. If I enter again after submitting the DS-160, will that make my DS-160 untrue?

However, I sent an expedite request directly to the Montreal consulate on Monday and they received it yesterday so I’m praying it gets approved. Best of luck to you guys! I know this process sucks haha

    How do these batches work? They’re sending a chunk of cases every couple weeks or something?

    We got the RFE notice on April 8, 2021.

    First, we found out that we got RFE while I was checking our case status on USCIS website which was saying "Request for Initial Evidence Was Sent". Then we contacted with our attorney who is our point of contact. They received a written RFE Notice via mail and forwarded the scanned copy to us which was indicating what they needed from us. On a side note, we received our RFE after we sent an "inquire outside normal processing time".

    So you probably want to check your case status on USCIS website with your case number first. If there's a RFE, you should be seeing it on there.

    Hope everything will be fine for you and your fiance 🙏 

    I checked again, no update on our case or RFE. I wonder why it is taking so long :(

    Im sorry this has happened. I think your case has been "out of normal processing time" for a few months now. I would think its appropriate to follow-up now ASAP. Most of your fellow August filers have received there NOA-2 and at the embassy stage. USCIS is working on October/November Filers. I would check the data on here to see what stage August filers are, specifically in Canada.  Plus with the backlog in Canada, your finance may not be here until next year. 

    Thanks for the advice! We are supposed to get an answer to our inquiry by the 30th but they probably won't tell us much.

    Like many countries around the world, the US Consulate in Montreal has a huge backlog right now because of COVID, and it was a long wait in pre-COVID times.  So even if the I-129F is approved this week, the wait for the visa interview will be many many months after receiving NOA2.  It could be late this year or even 2022 before the visa interview is likely to be scheduled.  So don't make any moving plans until you have received your passport with the K-1 visa inside.  Good luck! 

    Thanks for this advice I really appreciate it. I suppose we will have to re-evaluate our plans.

    It took a little over 10 months for our NOA2. I submitted two out of normal processing inquiries, contacted my Senator, and contacted my U.S. Representative. I was never able to reach them on the phone, but I've heard that if you ask for technical support, they will let you through to an agent. We were approved with no RFE

     

    Also, the K-3 visa is pretty much obsolete at this point, so that wouldn't really be an option for you.

  7. Hi everyone,

    My fiance and I applied for our K-1visa on August 27th 2020. We still have not received our NOA2. We also have not received any RFE.

    I have planned the move to the United States from Canada for the end of July. We thought that we had given ourselves a good buffer but with Coronavirus everything is delayed. 

     

    In April we requested a follow-up on our case and 2 weeks later sent us an email basically saying "I know this is frustrating but we're working on it.".

     

    We just submitted another request and are supposed to get a response June 30th, but I'm worried were just going to get the same thing. We are anxious to start living together but I can't make any plans until we know this has been approved at the minimum.

     

     

    I have a few questions:

    Should we just switch to a K-3 Visa, or will that delay things even further?

    If this response has no information again, how to we contact the USCIS more directly (phone)?

    Has anyone ever been denied after such a long wait time?

    Has anyone been requested an RFE after such a long wait time?
