    For petitioning sponsor & joint sponsor:

     

    - new completed I-864 form

    - proof of US citizenship (birth certificate)

    - 2020 federal tax return with all W-2s, 1099s and schedules

    - pay stubs from the last six months 

    - letter from employer

     

    We did get help but she wasn’t a lawyer.

    We received an RFE for my adjustment of status recently.

    One of my questions is, my husband is currently unemployed and I’m not sure what documents we need to provide for him since he is the petitioner.

    In the RFE it says:

    Based on the documents submitted, we could not determine that the petitioning sponsor, <husband>, on Form I-864, Affidavit of Support, is qualified. In order to be a qualified sponsor, the petitioning sponsor's Form I-864 must be properly completed and signed, and the supporting documents must establish that the petitioning sponsor's income meets 125 percent of the federal poverty guideline for the sponsor’s household size. See Form I-864P for information on the Federal Poverty Guidelines.

     

    If the petitioning sponsor's income does not meet 125 percent of the federal poverty guideline for their household size, you must obtain a qualifying joint sponsor who demonstrates the ability to support you or submit evidence of assets. See Form I-864 Instructions for more information. If you decide to obtain a different joint sponsor, you will need to:

    -Submit a completed and signed Form I-864, Affidavit of Support, from the joint sponsor. All pages must be present and of the latest edition date.

    -Provide the joint sponsor's Social Security Number on Form I-864.

    -Provide a complete and correctly calculated household size on Form I-864.

    -Submit a complete copy of the joint sponsor's Federal income tax return and all supporting tax documents (W-2s, 1099s, Form 2555, and tax schedules) for the most recent tax year.

    -Submit evidence of the joint sponsor's status as a United States citizen, United States National, or Lawful Permanent Resident.

     

    We also have his dad as our joint sponsor but is retired and owns the house that we are currently living in— we provided all IRS documents w2s, 1040 sr, 1099-r, 8867, 8879, ssa-1099 but it says on the RFE that we need to send them all of these documentation again. They also asked us to include his dads SSN which we did when we filed so I’m a bit confused on out current situation. Any advice or help would be appreciated.

     

    Last thing they added was: You have submitted Form I-485, Application to Register Permanent Residence or Adjust Status, and ALL pages of the form are not present or of the same edition date (which in my defense I made sure that everything is properly answered and even put N/A on blanks.

    I got the same RFE as you, I know the letter sounded so vague, so you have to really double check everything. I have a PDF file of the forms that I initially submitted, and realized that I made a couple of mistake. First, for my joint sponsor, under the "current individual annual income" section we put the "total income" number on the federal tax return that he filed jointly with his wife. After doing some research, the "current individual annual income" means the amount you're making individually for the current calendar year that you are filing, so we put the number that match the salary on the employment letter. We also updated paystubs from the last six months. Second mistake was not sending a complete tax return, we only submitted 1040 forms and his W-2s. We later found out that if your joint sponsor filed taxes jointly with their spouse, you have submit all W-2s, 1099s, and schedules that are related to the tax return, even if you're only using the income from one person.   4. USCIS sent me RFIE for i-864, even though I already submitted it and it's correct. In my online account, they didn't upload the i-864 form, only the supporting document. Maybe they lost it? So I talked to a lawyer, she said it's mostly USCIS mistake and told me to resubmit the i-864 form again with same supporting tax documents but with updated pay stubs. Little bit annoyed but whatever, gonna resubmit it again soon.

    Don't send anything unless they ask you to. If you're case is marriage I-485, you will get a deficiency notice for your medical, not an RFE. You have to bring your medical to the interview.

    9/25/21: Biometrics scheduled for Philadelphia, ASC
    10/18/21: Biometrics appointment for I-485 and I-765 (Code 3)

     

    See you all in 3 weeks or so, and hoping those who haven't got their NOAs or biometrics get it soon! 🤞

    Hey, I just checked my online account too. I was able to access my biometrics appointment notice. I’m scheduled for October 22!

    Are you able to access your notice on the website under your "Documents" tab? I can see it but when I try to open it, it doesn't load.

    Can’t access it yet, it says error. Hopefully soon!

    I see on the myUSCIS website that my I-485 case has some of my paper-filed case scanned and uploaded, but not all of it. I mainly see my entire I-485 form, copies of my passport, and some I-130 evidence. My I-765 and I-131 don't show any file though.

    Same thing with me. Under the I-485 section, there so many missing important documents, such as me and my husband’s birth certificates, marriage certificate, I-94, etc. I was reading through July 2021 filers thread, so many folks got RFEs for documents that they already submitted. But you can upload missing documents on their website.

    You have to make an appointment. Bring the I-693 form at the appointment, you and the doctor have to sign and fill the the form. Don’t fill and sign anything unless instructed by your doctor.

    So two cheques: one for $535 and second $1225 thats all? no fees for any other forms? i.e. employment authorisation or travel authorisation or medical records or fingerprints/biometrics etc?

    The work permit fee is waived when you file together with I-130 and I-485. The biometric fee is already included in the $1225, I-485 payment.

    1. Everything’s correct. 
    2. 2 passport photos of US citizen petitioner, 6 passport photos of the applicant/beneficiary 

    3. $1225 for the I-485, $535 for the I-130. 
    4. Should be two separate checks, payable to “U.S. Department of Homeland Security”
