  1. as mentioned in majority of other threads on this topic: your sister can not use the tourist visa to come here with the intent of adjusting status. The way you write it sounds like she did not. She will have to show evidence supporting a bona fide marriage ie it wasnt just for the purpose of adjusting status.

    I am quite frankly unsure about this special scenario of being married before her husband naturalizes. (so the scenarios below are really more a standard case of adjusting when the partner already is a US citizen)

    Could others please comment on this?

    Assuming she came just to visit:

    My understanding: she cant file on the basis of an LPR. so the two options are for your sister to

    - go back home and file via consulate

    - wait until naturalization goes through and file then.

    filing with or without overstay does not really make a difference as long as filing occurs before 180 days of overstay.

    given your timeline of naturalization this should be feasible.

    (Please bear in mind that it may take a week or more from sending your application in to them giving you a date. so sending 179 days beforehand does not work)

  2. This question is for my sister who came last November 2011 in the US to visit me. I showed her around, and she reconnected with her friends. We met her former HS classmate, and they fell in love. They recently got married, and the guy filed for naturalization yesterday 2/29/2012.

    My question:

    My sister's visa expires in May. And the Certificate of Citizenship of her husband might come out after 3 months the earliest. Should they wait to file the I-130 when the husband becomes USC? Her tourist visa expires by then.

    Or..should they file now, so she wont ne out of status, even if the husband is still LPR?

    Any thoughts, suggestions will be highly appreciated..and please, no condemnation. They are really sooo in love....

  3. I wasn't implying that he will use the Philippine passport going back... The reason of the airline to deny him the return ticket because he registered a philippine passport when buying it earlier... of course they will use the US passport going back to PI, the OP clearly states that, thus, his question.

    I just do not understand the issue of not making him avail the return ticket when its the same person who will use it, just a different documentation coz of the change of citizenship which they can explain since he underwent the process of naturalization while here.and BTW, the OP did mention that that his son will apply for dual citizenship when he gets there, thus, nullifying the requirements to obtain a student visa.

    one of the rights is to travel bearing a filipino passport.

  4. Also, we don't intend to let him stay in the Philippines illegally. He is planning to go back to College there, but we will see when he gets there. I am just adopting a wait and see attitude, going with the flow..He is a young man, and if he plans to stay more than 2 weeks, then we will file the necessary paperwork.

    Sorry for using the word- technically.

    My purpose for asking was why can't he travel using the same ticket, because it was issued in his name, and the name on the passport matches the ticket. His Dad is a Filipino citizen, and he is a minor born in the Philippines. His father will file for his Dual citizenship when he comes back.

  6. An example would be "Until now Palawan is beautiful" meaning palawan has been beautiful and is still beautiful including the time I say this. Whereas if Americans say that sentence it would be interpreted as Palawan was beautiful before and now it's not. Make sense?

    Now I get it ( I hope I truly did!)... Maybe we should use- EVEN NOW.

    I didn't realize that word would make a lot of difference with the way it is said- until now.

  7. My son has the US passport already. They dont want us to use his US Passport to rebook the return flight ( since the flight was registered using PI passport), nor use the Phil passport with this ticket, since he is technically USC. I guess they want us to purchase new tickets with the US passport, emphasizing we need exit tickets from Manila.

    Thank you for the answers, guys. And Im sorry i didn't make my question clear, or did I make it more confusing? Hope you can still help me out. Unnecessary expenses for me, these things they are requiring us to do.

  8. Hi! I am now working as an RN in CA. I came here without experience, since I was from a different medical field, and was hired. Been RN here for 3 years now. I applied with the CA BON, they did not require the NLE, so I went ahead and took the NCLEX without the NLE. I took it in HK since we didn't have it in the Philippines at that time. If I remember it right, Vermont didn't require the NLE, too.

    If you want to work in CA, feel free to send me a PM, cause I think the hospital where I work in are hiring new grads. In fact, they are offering Versant Residency program for new RNs.

  9. Hoping for someone to shed light on how to go about this..

    My 17 year old son recently became USC, and wanted to go back to Manila to continue college, and then come back here. He came here last July on IR2, had his oath as USC last month. We had a long talk, and he's finally decided it would be better for him to finish College in Manila. He was a freshman when he left last July. For practical purposes, I am allowing him.

    My problem- we were trying to rebook his eticket in PAL for an earlier time than his December flight sched, to make it to his enrolment ( he's in a trimestral course), but PAL said we can't do this, since we used his Phil passport; we have to cancel his Phil passport first and book an exit flight from Manila going back to the US. I reasoned he is going to apply for Dual citizenship when he gets back to Manila, since if we do that here, he wont be able to get back in time for school. I know that we have to contact the Philippine Consulate for this, but I came to VJ, just in case some can give us inputs on how to go about it. The Philippine passport has just been renewed before we left last July. But I know that technically, he can no longer use it, and they dont him to use the US passport for the return ticket.

  10. Just applied for my son's US passport, and guess what the nice girl who received the application told us..?

    "Did you still apply for the N600?" I said yes, and she said- "Well, you just wasted your precious $600..the only purpose for that is to apply for your son's passport, and look, he can have his proof of citizenship with just that." I said, "well, we'll never know, we might need it in the future" To which she replied- "Nah, he's fine with just the passport. That's enough proof".

    Well, better be equipped than sorry. Peace of mind has no price.

  11. Thank you, Langa, for posting about your daughter's interview experience. Just filed the N600 for my son; went ahead and did that after much contemplation on PP and N600 vs only PP. $600 for the N600 ( nice and easy to remember- thanks, Bob!) is a lot of money, but for my peace of mind, I decided to just do it since he's turning 18 pretty soon.

  12. just a piece af advice..

    You need the copy of most recent ITR and W2. Even if we submitted the documents with NVC, I was asked a copy of the 2010 ITR. On the day before our interview, I asked my husband to fax the ITR (cuz i brought 2009 with me, good gracious!), and then I photocopied the faxed copy. And true enough, the IO asked me for a copy. Better be prepared, just in case.

    We did IR2, BTW.

Called up USEM, and was told it usually happens when the given name is so long that it cannot be printed, and that there will be no problem in the port of entry as long as the data in the immigrant visa summary is correct. However, we can still request for visa correction. The operator is unable/not allowed to say what goes on after this, though. We will be going to the embassy today, and see what happens.

Today, we received the immigrant visa packet of my son, and we got so excited when it came after only three working days, because I really need to go back to the US. However, when I checked immigrant visa issued ( serves as temporary I-551 upon endorsement, as annotated ), the given name was missing the last 2 letters.

    Is it okay to go directly to the US Embassy in Manila to have this corrected? Another form?

    Just when we thought we are almost home...........

  16. Thanks everyone! Sorry for the delayed reply. Been busy after interview day. Just waiting for our visa to arrive so we can move on with the seminar/counseling and buy a ticket, plus some last minute shopping for the wedding. :)

    Congrats! We had the same interview date. We might have even bumped into each other, as we were there at 6am too. I was with my son (IR2). I wish I knew who among the interviewees there were from VJ.

    I just received the visa few minutes ago. Yours should be on its way. Tomorrow we'll go to CFO and fly out next week.

  17. We've placed Metro Manila on all our forms since 2007, and we never had any problems. We were originally from Makati City; at first I wanted to cry when I first submitted a document to USCIS in 2007 and placed Metro Manila instead of NCR, but it went through, and I've been putting that ever since.

    My son just had his interview July 1st, and that was also what I wrote when I submitted all his documents. Hope this helps.

    so... does anyone what those few specific situations are where one would need cert of citizenship and a valid passport would not work?

    Hopefully, someone can provide clarification, as I have the same question. From hearsay, I was told that there would be problems in College. Wish someone could shed light, or share actual experience.
