    I was able to get this question clarified through an attorney, who clarified that I should attach the W2s, and then also provide an explanation to avoid further confusion.

    Because it changes the name, so it says that old company I made this much, new company I made this much, so it could be easily mis-communicated that its two different companies. Even though my transcript shows I made well over the amount required. Easy way to understand is that 1 W2 shows for all the months leading up to the acquisition, 2nd W2 shows remaining months but under new company name. I didn't switch jobs though, and my old company just changed its after acquisition.

I have tax transcripts showing my income, but my question is: My company position was part of an acquisition by its primary company, and I still work for the same company, but I got 2 W2s, 1 with old  company name, and the 2nd with the new company name. The problem is that it cuts my income in half, even though my employer letter states I make more than enough to sponsor my wife.  

     

    Do I send in just the tax transcript, paystubs, employer verification stating I still work with the same company, 1040 without the w2s, or should I send in w2s from the old company and new w2 with the new company name?

    You just update your address as you go along. It won't interfere with the process, it'll just change where mail gets delivered from USCIS.

    When did this happen to you? 

    Last year, had the same spill about things taking 180 days, but it was like a month. The good thing is that USCIS will expedite the case, and it will go a lot faster on the second go around.

    It won't take 180 days, they just say that at USCIS, it will be a quick process, usually a month tops.

    NVC received our petition on January 26th. I called again this past Monday to see if it had been put in the system yet. That’s when I was informed that NVC had to send my case back to USCIS on February 3rd. He said my case wasn’t put in the system so they didn’t know why. He also said it’s been happening a lot lately where they’ve had to send them back to USCIS for certain errors etc. 
     

    USCIS just received it yesterday so now my status says that the department of state has sent it back for further review. 
     

    Has anyone had this happen? Or know why or what could cause this to happen?

     

    I’m just waiting patiently now for the notice in the mail to find out what the heck is going on. If this is a USCIS error, this is criteria for an expedite, correct? 

    My case was sent to USCIS, then sent back, had to make corrections. More than likely, USCIS forgot to do something on their end.

  8. My fiance's k1-visa case has been approved and the visa was issued. I'm not aware if this question has been posted before, how long does it take to actually recieve the package? Is their any specific thing you do when you receive the visa in the mail. She got her visa approved by the Sydney U.S consulate, visa was issued on the 16th.

    When it comes to legal matters like this, consult with an immigration attorney. You also don't want to not include it, since the department of state will find it.

    As I did not have my partner's original divorce decrees, my application could not be processed here in Melbourne. I was given a yellow 221g form with instructions to obtain the original decrees, and to then send them, along with the rest of my documents, to the Sydney Consulate. My case will be processed there,

    I had my interview this morning at the Melbourne Consulate. I used two manila folders to hold all of my documents...one for the required documents and the other for relationship evidence. Both myself and others who were also there for interviews at the time, were allowed to take their folders upstairs. 

     

    I used paperclips to keep the different sections of my documents together.

    Additional evidence is strongly advised. Table stakes are current statements of intent to marry within 90 days of POE from each future spouse. 

    I did a Letter of Intent for the re-validation letter, your saying she should do one also?

  13. I have my k1 visa interview coming up in Melbourne Australia, I have a few questions.

     

    • -When a case is done at another consulate, do they send the entire petition with all documents and attachments?

     

    • -Do you need to provide any additional evidence of ongoing relationship, due to covid, me and my fiancé could not see each other in person? I can provide chat logs, shared images, and things I've sent her during covid. I don't see it being listed as a required documents, just on the travel.state website for required documents. 

     

    • -Does my fiancé have to do another medical, the Sydney consulate claims that medicals are good for 3-6 months?

     

    • Does my fiancé need passport original passport photos from me? I've given her a copy of my birth certificate, even though one was already included with petition?
  14. My fiancé has an interview in Melbourne Aus for the K1visa, I've been working at my new job for 90 days. I make 45,000 a year before passive income. My question is, since I don't have tax documents for my new job, can I use paystubs? I also have a co-sponsor as well, but I make more than them.  Can I include my passive income, if it comes from the military, with the passive income, I would be over 50,000 a year.

This case took place this year and he already had 2 hearings, his third one in november but we want   to submit the k1 visa by the end of august or mid september, as soon as possible.

     

    What should we do? wait until he got dismissed by judge? or we can sent the packet and explain what's going on and tell them? 

    In the us we are innocent until the countrary is proved

    You'd get an RFE, but in your situation, I would recommend that you tell USCIS, so you don't get hit with delays.  A lot of vagueness, but if you file before the 2nd case has been settled, the CO will ask about it. USCIS does a federal background check, if it comes up, and you haven't explained, you'll get an RFE to explain. 

     

    Every case is different, I can bet, you're not the first person that has had to deal with this type of situation/scenario. 

  16. I started a new job, making around 40k, not including my other income, I have a co-sponsor (whose been working for the past few years) who makes around 40k. Can I just use my income, or should I also use my co-sponsor for my AOS? I'm currently waiting to get a interview reschedule due to lockdowns. Also to add, interview will be in Sydney, Australia.

So, if your fiancé requested a rescheduled interview, then a new interview date will be given by the Sydney Consulate after the current lockdown has ended. 

    Yeah I managed to find the email they sent, and they'll be giving us a new date once the lockdown ends.

    I doubt it.   Sydney is not a high fraud consulate.   The interviewing officer will be well aware of the unique covid situation in Australia, such as citizens being unable to leave the country without a waiver.   You could always bring chat/phone records to the interview, but my guess is they will not be needed.

     

    You should both rewrite and date new letters of intent to marry each other though.

  19. My fiancé's interview is coming up soon, my question is in regards to additional evidence. Since covid, we haven't been able to see each other. Do we need to provide additional evidence at the Sydney consulate, and if so what kind of additional evidence? The Sydney consulate already has our petition and all the original evidence.

    I don't remember why exactly. Perhaps because it includes fingerprints. Maybe someone else can clarify that. But there are more recent threads on VJ about this.
