I’m currently married to a US citizens and am residing in the US on a TN visa (work visa). I am DQ’d and waiting for my interview date at the Montréal embassy. My question is, after the interview, does the embassy hold onto your passport? What if I need to get back home to the US or even toronto, how would I travel if they hold the passport for two weeks. Would I have to stay in a Montréal hotel?

Be aware that you may be denied entry into the US under your TN status as the IR-1/CR-1 interview constitutes evidence of immigrant intent that may conflict with the non-immigrant intent requirement of the TN status. Unless you're placed in extended Administrative Processing, you have to plan to stay in Canada for a few days until the passport with your visa catches up with you.  To lessen the chances of going into Administrative Processing, book the earliest medical appointment you can get once you get your interview date, and make a day-trip to Canada out of it. I don't think they deliver the passport to a hotel, either, so you might want to look at staying with family/relative/friend/etc. living in Canada.

You can fly domestically in Canada with a Nexus card or a Real ID-compliant or enhanced US driver's license.

  2. Question for the group:

Since my DQ date is April 16, it seems probable that I'll get an interview letter in November for a December interview date. Currently in US with a TN, regretting not filing for AOS, but here we are.

The complication is that we're having our first child in a couple weeks (due 10/31) and I just don't think it makes sense for me to be away from a newborn baby and a recovering mom in order to do the physical exam and the interview, after which I would not be able to get back into the US until I get the passport back. So I think I have to strongly consider rescheduling the interview, if one falls to me next month.

How does rescheduling the interview work? Has anyone rescheduled their interview recently and how long would it take before the interview is rescheduled?

Definitely cannot afford to spend 3 weeks in Montreal. 😕

Maybe I'll fly to Vancouver (family lives there) to get the medical exam well ahead of time. But how long should I expect to have to wait after the interview before I can re-enter the US? As in, when can I have my passport back (assuming I need a passport to enter the US). Note that currently my passport has a TN Visa attached to it.

If it's an issue of finding accommodations, I'd say fly in for the medical in Vancouver, go back to the US, then fly to Montreal for the interview.  However, your passport will need to be shipped to a Canadian address (such as your family's address in Vancouver).  If it's a matter of $$, spending money to fly across the country multiple times in two-three weeks might be about as expensive as finding an Airbnb in Montreal for 3 weeks.

The post above me raises the Nexus option to cross the border without a passport, but DISREGARD IT AND DO NOT TRAVEL TO THE US after the interview but before you get the passport back with the visa in it.  Your TN turns into a pumpkin after your interview - having your immigrant visa interview at the consulate is the point of no return in terms of maintaining a non-immigrant intent that is the necessary predicate for an entry into the US with a TN status, since you are making application for an immigrant visa at the interview (i.e., immigrant intent).

Late night venting (and a cautionary tale if anyone is considering standard service) because this is beyond frustrating.

My wife became a US citizen on 04/14.

She applied for her passport @ USPS on 04/26, standard service.  Quoted 12 weeks at the time, and we weren't in a hurry, so why spend the extra $60?

First sign of trouble (actually, the only sign of anything in this whole process) was that check was only cashed on 06/07, which is the same day the application finally showed up as being "in process."

    and....

....not a goddamn thing since then.  Today marks 15 weeks and 3 days since she applied.  In the meantime, they pulled a switcheroo and the expected timeframe for standard service is now 18 weeks.  Awesome 🙄

We have no upcoming international travel plans, so it's probably not appropriate to reach out to a congressman or senator, or try to get an in-person appointment.  We've waited this long, so we don't see the point to forking over more money to expedite the application.  But the aggravation mounts ever higher with each passing day, and god forbid if something happens that requires her to prove her US citizen status.

    Update:

8/12 - after the late night post, woke up next day and reached out to our Congressman's office.
8/13 - response from Western Passport Center, to inquiry from our Congressman's office - "If the applicant is traveling soon we suggest that she upgrades to Expedite service for 60.00 so that we can start processing the application and upgrades to UPS overnight delivery for 17.56. Please send us credit card information by replying to this email so that we can process the application asap, thank you!"  almost 16 weeks in, they're telling us we need to pay more money for the privilege of receiving worse service than promised at the outset.
8/16 - was about to send Congressman's office an email thanking them for reaching out but ultimately deciding to wait it out. as I'm literally writing the email, got a UPS email notification that an overnight package was on the way from Western Passport Center.  checked application status on the passport tracker website, status shows it still to be in process, but as an expedited application (?!).

Very mysterious, but we'll take the passport in our hands, if it indeed arrives tomorrow.

I would start with AskNVC because until the Consulate schedules your interview, your case would be at the NVC. They should be able to upgrade your visa category without issue.

Please fill out your timeline if you haven't already. @Hawk Riders can add you in then.

My timeline's up to date (also includes my wife's citizenship stuff as well, which is why I have both permanent residence and citizenship timelines).
