Was your husband working last year?

He started working December 2022, so he just got one paycheck that year 😂 we still filed married-jointly with that paycheck plus my income

That's why I'm not sure if I should make him file I-864a (as his sister household member) and me file one as well as is my income. He still is working in that same position.

I’m a US citizen. I’m sponsoring my parents. I and my husband are students, we don’t have enough income, so my sister in law will be joint sponsor.
I wonder what kinds of form we should fill out for Affidavit of support. So I will fill out I-864 for me and another I-864 for my sister. My question is does my husband need to fill out I-864A even his income is not enough?

Hi ! I'm going through something similar, how did you end up filling the forms?

My sis in law is sponsoring both my in-laws but my hubby just started working so my income is what we filed with taxes.

Why make it more complicated yet you have an easy way out?

I'm sorry I'm just not really understanding 🥺

Somebody told me that my sister in law should file I-864 and my husband just the I-864A as we live under the same house. It was better this way as if I become a joint sponsor then we would have to count him, myself and my daughter in the household thererefore we have to make a higher income. I believe they said that because she's trying to sponsor both parents. I'm not sure tbh that's why I'm so confused 😕

If he didn't work last year, you don't need I-864A..

You can add your W-2 to correlate that fact.

Additionally, I-864 asks for joint return income AGI and individual income. Pay attention to make sure you don't mess one or the other.

I was thinking maybe so he can show that he could use his assets (checking & savings) in case she needs it?

  5. ohhh okay.

For I-864A, should I also file one? We filed jointly taxes for 2022, but all of the income was mine. I don't mind signing the contract as he started working this January anyways. What do you suggest? Just two I-864A from him?

Each individual needs a separate I-864. Same for I-864A.

  6. Hi,

I have four questions. Please, please bear with me 🙏

Context: My sister in law is bringing both her parents to the USA. They have been approved already so she now has to file an affidavit. Therefore, my husband has offered his income/assets if she were to need it (most likely) but we currently live in the same house/address as her.

    My following questions are:

    1. Does she need to file two different I-864 (one for each parent?)

    2. If not, then that means she should only file once and just add either parent as an extra member she'll be sponsoring?

    3. In part 5 of I-864, it says "optional" to add a sibling who will submit I-864A but im guessing she should add my hubby in it?

    4. Does my husband need to file two separate I-864A or just one and add both parents in it?

    Thank you in advance!

You should write the current income projection that your SIL can provide documentary evidence for.  Example, if she has a recent paystub and that paystub shows that she gets paid every 2 weeks, then the calculation should be -- gross pay from that paystub x 26.  Submit a scan of the paystub in CEAC as evidence of current income.  Although not required, you may also put a note in the Additional Information section of the I-864 to explain the income calculation, something like "current annual income = gross pay from May 19th paystub x 26 pay periods in 12 months".

Amazing! Thank you so much, I'll tell her to upload income paystubs

The previous posters mean that you might be doing the current income calculation wrong for the I-864.  Remember that the income reported in last year's tax return is PAST income.  CURRENT income is projected income for the next 12 months.  So if your SIL is currently working at least 40 hours per week, then for the I-864, her current income is $21 x 40 hrs x 52 wks = $43,680.

Finally a sane comment. Thank you.

So her schedule is more than 40 hours per week, should I just write down the income she would on that or just the 40 hours? I've done the I-864 by myself but this time it's confusing or I'm just overthinking it lol

If she gets 40 hours a week and if she works 52 weeks a year, then her current income is not $30,000

Unfortunately too many petitioners get this wrong and the visa ends up being denied because they under report their current income.

She's a workaholic and is payed double for the extra hours. She used to live abroad, decided to come the USA in April 2022, May 22 we submitted her parents

petition and she started working in August 22. She didn't under report her earnings, just did a lot of extra hours.

She'll most likely make double this upcoming year which is why I'm thinking she could sponsor her mom herself and I can help out with her dad ?

  10. Hello!

My sister-in-law is petitioning for her parents to come to the USA and both I-130 applications have been approved (parents live abroad). We have decided to continue with her mother's process as her dad's case hasn't been created at NVC yet.

She made around $30k this year which is enough for her to file an affidavit by herself.  However we're not sure if she would need a co-sponsor when we she files an affidavit for her father. We're willing to help as we live in the same household. We made $38k this year plus have a house, bank accounts etc.

Should we let her file only her as a sponsor for her mom and then add ourselves as co-sponsors for her father?

Finally received the Green Card in the mail today! Took about 20 days from approval to receiving it in hand. It took a while for it to update to "Card being produced" but once it did, it got here in about 2 days.

Wishing everybody best of luck and hopeful you all will get some good news soon!

Thanks! I was just going to ask how long it usually took after the approval 😂
