  1. I’m just worried that the writ of mandamus is quite a drastic draconian action. I fear that USCIS will then negatively view my case if I file a lawsuit against them. I mean they really shouldn’t especially if all is good with your case. Have you heard of any positive results with the writ? in the meantime I have written to my congressional office for them to reach out to uscis. See if that produces any results. My next step was the ombudsman office and then only to consider a writ, but welcome any thoughts.
  2. Thank you for all your responses. I only submitted for N-400 because it is outside normal processing time. It says that my I-751 will be outside at the end of November. So I will submit the e-request then. in the meantime. I will reach out through my congressional office to query about the status of both applications with USCIS.

  4. Thank you. The marriage is ok. We have had a child together since filing I-751 and N-400. There are some rought patches, but would that have an effect on I-751 or N-400? Separate question, if five years pass since I've had a green card (with the I-751 extension), can one apply for a separate N-400 based on the fact that I'ved lived in the US for five years with a green card?
  5. Thank you. but I thought that the two applications are independent. I understand approval point and that when we go to an interview the officer will decide whether to do a combined interview or say need to wait for I-751, but I don't think it means my N-400 can be ignored. I've seen many cases where a combined interview was done without any issue. In fact most people I understand apply for N-400 even while I-751 is pending. I submitted only in relation to N-400.
  6. Hi everyone, I am in a bit of a limbo and not sure what to do - I would very much appreciate your honest thoughts on the best way forward. This relates to my application for N-400. For context, I have a I-751 (petition to remove conditions on residence) this was submitted on 11 August 2023. I submitted my N-400 citizenship application to USCIS and received receipt notice on 5 June 2024 (as of today this is over 15 months ago). My receipt notice states National Benefit Center (Overland Park, KS) I checked and my field office for any N-400 interview is West Palm Beach, FL. On my N-400, my biometrics were reused and I have since had the status of "case is still being processed by USCIS." My USCIS online profile also has now been over months saying: "your case is taking longer than our previous estimate and is now outside normal porcessing times." When I checked the case processing time tool on USCIS page and gave my receipt notice - it stated that states - You can send us questions about your case by submitting a Service Request online. I sent e-request for outside normal processing time to USCIS about two weeks ago. Yesterday, I received an email from USCIS (Customer Support in Washington, DC) stating the following "We have determined that your immigraion benefit request has not been pending longer than what is normal for the specific request type. Please be assured that we are handling your request..." I think USCIS are wrong. As noted, it has been over 15 months since I filed and when I first looked at the processing time for West Palm Beach, FL, it provided that processing time is around 6 months. Now it is 9.5 months, but still I am now beyond even this current longer period. I am not sure what to do in these circumstances. Do you think I should submit another e-request to USCIS or contact congressional representative and/or request assistance from USCIS Ombudsman or escalate this otherwise. Or should I just sit and wait until they assign an interview for me. I'm not sure if this is the pending I-751 that is causing this issue but that is still not a reason for them to delay N-400 that is its own separate application. In other words, if you are married to US citizen and have a green card, you have a right to apply for citizenship within 3 years rather than 5 years on the green card. I feel quite defeated. I was hoping for a positive response with this e-request. I have a few friends that filed N-400 after me (in busy locations e.g. California) and have gone through an interview already. I would very much appreciate any thoughts and comments on this. If anyone is in the same boat, please also let me know.
  7. Hi guys, Quick follow up question. On the e-enquiry for outside normal processing window there is a question about Last action taken on the case with a free text box. I was going to keep it short and say this (that was the last official action from USCIS on the N-400). "On June 5, 2024, I received a notice stating that USCIS will reuse my previously captured fingerprints and other biometrics. No further action has been taken on my case since then." Would you add or change this in any way?

  9. Hi, I was wondering whether anyone is still waiting for their N-400 interview at USCIS local office in West Palm Beach, FL. I filed on 5 June 2024 and my status continues to state "Case is still being processed". I am going to file soon a request for status update with USCIS since my wait time is outside the processing window now. Has anyone done this and been successful? I was also thinking whether to write a letter to my governor, but not sure if this would be helpful. For context, my N-400 has a pending I-751 (but that has been processing for years now).
  10. Hi everyone, I’m not sure how many of us are in the same boat but I’ve been waiting for an interview to be scheduled for N-400 since 5 June 2024. The adjudicating office is West Palm Beach and I have a pending I-751 with a marriage based two year green card. I note that the average processing time is 8 months and I believe that only in April I can send a case inquiry. I was wondering if there is any point in calling the live USCIS agent or to just sit tight and wait. It’s so frustrating because it seems that there are lots of people getting quicker interviews. Any advice or words of encouragement would be greatly appreciated!
  11. Hi everyone I applied for N-400 in June 2024 to the West Palm Beach office through online system. I used to have a case status update on how much time was remaining but this has disappeared. It used to say to me case taking longer than expected. For context I did add a document to the online system.

Hi everyone i I recently saw in another post that someone was able to get their interview scheduled after they submitted additional documents on the USCIS online platform in relation to their n-400 application. I understand that they added a document and the next day an interview was scheduled. I submitted my application in June and the current status is actively reviewing. The estimate of time is now saying that your application is taking longer than expected. I was wondering if your application is flagged with USCIS officer if you submit further supporting documents (without RFE) and the schedule an interview because they see you are outside of their estimated processing time. any thoughts on this would be appreciated!

  14. Hi everyone Quick question - do you think the estimated time for decision on USCIS page (when I log in and check my n-400 status) correlates to when you may hear from local USCIS offices? What has been your experience? I filed in June 2024 and the status so far has been your case is being actively reviewed. A month ago I noticed that my decision time reduced from 5 months to 2 months. Now I checked and it says 31 days. Any thoughts or tips from your experience would be appreciated.
  15. Hi everyone, I have been filling in the online N-400 form and where it asks have you ever not paid child and/or spousal support - I answered NO. This is because we are married with my husband and have a baby and everything is ok. This question is not applicable to me but I still need to answer it on the online form. Now the evidence portion asks me to provide evidence about child/spousal support etc. I have no evidence here because this is not relevant but I am not sure how to remove this from the form. Do I simply write up a letter on Word saying that this is not applicable to me since my husband and I are married and no child/spousal support payments are relevant?

  17. Hi everyone, I am debating whether to request a name change on N-400 to my married surname. My green card is still in my maiden surname but I would like to have my new US passport issued in my married name. Should I request this through N-400 or later on change the name on my passport. The reason why I am not sure is because apparently you need to have the name change can only be done through a judge/court sworn in ceremony at USCIS and these are held apparently quite rarely in some offices. I don't want to delay the swearing-in ceremony after interview. FYI my SSN is in my married name. Has anyone come across this before? Any suggestions on how to have my surname changed to my married name for the new US passport? Thanks very much in advance!
  18. Hi everyone, I will be applying for citizenship (N-400) online while I-751 is still pending. For reference, I filed all my previous applications (including I-751) by mailing all the forms and papers rather than online. When I logged into my USCIS account (which I think USCIS created after I filed I-751 to check on its status), I noticed that USCIS scanned only a portion of my I-751 application (titled part 1) there are no other parts scanned in. Is this something I should be concerned about? Did they lose the other documents I submitted with I-751? I'm still planning to resubmit some of the documents which were submitted with I-751 and that appear online on USCIS, but let me know if you there might not be any need to submit them because USCIS already can view these. Thanks in advance!
  19. Hi everyone, I will be filing for N-400 based on three year resident status under the marriage exception. My I-751 is still pending. When providing documentation on marriage for N-400 as the joint bank statements, how far do you go back? Past 6 months or a year/longer? Also, my husband and I have a baby (mentioned the conception and ultrasounds in the I-751 application) - would it be ok/should I bring our baby with us to the N-400/combo interview? He may be around 6 months/one year old by that point. Not sure if anyone has done this or would even recommend if let's say we can't find someone to look after him. Thanks very much in advance!

  21. Thank you so much! Appreciate your response so much. One final quick thing - I guess it also does not matter if I file online the N-400 with the 90 day filing window. In other words this applies to both online and mailed in applications.
  22. Hi Everyone, I have a few quick questions. I will soon be coming up to my filing right for citizenship under the 3 year rule. However, I have a conditional resident card which I have filed to extend under I-751. This application is still pending and I have the 48 month extension to my green card. I would like for apply for citizenship now and see if the USCIS officer would combine the two interviews. My questions are: Has anyone had any luck with this recently? When you filed for N-400 did you file online or by paper form? I hear that N-400 filing online is more efficient and popular but my I-751 form was filed by paper. Does that make any difference to the citizenship application? Is there an example cover letter for filing this type of application with I-751 still pending? Did you include a copy of your I-751 application? Unfortunately I did not make a copy of this before sending and therefore, may not be able to include this. Does it make a difference to the USCIS officer or could they request your application internally within USCIS before the interview? Thank you very much for your help in advance!
