  1. Question for people who's green card is approved, and the interview was waived. How long after submitting your medicals did you get your green card?

  4. - Thank you, @Demise I am confused about your second statement. So at this time I am sending the paper AR 11 copy, letter and RFE copy with the medicals to St.Louis field office (1222 Spruce St Room 2.205, St. Louis, MO 63103). The RFE states to send medicals to this address. I will not provide justification for delay in responding in the letter, thank you. Also planning to note on letter that a separate AR 11 is being send to VSC. I am sending a separate AR11 paper copy to VSC as per uscis change of address instructions specifically for VAWA clients: https://www.uscis.gov/addresschange . The address listed for this on the weblink is (U.S Citizenship and Immigration Services Attn: Humanitarian Division Vermont Service Center 38 River Road Essex Junction, VT 05479-0001) I can of course add a letter to VSC as you instructed, along with the AR 11 paper copy. Please let me know what you think of this, sorry I didn't provide all the data earlier.
  5. Hi @Demise , I am working on mailing my I693 sealed packet today, I got it from the civil surgeon yesterday. I am also planning on sending the following three documents with the I693: 1- Copy of the RFE for medicals (it was issued by uscis on may 22nd, it was delivered to my lawyer's old firm, they never sent it to me. I found out about RFE through congressional inquiry and not so politely informed at my lawyer. my lawyer had the old firm dig around and they found it in their scanned documents, finally emailed the scanned copy to me 2 days ago.) 2- A completed and printed AR11 updating my safe mailing address to my home address. (The safe mailing address on file with uscis since the case was filed and up until last week was my lawyer's old firm. The attorney sent a g28 a week ago updating the safe mailing address to her new firm, but I have lost all confidence and don't want her anywhere near my case. She has caused me a lot of headaches over the years. ) 3- A letter: explaining that delay in submission was due to the medicals RFE being lost by my attorney, also informing them that I am firing her (in formal and polite terms of course), and to please update my home address as my safe mailing address. I am planning to just put the RFE copy, AR 11 and letter together with a paper clip and put this all on top of the sealed I693 packet in the Fedex envelope. The posted deadline for submission of medicals was noted on the RFE to be august 18th, I do understand I have another 60 days extension so no worries sending after the posted last date on the RFE. I just felt its a good idea to let them know why I am submitting after the Aug 18 "deadline." Please let me know if you think this is all good or if I should do anything differently. Input from other forum members is also greatly appreciated, of course.

  7. Hello all, I am extremely grateful for all the ideas and support for my missing RFE situation. My ducking lawyer finally found the RFE today. It was delivered to her old firm, she changed her firm a year ago and never updated the address with USCIS. RFE is for medicals only, it was issued in ducking May 2022, three ducking months ago. Anyway I got medical exam done yesterday and will send the sealed packet when doc gives it to me on Friday or Monday. This group is worth its weight in platinum. I bow down to everyone who contributes and keeps this place alive and thriving.
  8. So did they re-send it to her or did they send it to the Congressperson's office? How did they send it - snail mail / email / fax? And how long did it take from congressperson sending the request to USCIS to obtaining the RFE? I contacted a congressman's office today and they will send the request to USCIS tomorrow. They said there was no guarantee USCIS will send it to their office electronically (email/fax) and it could take as long as 6 weeks for a response. I am worried about time due to the deadline issue. RFE was issued on 5/24/22 and although @Demise assured me there was time to respond, I want to avoid any further delay. And of course I am tired of waiting for my GC.
  9. Hi @Demise , I am stuck regarding this RFE that was lost somewhere. If you recall, my VAWA was approved in Nov 2021, and my I485 is pending, its in St. Louis field office since Feb. My lawyer got a I693 deficiency notice in Feb 2022 that they never told me about till last week. Senator Durbin's office sent congressional inquiry on I485 last month, and USCIS responded last week that they sent an RFE on 5/24/22. I am assuming its for medicals, since that was the only missing info in I485 packet. My attorney's office is my safe mailing address on the I485, but they say they did not get the RFE. I didn't get anything in the mail either. I check mail daily. USCIS online portal doesn't have any update on RFE being sent either. I suspect the attorney has some mail issues resulting in the lost RFE, but I don't have any way to tell for sure. Attorney suggested that I request Senator Durbin's office to have USCIS fax a copy of RFE to them, but Durbin's staff refused to do this. They say this type of request is "outside their purview" and that they can only send "an inquiry regarding non-receipt of RFE", which I assume will take another 30 to 45 days before its answered by USCIS. I am running against the clock. I scheduled an immigration medical exam for tomorrow, but obviously can't send it without the RFE. Do you have any ideas on the optimal course of action here? How do I get a hold of this RFE in a timely fashion? Any others in the forum please chime in if you have had similar experiences or have ideas. Thank you.
  10. Thanks a ton, lifesaver. I was getting anxious as I could only see 84 days deadline on USCIS. Can you please send a link to the RFE response deadline rule you quoted? Of course there is no case update on my I485 about the RFE, because why would they? Its not as if they give a duck. Advice to all in the forum who are waiting: once your VAWA is approved, please bug uscis via infopass or congressional inquiry every 30 days for info. Keeps them on their toes, and you get updates - did file reach field office/ NBC, did they issue RFE for medical or not, is interview notice sent, etc. They wont post these updates on online portal, because its USCIS. You may or may not receive notices in the mail, and they wont give you tracking numbers for anything except green cards and EAD. Your attorney may be incompetent / careless / malicious enough to miss documents send to their address. Please advocate for yourself. You don't want to be in a place like me with an RFE that was issued three ducking months ago and I get to know about it now. I am furious with myself and my attorney. I used to check every 2-3 months with senator. I guess that is not frequent enough.
  11. Question for you, @Demise i learned from senator's office yesterday that RFE on I485 was sent on may 24th, which my attorney says she has not received. VAWA was approved in Nov 2021. I requested senators office to get a copy of my RFE, I presume this is a medicals RFE as that's the only thing that was not sent when I filed I485 in feb 2020. Am I on the right track? Is there anything else I need to do here? What's the deadline for RFE?
  12. Hi @RKE hearty congratulations. A Few questions: - name and firm of your attorney for the mandamus? - how much did the mandamus cost? - when did you submit medicals? meaning with I485 or later? I am asking as @Demise said i485 might be denied if mandamus was filed without sending medicals first.
  13. @Rhema1 is correct, they wont update you of transfer to NBC and then to Local office. I got to know my I485 case was transferred in March through congressional inquiry. If you are not in a hurry and have a work permit, just wait for 6 months after vawa approval and then resume congressional inquiry / out of normal processing time inquiry if you dont hear anything by then.
  14. Thanks, @Demise. Always happy to hear from you. My I485 is already in St. Louis field office. VAWA I360 was approved in Nov 2021 and I was notified via congressional inquiry in march 2022 that the case is awaiting interview scheduling in St. Louis field office.
  15. Hi all, I just submitted out of normal processing time request online for my I485 ( I485 petition filed in feb 2020, VAWA approved nov 2021). The online case system didn't let me submit until I chose the "I485 - other" category for my service request. So when filling I485 form they list the categories for qualifying for Green card, and VAWA is listed under family based I485 category on the I485 form. But apparently that is not the case when filing the "out of normal processing time inquiry", I tried to file the service request under "I485- family based" category but the system would not let me do that. Hence I wanted to inform everyone, in case anyone's I485 is out of normal processing times posted by uscis and they want to submit an out of normal processing time service request. Also FYI, my ex never submitted I130, my I485 was submitted a few months after I sent I360 petition, and I selected the VAWA box in the I485. maybe that has something to do with the service request issue. I know of others on the forum who were able to send service request using the "I485 family based" category for the service request.
  16. I check case status daily, no RFE update. I check with attorney every couple of weeks as well, no medical RFE / medical deficiency letter / interview letter so far. Current / most recent status update on I485 (checked just now): ------------------------------------------------- October 21, 2020 Case Was Updated To Show Fingerprints Were Taken ---------------------------------------------------- Plan is to wait till November to give the slowpokes a solid year to adjudicate I485, then will send medical without RFE and file mandamus if no response by November. In the interim I bug them every three months through senator's office.
  17. I sent congressional inquiry in Feb 2022, they confirmed in March 2022 that I485 file is in local office (St. Louis). No word since then. Sent another congressional inquiry in July 2022, no response to that yet. VAWA I360 approved in Nov 2021.
  18. I am really happy for you, @BollyB. Lot less heartache and drama for you than others in the waiting game. I wish you get the green card soon as well. Hopefully this is a trend of VSC processing VAWA cases faster, and not just an isolated incident. Really wish there was a way to make things more transparent in USCIS systemwide.

  20. Yes. I know of other forum members who have had C9 and C31 EAD cards concurrently. Hopefully with processing times decreasing, two years EAD validity, and automatic 540 days extension with filing for renewal before expiration of current EADs, people would not need to do this kind of redundant duplication.
  21. Hi All, bit of good news today, just got case status update that my C9 EAD renewal was approved. C9 EAD expired in June 2021. Submitted EAD and AP renewal petition in Feb 2021, they took 17 months to process. I had submitted out of normal processing time request three weeks ago through the online route, of course I didn't get any answer but the update today implies that it was probably useful, I think. Just wanted to mention in case its helpful to some of you. There is no new update on the I131 status yet, but I am hoping that this is a combo card valid for two years so I don't have to go begging after the esteemed USCIS folks again until I get the green card. My C31 EAD expires in November 2022, I might send renewal request for this before expiration, just in case.
  22. medicals RFE means interview will be waived. you will get decision on i485 within 2-3 weeks of submitting RFE usually. I am so jealous!
