  1. Visa Update: Consular Operations (Visas) as of June 2021

Visa Update: Consular Operations (Visas) as of June 2021

Routine visa services remain suspended because of the COVID-19 pandemic.  The U.S. Embassy in the Philippines continues to operate with reduced staffing.

As conditions surrounding the COVID-19 situation improve, the Embassy will add additional services, culminating eventually in a complete resumption of routine visa services.  The Embassy cannot predict when the resumption of full visa services, or a specific category of visa classes, will occur.

Immigrant Visa (IV): The Embassy continues to have a significant backlog of all categories of immigrant visas.  We are using a tiered approach to triage immigrant visa applications, based on the category of immigrant visa, as we resume and expand processing.  While we are scheduling limited appointments within all four priority tiers every month, the following lists the main categories of immigrant visas in priority order:

    • Tier One: Immediate relative intercountry adoption visas, age-out cases (cases where the applicant will soon no longer qualify due to their age), and certain Special Immigrant Visas (SQ and SI for Afghan and Iraqi nationals working with the U.S. government).
    • Tier Two: Immediate relative visas; fiancé(e) visas; and returning resident visas.
    • Tier Three: Family preference immigrant visas and SE Special Immigrant Visas for certain employees of the U.S. government abroad.
    • Tier Four: All other immigrant visas, including employment preference and diversity visas.

Nonimmigrant Visa (NIV):   The Embassy continues to prioritize travelers with travel needs, foreign diplomats, and certain mission-critical categories of travelers, such as those coming to assist with the U.S. response to the pandemic, followed by students and exchange visitors (F-1, M-1, and J-1) and temporary employment visas (H-1B, H-2B, and L nonimmigrants).  Visa appointments and processing for B1/B2 (Business/Tourist) remain suspended, with the exception of interview waiver renewals.

We understand that many visa applicants have paid the visa application processing fee and are still waiting to schedule a visa appointment.  The Embassy will extend the validity of your payment (known as the MRV fee) until September 30, 2022, to allow all applicants who were unable to schedule a visa appointment as a result of the suspension of routine consular operations an opportunity to schedule and/or attend a visa appointment with the already paid fee.

Visa Scheduling:  After we resume visa processing, which will be confirmed on our website at https://ph.usembassy.gov/visas/visa-updates, applicants can reschedule the first available visa interview appointment slot by phone at (+632) 7792-8988 or (+632) 8548-8223, or through our online appointment system at http://cdn.ustraveldocs.com/ph/.  There is no fee to change an appointment.  After routine visa processing resumes, if you have difficulties rescheduling a pending consular appointment, applicants may send an email to supportphilippines@ustraveldocs.com for specific guidance.

No. Immediate relative is only spouse, unmarried children under 21, or a parent of a US citizen.

The “family based immigration“ categories that have F-numbers such as F4 are not included.

Ohh I see. I hope they resume visa processing for family based as well. Thank you for your replies!! ❤️:)

  3. Good Day everyone!

US embassy here in the Philippines just posted an update about their operations regarding visas.

The Embassy is currently processing limited numbers and they included in the immigrant visa:

    • Interviews for Immediate Relative family members of U.S. citizens, including intercountry adoptions: IR-1, CR-1, IR-2, CR-2, IR-3, IH-3, IR-4, IH-4, and IR-5.

I wanted to ask if "Immediate Relative family members" and family based immigration are just the same?

Does it include F4? Thank you!!

  4. Good Day everyone!

    Priority date: June 2, 2000

Became current on the visa bulletin: May 1, 2020

    I turned 21 years old last July 3, 2020.

The petitioner emailed NVC about it and they said that I am eligible for CSPA (because I was still under 21 in May 2020) It will just depend on the consul during interview.

I read something here that I'd be protected as long as I submit a DS260 within a year after being current on the visa bulletin.

I submitted a DS260 last April 29, 2020. Became documentarily qualified last December 2020 and right now, we're just waiting for the interview date.

I'm just wondering because of all the backlogs and delays, what will happen after a year of submitting DS260?

Does that mean I might be considered aged out in April 2021 since it's already been a year when I submitted a DS260?

    Thank you!

Not yet but the heads of the relevant agencies are required to eventually issue revised guidance as to the enforcement of INA §213A in light of section 1 of Biden's Feb. 2 Executive Order.

That is not currently needed because of a court ordered preliminary injunction: https://travel.state.gov/content/travel/en/News/visas-news/update-on-public-charge.html "Applicants are not required to complete nor should they present the DS-5540, Public Charge Questionnaire."

    Thank you! ❤️

  6. Good Day everyone!

I just want to share some updates from our immigration process. This might give ideas to other applicants as well. :)

Priority Date - June 2, 2000; became current on visa bulletin last May 1, 2020

February 28, 2020 - Received an email from NVC (Notice of Immigrant Visa Case Creation)

*Started working on DS-260 and completing the required documents*

    April 27, 2020 - Completed and submitted the DS-260

September 11, 2020 - Received an email from NVC again telling us to resubmit our police clearance (We submitted police certificates only, they were asking for NBI clearance).

September 11, 2020 - Same day, we uploaded the correct documents they were asking for.

December 8, 2020 - Received an email from NVC again (Notice regarding your Immigrant Visa Case becoming Documentarily Qualified🤍

It has been 10 long months of waiting to be documentarily qualified.

I was also overthinking for the first few months because of aging out (I turned 21 last July 2020). I posted here a topic about me being aged out.

I would like to thank those people who replied to my topic. You gave me clarity about how CSPA works. :)

Regarding the topic of me being aged out, I'd also like to share that the petitioner emailed NVC about it and they replied this:

    "Dear Sir/Madam:

We reviewed your petition and we determined that the applicant appears to be eligible for the Child Status Protection Act (CSPA) benefit.

Please note that our determination is not final. A consular officer makes the final determination at the applicant's interview."

As of now, we are waiting for the schedule of our interview.

I hope we receive an interview appointment early next year and be accepted by the consular officer considering my case. *crossed fingers*

We are praying that the immigration ban won't be extended anymore. Praying for the best!

This post is kinda long but I hope you somehow had an idea about f4 immigration process.

Any comments/opinions will be much appreciated! Keep safe! ❤️❤️❤️

  7. Good Day everyone! I want to ask for your opinion regarding our situation right now.

We received an email from NVC last JULY 7, 2020:

The National Visa Center (NVC) updated the status of your immigrant visa application. Please go to the Department of State's Consular Electronic Application Center (CEAC) at https://nvc.state.gov/ceac. You will need your NVC case number and invoice ID number to log into your account.

Once you have logged into CEAC, please look in your message box or on the Status Chart at the bottom of the page. If NVC has feedback on any items you submitted, there will be a new message with details. If not, please simply follow the updated instructions on your Status Chart to complete your case. If any column says "Pay Now", "Invalid Doc", "Incomplete", or "Re-Opened", that means you must take action by paying a fee, submitting a form, or uploading a corrected/missing document.

    Regards,
    National Visa Center,
    U.S. Department of State
    https://nvc.state.gov/ask

But when I opened our CEAC account, the inbox is empty. And the status chart still has not changed, it says there "Submitted".

It has been 45 days and there is still no update or anything in our CEAC inbox.

Another one, when I opened our CEAC account, this appears in the link above:

    1440000658_2020-08-21(2)_LI.jpg.0bea70ab9fe9631c947a8e73ddc19ab9.jpg

I don't know if it's related to us not receiving any messages in our CEAC account because I just noticed it earlier. What do you think? Any comments would be highly appreciated.

    Thank you!! ❤️

I opened our account in CEAC but there is still no message there and the Status Chart did not change. It's been 6 days. :(

Based from what I've read before, it's not that long to wait for the message in CEAC after receiving an email from NVC.

    Should we contact them?

Hello everyone! Just an update, the petitioner contacted the NVC already through email telling them that we still don't have an update in CEAC inbox and this is their reply:

The documents you submitted are being reviewed. For current processing times, please visit our website at https://nvc.state.gov/submit (English) or https://nvc.state.gov/submit/espanol (Spanish). NVC will let you know if we need additional information or able to schedule your case for an interview.

If you need to correct or re-submit a document, we will send you an email letting you know you have a detailed message in your CEAC account.  Return to https://ceac.state.gov/iv and click on the "View Messages" button to the right to read feedback and instructions from NVC.  You should also refer to the Civil Document tab or Affidavit of Support Documents and Financial Evidence tab to review any documents that are missing or need to be deleted and re-submitted.

You can also check the status of the items you submitted and your case in general in your CEAC account.

I was just confused  because why did they send us an email saying that they have already updated the status of our immigrant visa application when in fact it was still in NVC being reviewed?

I also checked the NVC timeframes and they are already reviewing documents submitted to them on May 8, 2020.

We submitted the documents last April 27, 2020. And until now, CEAC inbox has still no message. 😕

The only people who need to be under 21 when they actually enter the US are K2. For the very last time, your age was locked when your visa became available. If you don’t believe all of us who are telling you this please look up CSPA USCIS and read it for yourself.  It gets tiresome repeating the same thing constantly.

OHHH I SEE. I understand everything now.

I am sorry if I annoyed you with me repeating the same situation and questions. I really cant help but overthink like literally everything because I turned 21. :(

but you really are a great help!! I was really worried to the point that I think about this everyday. I apologize for being repetitive.

I promise I am now enlightened by this.

Thank you so much for replying. You are a big help. Stay safe ❤️

Did you ask the petitioner or the main beneficiary who may have the i130 approval letter for the approved date?

Yes. He (the petitioner) also tried to find in his email the notice of NVC but he wasn't able to find it. So he already forgot the approval date.

On 7/15/2020 at 9:21 PM, SusieQQQ said:

If you became current in May you don’t need to worry because you were actually under 21 then anyway. Your age freezes when a visa becomes available (=priority date is current) as long as you seek to apply (submit ds260) within one year of that date.

To be honest, I am hopeful because of what you said. Yes I was under 21 when the visa became available.

I'm just afraid that on the day of the interview they will compute for my age and they might say I aged out. In the end, I'll be denied and will be left here in the Philippines.

I'm worried because from what I have read, someone who will migrate to US should enter the country before turning 21. Is that true?

  11. Hello everyone! Hope you're doing fine.

I am a derivative beneficiary under F4 petition and I recently turned 21 years old last JULY 3, 2020.

Our priority date is JUNE 2, 2000 and it became current last MAY 1, 2020 in the visa bulletin.

I am worried I cannot compute my CSPA age because we already forgot the approval date of our petition (Form I-130).

    What should I do?

Any thoughts would be highly appreciated! Thank you!

    Hello all,

I've gotten great help from everyone here, so I want to share my interview experience, in hope that it helps somewhat to those of you waiting.

    Location: Skopje, Macedonia

We picked up our medical results at 7AM from the hospital, and went to the embassy at 8AM for our interview. We were the first in the list to be called, so we walked in to an empty embassy interview hall. A nice guy helped us arrange all of our documents, and soon after 10 minutes, we got called to hand out the prepared documents. The guy took our fingerprints, and asked us if we have any valid visas. At this point I also saw that he has a CSPA worksheet for me, which had all the details of when the case was sent and approved, along with the last row, saying "QUALIFIES".

After being done here, we were seated again, and waited for the interview with the consul. We got called 10 minutes after, we approached the window, and we were asked to raise our right hand, and swear to tell the truth.

Then my mom was asked only 3 questions:

    1. Who's applying for your immigration petition?

    2. Where does he live?

    3. What does he do?

And the last question was for all of us (me, my mom and dad):

    4. Have you ever committed any crime?

After this, he said, thank you, your visas have been approved and we will call you within the next two weeks to pick them up. Have a good life in the US.

No one at any time mentioned anything about my age (i'm currently 24, about to be 25. But my CSPA age is 19). The only thing that i glimpsed was the CSPA Worksheet.

Everyone at the embassy was really warm and really made you feel like there were there to help you and not cause issues.

Overall, the best possible experience we could have hoped for.

Let me know if you have any questions.

    Thanks!

Hello! I would just like to ask if how are you able to be included in CSPA? Did you get a lawyer for it?

Your CSPA age is under 21.  Your real age was under 21 when the PD first became current, so it doesn't matter that you turned 21 afterwards.

Make sure you file the DS-260 within one year of your PD becoming current - file by May 1, 2021 - to lock your CSPA age in at under 21.

    Noted!

Thank you so much. All your replies mean A LOT to me!! I've been thinking about this for a while now since I already turned 21 while waiting for their email about our submitted documents.

I overthink a lot. Thank you again for explaining it to me!

  16. 1 hour ago, James120383 said:

your CSPA age is locked in during your immigration petition like I-130. It unlocks when the petition is approved until you file  DS-260. So between the approval of I-130 and DS-260 your days get added to the 21st CSPA age.

So your CSPA age calculation would be : age when I-130 was filed + days from May 1st to the day of filing DS-260 = your CSPA age. You also have up to 1 year from the day of visa availability to file  if you are under 21 as of May 1st

Thank you so much! Now I have to know first the date when the I-130 petition was approved since the petitioner forgot its date.

And yes, I am under 21 when the priority date became current. ☺️

I'm just worried because I turned 21 while waiting for an email from the NVC about our submitted documents.

I'm afraid. I don't want to be the only one left here in the Philippines :(

What is the petition approval date?

Haven't checked the current date but if it’s correct you should be protected anyway as you were under 21 in May, as long as you submit a ds260 within a year of that date.

I am kinda worried about the petition approval date because our petitioner forgot it and we don't know how to compute my age if ever I'll be included in CSPA.

I was enlightened by your explanation that I might be protected since I was under 21 when our priority date became current. It means a lot. Thank you so much

May I also ask, are we going to contact the NVC to know our petition approval date?

  18. Hello! I'm Den from the Philippines. This is my situation right now:

Our priority date is June 2, 2000, and it became current on the visa bulletin last May 1, 2020.

I turned 21 years old last July 3, 2020. And our case is currently at NVC, we are waiting for their email if there is feedback regarding the documents that we submitted online (CEAC).

I would just like to ask if anyone has an idea about my situation? Am I considered aged out or I can still be included in CSPA?
