    Everything else is like beating a dead horse at this point. Litigants in the Milligan case have gotten priority over everyone else just like ALL the mandamus cases Josh Goldstein  has done so far. Can you cite an example where they have not gotten a priority? Just because someone says something out of opinion, I wouldn't believe it as fact. Look at the facts to find your answer on this one. 🙂  They may not supposed to be able to get priority, but they do and they have in past practice. The judge only cares about the case in front of them.

    Yes, at the time I posted this, I called Philippine Airlines and was informed that I could go to the Philippine consulate and request a Tourist Visa, Vaccination required, once I have that I can book my flight.. No quarantine, however it would be subject to change.

     

    I have to ask, Are you associated with a law firm? I suspect that you and some others here are as well, otherwise why are you being so defensive? and why are you pushing so much negativity about Petitioners who don't join in the lawsuit?, It reads like YT videos from Immigration lawyers who push these same doom and gloom scenarios, suggesting; "If you don't acquire our services or join in our lawsuit, it could be years before you see your fiance",  Or as one wrote, "you wont be with your Fiance for Christmas"  LMAO.   

    I see a lot of Immigration attorney's on social media taking full advantage of Covid and the lock downs, just like they have with other tragedies of the past, They're the modern day version of Ambulance chasers, what remains unchanged is they'll never offer their clients a guaranty of success,  if their unsuccessful in the lawsuit, the Attorney's keep all the money you paid, and you're no further ahead than you were before you gave the money, just $2500 poorer.

     

     

     

     I'm going to help you out with a little dose of logic and reality for the sake of good will. The Embassy, even if they were to start resuming regular K1's like they have magically just stated DO NOT HAVE THE MANPOWER TO DO THEM. Do you think they are fully staffed just waiting to resume full capacity???? Are you seriously that naive and uninformed ?  I'm not trying to be nasty, but wholly cow dude. You are living in a fantasy world right now. And PH Air is now in charge of entry into the Philippines??? Please let us all know how that appointment at your local closed consulate goes for your tourist visa 🙂 The only people taking advantage of the covid lock downs are the US embassies. True story.  I don't have any issue at all that you have not joined the lawsuit but just be honest with yourself first and foremost. You are going to be waiting a long time, you seem ok with that and there is nothing wrong with your decision either, 🙂

    These are the top immigration lawyers in America. Relief comes via a writ of mandamus, that's what a mandamus suit was designed to do 🙂   Just to give everyone some background, they didn't want to take this suit at first, so it wasn't about the money. They wanted to make sure they could win the lawsuit and make sure they could get our cases expedited if we won. $2500 for mandamus suit is a steal. I checked with another lawyer before I joined who had no skin in the game and he said it was absolutely winnable.

    And I most definitely will be with my lovely Fiance for Christmas and for New Years,  regardless if she's here in the US or the Philippines, since Foreign travel into the Country is already opening up,  For $2500, I could book 2 round trips plane tickets and it would be a sure thing that I would be with her,  unlike rolling the dice with a group of greedy and opportunistic lawyers.

     

     

     

    Everything you said is completely false. Literally everything you said. Plaintiffs absolutely do get a priority, it's a mandamus lawsuit, did you know that? (educate yourself on mandamus)  May 2020 is not a 2 month backlog once the embassy opens to regular K1's. They will not open to full capacity in the next year at the soonest (please read the news, either CNN or Fox will do for this topic) So that 2 months is more like 8 months to a year or more at best, and that's once they re open, whenever that is . Lastly, foreign travel is opening up in the Philippines????  Yeah ok, with covid spiking there and a president using it for a power trip? They have had the longest lockdown of any country and now the are going to open up????? Because you think they will???? Sorry man, you didn't join and you have a bunch of excuses telling yourself why. Unfortunately they are all a false narrative you have made up to make yourself feel ok with making a terrible decision. But hey, if that helps you sleep and night, that alright. 🙂

    Meantime, please read some of the comments in this existing thread and how some recent tourists from the Philippines were asked for CFOs by PH immigration officers, but successfully departed the Philippines without CFO certificates, because they knew the policy, they stood their ground and told the PH immigration officers that CFOs were NOT needed for tourism.

    Like others have said, petitions and visas are not at all the same.

    You realize PH has an insanely tough immigration at the airport for tourists to leave the country, right? They offload an average of 50 passengers a day and some for no legit reason. A NOA2 is an official document why would I not bring it??????? A tourist CFO is an official document, why would I not get one??????

    We need to show IO at the Manila airport proof of a serious relationship. And approved petition shows exactly that 🙂 They need pictures and proof of conversations also EVERYTHING you can bring helps. IO gets suspicious and she will get offloaded. I'm trying to get the CFO tourist certificate as more documentation.

    We filled out a massive application form, paid 535 usd......got approved to the last step. I would think that would significantly lower her as a flight risk, right? It shows I am not some random guy that put a ring on her finger for possibly sex trafficking.....hopefully. An official document is an official document right?

    If she is asked about it, she has no choice but to be truthful. Don't even think about lying. It will only come back to haunt you later in this immigration process. You don't need to volunteer any information that is not asked for.

    Please ask your source who got offloaded to send photos/links/PH government announcements of this tourist CFO certificate. Please also cross-check your source to see if they had any of the red flags I mentioned in one of my previous posts (no history of travel, no strong ties to PH, etc).

    @Marek50 there's a fair bit of luck involved. Much will depend on how she presents herself and how prepared she is (those things you can both control), and which immigration officer she faces on the day of your travel (out of your control). 

     

    Crazy question, our Dubai visa is good for 60 days and we try again in a few weeks to get through immigration if she gets offloaded?

    For the tourist certificate, it's just a phone interview and the submitting requested documents. Usually they send the weblink after, but the officer wants to talk to my fiance first.....or tell her she is denied

    You have a chance, but both you and your fiancée need to learn more about the process. Do not mislead people, including CFO staff and immigration officers, by saying you have an approved K1 when in fact, you only have an approved petition.

     

    Your fiancée will need to prepare herself to answer confidently and honestly to any questions about her intent to return to the PH after her Dubai trip.

     

     

    Thanks, I sent the CFO officer my NOA2 so I'm sure she understood my confusion, and we let her know we were just looking for a tourist certificate 🙂

    My fiance is also bringing her 18 month old son which could be good or disastrous depending on who I ask 😞

    Sorry, an approved  I797 petition waiting for embassy approval, which is our excuse for seeing each other. I would think this would at least mean something to them, right? If I had an approved K1 she would be leaving to America and not touring in Dubai 🙂

    It may be worth fact checking those people who said they were offloaded: 

     

    - Have they ever travelled abroad before?

    - Have they ever been issued visas that are relatively hard to get? Ex. US, Schengen, UK, etc.

    - Did they bring proof of strong ties to the PH, such as a letter of employment, property?

    - Did they bring proof of financial capacity to pay for their trip, such as bank and credit card statements?

    - Did they research the CFO requirements and answer the immigration officer confidently, that they do NOT need CFO for tourism? If they actually had previous travels abroad, they should already know this is NOT needed at all.

     

     

     

     

    It's her first time traveling abroad, we are trying to meet in Dubai. I have a letter of Intent and a Letter of support for her notarized along with our K1 visa approval and pictures and my bank statements and even tax returns. She is currently not working.
