    Thank you! My timeline is below:

     

    Aug 2019 filed I485

    Sept 2020 filed I360

    Oct 2020 Interview and asking to hold I485 in abeyance 

    Sept 2022 I360 approved 

    Sept 2023 I485 denied 

    Oct 2023 I485 appeal filed (form I290B)

    March 2024 I485 approved 

     

    I was denied based on an unbelievable mistake by the cis. They just didn’t look up that I have i360 approved and proceeded on adjudicating I130. I filed and appeal instead of the new application because I didn’t want to go to a traumatizing interview again and within 6 months they appealed the decision.

    Just read instructions, you should have asked USCIS to convert I-485 within 30 days of filing for WAVA. Did you do that?

    Yes, I told them to hold it at my interview and I already had my VAWA receipt.

    I485 Petition was denied a month ago. The i130 was denied 2 years ago

    Yes I did! It’s been received and no more update. Been 18 days.

Me and ex wife were divorced and My lawyer told me that she went to interview herself and talked w the officer and got promised that they will hold it.     I think we have very different cases - my timeline and chronology are very different, I first filed VAWA then got interviewed, and I had no lawyer attending it. And you’re assuming so many things about your case that you just don’t know. Not sure why you would go to another interview, just get your approval first and go from there, especially that you have your AP and EAD the wait is not terrible

What I always tell them is that I wanted to go submit documents that I think the officer didn’t receive even though the post office showed delivered, and they always give me infopass

    Hm do you call and tell them that or you tell them that already at the spot? I could never manage to go past my receipt number and they say they don’t have access to my file. Also, do you think going to infopass in NYC would be okay if my case was rejected out of Miami? Thanks

    The only way he can ask for reconsideration was if he filed for VAWA prior to October 2020 date and his receipt reflects that date. 
     

    Furthermore. USCIS does not have to hold your I-485. There is no requirement to do so. The IO adjudicated it appropriately. 
     

    You are going to spend money and resources for your reconsideration to be denied in another year. 

    Got it, thank you! I actually did file i360 prior to my immigration interview but I see the potential struggle to reopen the case.

    I think make an infopass appointment and take with you your i360 approval notice and i485 receipts. They may fix your issue without a motion to reconsider or to reopen. And also get your i290b motion to reconsider ready. If they say file a i290b after your infopass, go ahead and file it. But go to your local office first 

    I’m also not able to schedule the infopass because my application is under VAWA and all they tell me to do is to call Vermont..

    just file another I-485 with medical. 

    I literally brought my filed VAWA package to my hold in abeyance interview lol but maybe you’re right to file a new application it’s just I don’t want to go back of the line again

    That's what I thought too although them saying that I confirmed that the application was correct made me a little scared in the first paragraph.

     

    If that interpretation is correct (that they are unaware of my i360 approval) is it better to motion to reopen with the evidence or file a new i485 petition? Hoping for whatever is faster and more likely to be approved. Field office for new application is NYC, this rejection is coming from Miami field office (I used to live there) @Sandra G. I only have 2 days to respond if I were to reopen.

    I think they still represent me, although I would love to get rid of them but don’t want any more delays with USCIS. They have moved offices and mail is being sent to the old address. But I’ve stayed on top of my personal address changes through AR-11 and e-requested the missing mail to be sent to my address.
