Consular officer asked her all of 5 or 6 questions, took the police certs, marriage cert, and birth cert. Told her everything was good and that she was approved.     I went to the CEAC site, and it says the application is refused. W.t.f.! 

     

    Need some help here. She is 7 months pregnant, and we need to get her to the USA ASAP

    It is completely normal proceedings, just go with what the Officer told you ;)

    Most people pay before entering the US.

    Don't you have to pay once you receive the visa only ?

    Why dont you just take his word for it?...he said in 7-10days you get your passport with the visa sticker in it....Admin process is needed to cross all the t/s and dot all the i's ....so just relax...if its day 20 and you dont have your passport back with visa then we know you in the "bad admin'

    I am in the same situation, I had my interview on the 20th of July, and yesterday (23rd) I saw that my status was "ADMINISTRATIVE PROCESSING". The Consular Officer told me that I was approved, but often there is miscommunication between the doctor's office and the embassy for the transfer of the medical results, and that is why you have to wait several days before seing "ISSUED" on the CEAC tracker. That is the case for me (my medical results are normal by the way), so it might be the case for you as well. It's just bureaucracy ...

    yes they just updated it today to ISSUED. I am very happy about it but I just have to wait a lot since they apparently send it every Thursday I believe...is it correct you think ?

    Every case goes through AP......and visas are not actually approved until AFTER AP....not before......regardless of what the officer said.  Watch for the status to change to "Issued".  That will be the real indicator of approval.  You should see that change soon.

  5. Hey Everyone,

    I had my interview for CR-1 visa the morning of 23rd of July 2020 at the US Embassy in Paris. Consular Officer told me my visa was approved and I will receive my passport in 7 to 10 business days with the visa stamp.

    I just checked CEAC and it now says "Administrative Processing". I've read a lot of horrible stories about administrative processing with people being stuck for weeks and even months on end without any reason being given.

    I'm wondering if a few days of "administrative processing" is the case for every visa and the CEAC will switched to issued in a few days? or should I brace for some possibly longer delays??

    Would love to hear from other people in Paris and other embassies!

    If the document is already in French and you are interviewing in Paris, no translation is needed.

     

    If the document is Chinese, for example, it must be translated by an official Notary (a Chinese Government Agency) to be accepted.

     

    So, in which language is the document(s) now?

    Thanks man, that's what I found so far yes, they seem content with this. Another question though: in French institution, papers are declared to be valid only if they are 3 month old maximum (older is not considered good). But As I plan to bring documents from the time I filed with NVC to the interview, will they hold that against me as a problem ? I do not have the time to order new certificates and other things, my interview is the 15th of July 2020...

    I need to bring English translation of some documents to the embassy in Paris for my interview. Do you know what certified translation means for them ? Can anyone fluent in English and French translate it for me with a statement that this person translated to the best of its knowledge ? Or do I have to contact a certified translator by the court of Justice ?

    Under the same circumstances my French husband was forced to do AOS from the United States. We did not want to take a risk of him traveling to France in the pandemic to finish his Consular Processing nor did he want to overstay his ESTA.

    Be careful not to overstay your tourist visa.

    My interview has already been rescheduled as an expedite in order for me to try to do the travel and suddenly the numbers about coronavirus rose again... I just hope I can do the whole travel then. Thank you ;)

  12. Hi everyone, 

     

    I am actually at the last step of my immigration process through a CR1 visa, the interview at the consulate of US in Paris, FRANCE (consular processing). The problem is that I am at the moment in the United States under a tourist visa to spend time with my wife and kids during this crisis. My interview is scheduled for the 15th of July 2020 but I do not know if it is gonna be possible for me to even get out of the US to go to France do my interview. Also, even if I succeed doing this, I am not sure I can even come back on the US territory without problems. 

     

    Do you think it is possible to request my interview to be here in the US due to the coronavirus and the risks I am exposing my family to ? If yes, I am suppose to re-enter US under the CR1 visa to then get my green card (last and final step), how do you think will that turn out to be ? 

     

    I hope I made myself clear enough in this weird situation,

    Whatever the case, I wish you and your wife good luck and should you find yourself at the border and things are going sour, ask if you can voluntarily withdraw your application for admission. It will save you an entry ban.

    Either way, as it stands now, spouses of USC are exempted from the ban. 

     

    You can always ask, I haven't heard of a case in which they expedited a case but perhaps other members here on VJ have heard of such a case. You'd ask for such thing by calling USCIS or the NVC directly (I believe they give you a direct number to call in one of the NOAs).  

     

    No, there's no such provision available and overstaying may cause issues when you try to enter on a tourist visa/VWP the next time.

    If you're hell-bent on staying in the US then you can file for AOS from within the US, if you add the NOA of your I-130 you don't have to refile that one. Keep in mind though that this brings extra costs with it and you wouldn't be able to leave the country and work for about 6 months (although getting an EAD and AP can be expedited, there are established ways of expediting these). There are some other practical downsides to adjusting from within the US (e.g. collecting necessary documents, tying up life overseas etc.) but only you can determine how practical that is.

    Alright sounds like I have to make a choice, I think leaving the country around mid April and returning before the birth could be possible. That if I do not catch this virus and they put me in quarantine and if the CBP lets me pass the border again. But there is not much other option anyway I believe. unless they indeed expedite my case.

    Expedite requests are free, no harm in trying, so I would suggest that you contact NVC and ask.  Be prepared to submit documents justifying an expedite.  If approved, all they'll do is send your file to the embassy in Paris a little sooner, and schedule your interview there for a few weeks later.  Your interview will be in Paris so you'll have to go back for that, then if approved, re-enter the US with your spousal visa.  Good luck!

    Oh thanks and where do I find the instructions on how to file a request for expedite ?

  16. Hi,

     

    As you all guys probably heard recently, Trump closed access to USA territory from every traveler coming from Europe (shengen space only I believe) because of the coronavirus.

     

    Here is my situation: I am french and visiting my wife under a tourist visa while waiting for CR1 visa process to schedule our interview to the embassy of USA in Paris, France. We did a consular processing and submitted all the documents to the NVC on the 27th of february 2020. 

     

    The tricky thing is that we are pregnant and expecting the birth for May 12th 2020 but my tourist visa duration of stay ends on the 30th of April 2020. Since I cannot return to France or I wont be accepted back in the US for the birth, do you think I can ask for the national visa center to make an expedite request with our case ? Or would they let me stay in the US in order to attend the birth of our baby and not risk the spread of this COVID-19 ?

    Is it advised to send all this though ? the website of NVC seems to say that only if needed you should send all those, but the IRS transcript shouldn't be enough ?
