  1. UPDATE:

    Manila did know he had 40 arrests, spent time in prison and is a drug addict. They simply asked if she knew about this and was OK with it. She did not know about the drugs or booze. My impression is that she simply wanted to come to the States bad enough to put up with this and got in over her head. We are trying to get more info on this guy so we can take action on her behalf.

  2. I am unsure if his criminal record was disclosed to USCIS, I understand she knew but supposedly he was a reformed man of Ya, She believed him. She did not know he is a drunk. He also appears to be very controlling. One thing, she has no airline ticket back. He either got by with a one way or cashed in the return trip. She appears too afraid to take action. We have told he we have a number she can call for help. 

  3. My wife met a lady in Manila at her immigrant seminar, She was a K 1 visa immigrant applicant. Both are in Oregon. Later, after her arrival, she discovered he is not the man of her dreams. He is an alcoholic and a mean vicious drunk. As far as we know, so far only verbally abusive. She did not want to get married but to go home. He convinced her she had to marry because they had a pre ceremony  wing vow. Now we find out extensive criminal record. She seems afraid to ask for help. Is this something I should contact USCIS  about

    Overview - What Is a K-3 Visa?

     

    The K-3 nonimmigrant visa is for the foreign-citizen spouse of a United States (U.S.) citizen. This visa category is intended to shorten the physical separation between the foreign-citizen and U.S. citizen spouses by having the option to obtain a nonimmigrant K-3 visa overseas and enter the United States to await approval of the immigrant visa petition.  K-3 visa recipients subsequently apply to adjust status to a permanent resident (LPR) with the Department of Homeland Security (DHS), U.S. Citizenship and Immigration Services (USCIS) upon approval of the petition. Because the spouse of a U.S. citizen applying for a nonimmigrant K-3 visa must have a immigrant visa petition filed on his or her behalf by his or her U.S. citizen spouse and pending approval, a K-3 applicant must meet some of the requirements of an immigrant visa. It should be noted that under U.S. immigration law, a foreign citizen who marries a U.S. citizen outside the U.S. must apply for the K-3 visa in the country where the marriage took place.     Eligible children of K-3 visa applicants receive K-4 visas. Both K-3 and the K-4 visas allow their recipients to stay in the United States while immigrant visa petitions are pending approval by USCIS.

     

    What is a "Spouse"?

     

    spouse is a legally wedded husband or wife. Same-sex spouses of U.S. citizens and Lawful Permanent Residents, along with their minor children, are now eligible for the same immigration benefits as opposite-sex spouses.

    • Merely living together does not qualify a marriage for immigration.
    • Common-law spouses may qualify as spouses for immigration purposes depending on the laws of the country where the common-law marriage occurs.
    • In cases of polygamy, only the first spouse may qualify as a spouse for immigration.

    When did you file the I-129F for the K1? When did you get married? 

    As you have asked for expedite what were your reasons? 

    Did you file another I-129F after the I-130 was submitted... 

     

    Hey Slumdog. I am also OR. I filed my I 129F in Aug 2019. It was in the Manila embassy ready to go in March 2020. Covid hit and things froze. We never even got an interview letter. it stayed in Manila till we got married in May of 2021. We then filed an I 130. According to USCIS if the I 129F is approved before the I 130 it is treated as a K 3. The only difference is that the K 3 wife can come to the States while it is being processed. However I have been waiting for approval of an expedite request. But my I 130  processing was started in Sept 2021.
