If you applying under the 3 year rule and are  in  a valid state of matrimony, you are not required to be in the physical presence of each other 24 hours a day each day.  Or even one second per day, each day.

Can you pls expanciate more on this. Since I entered as IR1 and still married. I only need to go to school full time for 2-4 years in a different state. Which I plan to at least come home 1-2 times monthly. Will that endanger my naturalization approval?

  2. Hi Everyone I need advise. It’s been 6months been in the US via an IR1 visa. My current state of residency don’t have the degree programme I plan to pursue. In other to do that I have to school in a different state for a 2-4year duration. My wife’s job doesn’t permit her to move with me for the duration, I would be the only one always coming back to my state of residence monthly to see my wife and I won’t have an income coming in since I would be schooling.  My question is if I decide to go that route what happens when I apply for Naturalization in 2years and some months? Is there anyway to navigate this?

Good day house I'm scheduled for interview December 17 but I got an email from our immigration attorney that we should suspend the interview due to Trump ban on Nigeria. Is that advisable because we've been on this journey going to two years now

There’s a WhatsApp group for you to join. Do not suspend your interview! People are been issued Visa’s despite the ban.

  4. Currently at the NVC stage. We got a reply from NVC saying my wife doesn’t meet the requirements to bring me the the states. She has been working since 2017 and this particular Job doesn’t require her to file taxes. She makes. $58k yearly. Now our lawyer wants her to file for  co-sponsor, when I know the minimum income to bring me there is $21,550k which she makes  way more than. Before this feed back from NVC we explained and notarized a document stating why she doesn’t file taxes. Sent her monthly payments . I am shocked at the moment . Because, just lawyer fees alone are soo expensive.. any advice please????

Yes the original copies. I would advice you go with your tax clearance too you never know. Depend on the CO doing the interview you never can tell what they would ask for so please go with yours. But the once I mentioned are the priority cos most of the questions are going to be base on the petitioner and mind you don't staple your affidavit of support.

How can one get the original copies to the interview? Can she scan the colored copies or mail down the actual copies via DHL?

    Hi fam,

please I need your advice/opinion/ Experience on this issue.

I was pregnant when my husband started filling process, hubby was still LRP then, and when I gave birth, case was still with USCIS and he called to notify them and they told us he doesn’t need to fill another form I-130 for our baby, that when we get to NVC stage we should include her name, And we relaxed. In btw this period, hubby became citizen. Fast  forward to when we got to NVC stage, we included her name when fill out ds-260 as said, and she was placed under review, but they approved mine and asked me to pay for further processing. The day we got dq’ed was the day they cancelled her application that there is no derivative visa for her, we should go and start her own case afresh, hubby had to call them back on what we should do, cos that time we were only waiting for interview date, they told us that she would be the principal applicant beneficiary at the time of interview. Truly, when they sent interview appointment letter, she was added as beneficiaries to attend the interview, but due to pandemic we were not able to attend the interview. Now my question is this, do you guys think she will be granted visa, hope consular won’t put me in Ap cos of this and ask me to start her own afresh, seriously it baffles me a lot.
    Thank you.

note: we were asked  to provide more evidence before our case was approved with USCIS, so hubby had to provide his naturalization certificate, our baby’s birthday certificate, pictures and all that. Not too long our case got approved and upgraded to CR1

I think you should seek the opinion of an Immigration lawyer.

I got this from an auto-reply email from.the US embassy Nigeria.

Does this also mean that those that are in administrative processing will have to repay application fee, visa fee and redo medical examination

I think the message is very clear on what the US Consulate intends to do as regards those whose visa’s about to expire or already expired.

Which means that even when US embassy in Nigeria reopens. They would still not process immigrant visas which include CR1 visas until the ban is lifted. I advice everyone to be really patient because these are really fragile moments for everyone undergoing and visa category process especially in Nigeria as there are no head away yet regarding their reopening.

When you check out the proclamation, there are exemptions.

So you're just wanting a visa to live and work in Canada until you can move to the USA?

The Canadian Express entry programme allows one to enter Canada with a permanent residency status via ones qualifications. So yes I am considering that as an option to be closer to my wife in the USA since it’s just 2hrs away. Or would you advise I go through a Canadian students visa ( a Masters programme)?

    Hello,

Go ahead with your USA application. You can do the Express entry by the side. The Ban does not stop them from issuing visa. Trump is looking for educated, highly skilled and financial healthy immigrants to come to the state.

Ensure your relationship Is genuine, she should be confident and truthfully answer all questions asked with back up evidence.

Make sure she includes all her qualification and anything that makes her financially strong while submitting documents.

I witnessed alot of people being out rightly denied, for not submitting the right set of documents and those with conflicting information.

    Best of luck!

So basically, Visas are still been issued despite the ban yeah?

Every visa application is either issued or refused. It sounds like they were refused with a 221(g) pending additional documentation. Nothing unusual there. It's technically a refusal (as it has to be if documents are missing), but one that can be overcome by providing the documents.

Edit: Although I will note that it is NOT an RFE. USCIS issues RFEs. The consulate refuses the visa under 221(g).

ello. I don’t know if  this is the right forum, but I do need advice. I am married to a USC. From calculations my petition will be approved in Sept and interview before December. Right now there is a ban on the Immigrant Visajn my country Nigeria, from the look of things the Nigerian Government is distracted and has channeled resources to tackle this Coronavirus, thus making us uncertain as to when they will satisfy the US criteria in uplifting the Ban. Now, with an on- going petition yet to be approved and been an Optometrist . I am thinking applying for “express  entry Canada”- a route that leads one to becoming a Permanent Resident in Canada(takes about 18months) or better still applying for an Msc in a Canadian Uni. If I can get myself to Canada,It just takes my wife 2hours from her state in the US to meet me in Canada. As it is I am not getting any younger the Older I become ,the  lesser my points for the express entry Canada. My questions are
    1. Is it safe to venture in the Express entry route to Canada? Or just go for schooling for my  masters degree or just wait til this ban is lifted(I don’t know when it will be lifted)
    2. When it gets to the time of my US interview . Will the Vo’s find out I applied to Canada. If asked if I applied for any other countries Visa is it okay to come out plain or hide such info?I just need advice pls

It was a tough day. I think I saw your hubby.

Guys, I'll update soonest, full details, what to mitigate and expect. Its soooooo tough right now. I almost wept when people were out rightly denied, RFE and asked to  submit extra documents.

    Above all, God reigns.

    Regards,

Outrightly denied! My goodness. We will be waiting for updates.
