Just dont update your passport, will be tough to travel back to the homeland. We kept all the immigration and passport in my wifes maiden name while changing ssn, bank accounts DL to her new name. When she appliwd for citizenship she changed it all over to married name and got her new passport in her new name. Not necessary to change your name with USCIS.

    I filed I-90 form in Jan 2023 to replace my 10 year GC that was lost in the mail by USPS after form I-751 was approved. In the meantime, court approved my legal name change. At this point, I'd like to update my documents (driving license, SSN, bank account) and inform USCIS about the name change, but I am not sure what to do. I could either:

     

    • Go ahead and update my documents without informing USCIS. I'm afraid this would jeopardize the pending I-90 case.
    • Update my documents and send an unsolicited evidence to USCIS through my account to inform them about the name change and hopefully they'll update the name.
    • Do nothing and wait an indefinite amount of time for my case to get approved

     

    Every time I speak with somebody at the phone they are not helpful :( Thanks for any advice.

    After having my I-751 approved, I was sent the 10 years green card to my mail address but I have never received it. I reached out to USPS and they admitted they lost it. So frustrating!!!

     

    After a month or so, I changed my last name for few reasons so I’ll need to update my new Green Card.

     

    I know I need to file I-90 to replace my Green Card, but what reason should I enter? Card was lost or destroyed? Or legal name was changed? They both apply!! And will the fee be waived since the GC was lost? I’m not sure what to do.

    After submitting the outside normal processing request on the October 27th i got a notice on the 28th that "We have taken an action on your case" however online case status showed nothing, no updates at all and checked again over multiple days with no change. Filed my wife's EAD renewal paperwork this afternoon and then checked the mail, behold a USCIS letter saying our interview has been scheduled for December 1st 2020 at the Detroit Field Office.

     

    Now i am not going to say that the outside normal processing request was 100% the reason it was finally rescheduled, but i have a sneaking suspicious that it was because the notice date on the letter in October 27th (same day i filed the request).

    That's exactly what happened to me: as soon as I filed for EAD and AP renewal, they rescheduled my interview :)

  5. Hello. I talked with some people and it seems like they are rescheduling interviews for applicants who filed in October-November 2019 in Detroit. You'll probably get your interview rescheduled soon.

  6. If your spouse held a J-1, you should submit the form DS-2019 in your possession and a copy of the J-1 visa.

    Now, there are two cases:

    1) Was your spouse granted a waiver for the 2 years rules and it's clearly stated on the visa or on the DS-2019? You're okay (This was my case). 

    2) Your spouse wasn't granted a waiver but he/she resided in the home country for at least 2 years after leaving the USA? Submit proof of this. I-94 with travelling history and proof of residence in the home country (lease documents, car insurance for example with translation if necessary.)

     

    Be sure to explain this on your cover letter. 

  7. Hello. Does anybody know what's happening at San Diego field office? Did they resume the regular operations?

    I initially filed my AOS in Detroit, MI in November 2019. My interview was scheduled for March 2020 but then cancelled due to the pandemic. I recently moved to SD and requested a change of address to USCIS. I am still waiting for my interview to be rescheduled. The wait is so frustrating. 

  8. I think the main reason they didn't restart the AOS interviews yet is because they are prioritizing the naturalization processes since the presidential elections are so close. For Michigan, the deadline to register for the elections is August the 4h. I believe they are trying to finalize as many naturalizations as possible. I hope that after that date they'll resume the AOS process. Note: this is just my assumption, take it with a grain of salt.

    My interview was scheduled for March the 18th at Detroit Field Office. Then, I received a letter saying the interview was cancelled and to wait for further notice in the mail. I've never heard back from them in more than 4 months. I called USCIS 2-3 time during this months but they didn't have any updates for me and they didn't let me reschedule the interview by myself. March the 18th was the first day of quarantine in Michigan (lucky me) so, I suppose my interview will be one of the first ones to get rescheduled in Detroit. I'll keep you posted as soon as I know more. Good luck to everyone.

    I would send what you were asked for by USCIS. That is, the sponsor's tax return and the applicants birth certificate.

    You may attach a cover letter to explain yourself if you made a mistake, but I would'n send a new I-864. Just follow their directions.

    You can check out your status on  USCIS website. I subscribed to the text service, so I get a text whenever my status is updated. 

    I also use an app on my phone called CaseTracker.

    on the application it was my maiden name + my married name .

    I said That I just want my married name and that’s what I have in my visa 😀

  13. Hello, this is my situation.

     

    I got married in October 2019. At that time, I decided to change my last name, so I received the marriage certificate with my new married name.

    Right after, I filed for AOS, requesting a name change in all the documents (I 485, I 130, I 131,  I 765). 

    My SSN, driver licence, passport and everything are still on my madein name. 

     

    After few months, I am considering to go back to my maiden name. There are multiple reasons: avoiding the troubles of changing my bank accounts, credit cards, passports, SSN.

    Moreover my home country doesn't make it easy for a person to change their legal name

     

    Could I request to go back to my maiden name during the AOS interview even if I filed the documents with my married name?

    Yes, my status changed to "card was mailed" 2 days ago and again "card was picked up by USPS" 1 day ago. They also attached a tracking number. 

    Just be patient, I am sure your card will be shipped very soon.
