I agree. I'm not trying to hide it, or I wouldn't have spent two months trying to track it down. I think all I can do is get certified letters from the court and state archives stating the record can't be found, and include an explanation of what happened? I also have an email from the MD state archives stating I should contact the court for the case number. I did and the court can't find ANY record of me being arrested in Baltimore. I've hit a wall, I think.

Just disclose the arrest on your K1 petition. Provide any documentation you have. Including the court letter stating that no record can be found. In my case, in addition to the court letter, I also provided a police certificate from the police department that had me arrested. The letter showed no record as well, as my record has been sealed because my case was dismissed. I would, also suggest, provide information/ explanation in the supplemental section. Just state that you were arrested, the charges (if you recall the charges), the outcome (if you recall the outcome), that no record can be found, and that you have provided the court letter stating that no record can be found. This all will be sufficient. Good luck.

I'm not sure they know which employers you worked for without you putting them down. Here is a way to correct the error with no penalties. Just substitute your personal information and the information that you want to add.

This letter has worked for others to correct errors or for missing documentation or errors that you would like to update, correct or add.

    Dear USCIS,

I, <PETITIONER NAME>, forgetfully omitted XXXXXXXXX in my i-129f petition for alien fiancé and have sent this supplement to provide the missing information. The contents included in this supplement are:

    • Beneficiary's passport style photo (Do not forget to write her/his full name on the back of it lightly in pencil)
    • Letter of intent to marry (beneficiary)
    • Letter of intent to marry (petitioner)

I wish to please request that the documents included in this supplement be added to my i-129f petition for alien fiancé.

    Information about my petition:

    Receipt number:

    Receipt notice date:

    Petitioner:

    Petitioner's date of birth:

    Beneficiary:

    Beneficiary's date of birth:

    Signed,

    <Signature and printed name>

    <Date>

Should I wait to receive NOA1 so I have a receipt number and date and then mail this with the supplemented information - list of my other employments? Or should I wait and see if they approve it without asking for an RFE; then, have my fiancee have the supplement at the interview date?

Ok, I see what your saying. From the juvenile case I have 3 court documents labeled disposition (1 has the outcome of the court proceedings where i was granted community service, next a 6 month review and deadline extended, and next was 3 month review where community service was completed and case dismissed)

I also got the disposition and outcome of the other two cases. Certified and notarized.

It costs $25 per page for certified documents. Is it required that they are original certified documents for the filed I-129f? As well as the copy given to beneficiary at time of interview?

I've seen on the USCIS website that everything should be photocopies except the passport photos and the letter of intent to marry. Just wanna make sure because I want to send the right ones

I mean you could send them the photocopies. Hopefully, they are satisfied with what you have send. However, if you wanna avoid receiving an RFE, I would send them the certified copies.

On the I-129F it asks for employment history for the past 5 years. I haven't worked in the past 5 years because I've been taking care of my disabled mother full time. Should I still put down my employment history from longer than 5 years ago? Should I put an explanation as to why I haven't worked on the I129-F? Thank you in advance for your response.

I missed this part. I only put 2 years worth of employment history. I am not sure if they would issue and RFE for it to provide them with more information. Does anyone know? In your case. I Suggest, yes, write whatever explanation you have for not being employed.

Did you send photocopies of the certified copies from the court? or, did you send the certified copies the court gave you? I've just seen lots of differing of opinions and not sure what to send

I have read in the I-129F instructions that court and police documents must be certified copies. Not photocopies, which is the case with everything else you submit to USCIS.  I suggest when you go to obtain the required documents from the court and/ police station ask for 2 certified copies of each. That way you can mail one with your petition, and have one for your own record. Also, disclose the arrests with your fiancee. Give her all of the records at the day of the interview. Good luck.

Always send photocopies, never send originals

That is incorrect. Arrest related police and court documents need to be certified copies.

    Hi,

Just wanted to get more opinions on this matter.

I am the US petitioner, filing I-129f form soon. I am 3 arrests on my record. One as a juvenile, and 2 as an adult. All 3 charges were dismissed. I have obtained copies of the juvenile court documents. The entire case is 20 pgs. Which pages do I need to get certified?

The next arrest I was charged with possession of open container as a minor (18, but under 21). I was taken to the jail and let go in the morning. I was never charged with anything. I got the certified arrest record. But there are no court documents. Do I need a statement from the court stating that there is no record of this? or is the arrest record enough?

The last arrest was a traffic violation with a maximum fine of $1000 or more. I got the disposition from the court documents certified and notarized copy of the arrest record. I think I have everything I need for this case.

Should I send photocopies of the certified court and police documents? or the original certified documents?

Just wondering if anyone has any pointer or guidance...

    Thank you

I am not sure what court or police documents you have already obtained. In my case, I have obtained a certified court disposition. It is a letter stating the arrest, charges, and final disposition - verdict. Also, I have obtained a police certificate, where the sheriffs department ran a background check on me. I send the certified copies, and not photocopies.

For those who have just filed your I-129f application with USCIS, this thread has been created for your needs and for you to be with others experiencing different aspects of this journey. This is a place to ask questions and to share experiences. All are here to learn together. Good luck because this is a long process currently running 5-6 months from filing date for your NOA2 approval.

    https://www.uscis.gov/sites/default/files/K1_Process_V11.pdf

Also, since your application will go through a number of background checks this is a primer on what goes on with the background process.

I know it really sucks, but the best way to get through this is to lower your expectations and try not to compare your timeline to anyone else's. Don't forget that the people here on Visa Journey represent a tiny percentage of all the petitions the CSC has to work through! When someone gets to your file you'll hear from them. Stay busy, talk a lot with your fiancé about non-visa stuff, don't forget to hang out with your friends, take up a new hobby, go to a sporting event, and your time will come! Good luck

Explanation why is it taking so long.

    Is there a December thread?

You should answer yes to 2A since you were arrested for dating violence and yes to 4 since you were arrested for breaking/violating a law. Make sure your fiancé knows full disclosure of the events.

As part as of the requirement to provide information. Should I include the charges, the date of the arrest, and the outcome. Technically, match what is provided in the court disposition? Or should I go specify that my arrest was dating related?

  9. If I answer yes to question number 2.A, Should I also answer yes to question number 4.A. I was arrested for dating violence. Breaking a phone in particular.

2.A Have you EVEN been arrested or convicted of any of the following following crimes:

Domestic violence, sexual assault, child abuse, child neglect, dating violence, elder abuse, stalking or an attempt to commit any of these crimes?

4.A Have you been ever arrested, cited charged, indicted, convicted, fined, or imprisoned, for breaking or violating any law or ordinance in any country, excluding traffic violations?

As far as previous advise from our VJ members, yes, a scanned copy works.. you may want to check out previous conversations about this 😊1B630909-4574-4865-A394-94D4870A4FFA.thumb.jpeg.6933ac46e91e4977dbb89a62ff8c2617.jpeg

The wording can be the same too? I have read on here that some people suggested that the statements should be original in their wording, however, I fail to see the point in that.

Any document you send to USCIS should be a copy. If you need an original for the interview it will be asked for or set as a requirement in the P3 letter from your embassy.

I will provide a photocopy instead then. However, for my arrest, I am going to provide a certified copy. As it is a requirement for court and police records - correct?

That’s plenty.  Itineraries and passport stamps are all you need.  If you submit pictures together it rounds it out also.

I have read this site and others and have yet to see anyone saying they got an RFE because they thought the travel documentation wasn’t enough it that the trip wasn’t taken.  The case would have to look shaky for that to happen.

I do only have my passport stamped in the connecting country though. For whatever reason my passport was not stamped in the destination country where my fiancee and I met. Should I still include the passport stamp as part of my evidence. It would still prove that I took the trip, however, I do not want to confuse the person reviewing my petition to think why am I providing passport stamps to a country where we did not meet.

Does it have your name on it?

Yes, it states my name. it states the departure from and to, and the date.

What about credit card statements showing the purchases with date/location?

Yes, the credit card statement indicates date and location, in addition, it says ATM transaction. Meaning it was a physical transaction. Not like an online transaction.

Would this suffice? Also, I do have passport stamps, but only for Germany (the connecting country). It would at least confirm that I indeed traveled, but yet I do not want to confuse the person reviewing my petition. My fiancee and I met in another country where my passport was not stamped for whatever reason.

Do you truly think that the DHS has time to waste on trivial things like these? You asked for help but come off as defensive when VJers try to help you. No one is against you and we all help as best as we can. :)

Refer to the K-1 visa guide: https://www.visajourney.com/k1-fiance-visa-overview/ for more help.

    I do have the following:

    1. Flight itineraries (USA to Germany & Germany to Destination Country)
    2. Baggage Ticket (USA to Germany)
    3. Baggage Claim Receipt (From Germany to Destination Country)
    4. Passport Stamps for Germany ONLY
    5. Debit Card Statement showing three separate ATM transactions in the Destination Country. Meaning I withdrew cash at a foreign ATM.
    6. Two/ Three Pictures of my fiance and I (one with family)

Is this sufficient evidence of the in person meeting?
