If you're worried about them getting denied after a long flight, have them route their flights through Dublin or Shannon so the pre-clearance happens there.

Poland is a part of the Visa Waiver program as of just recently, so I'm worried most of their scrutiny will be faced after the long flight in a US Airport.

If I were you, I would call CBP at his POE. Give them his name, and information, and give them the heads up that he wants to AOS while on his tourist visa. Might help them process him faster in line.

She does not have one. I have a request in for my employer to get me this signed ahead of time but they are dragging their feet, most I can do is a screenshot of her on the beneficiaries.
