  1. There is a topic here already that deals with April filers from NVC to Interview. So I decided to put a topic like this one because I think there have been several approvals from April and May filers. Post your NOA2 dates to NVC so we can get a good picture how long it takes now between NOA2 to NVC. It usually just takes a week or two, but I think now it takes about a month or so..those who have NOA2 alreayd and still waiting for NVC post here and also once your case arrived at NVC.

Your feedback would be much appreciated..thanks..

  2. This just crossed my mind and would love to have your thoughts as well. There is this immigration attorney who is very well known and excellent in his cases and he is based in California but has a few locations as well including the Philippines. He also has a talk show called Citizen Pinoy which is aired by ABS-CBN, the biggest tv network in the Philippines and also broadcast their shows here in the US through Direct TV. His name is Michael J. Gurfinkel and my thought was can I still get an attorney even though I have submitted all the papers and just waiting for the NOA2?

Not that I am going to get him but this was just a thought and would love to have your opinion if this is possible. He has done lots of cases that were turned down by other attorneys and said that the cases were impossible and hopeless and turned them to green cards or whatever the cases were.

So I need your thoughts about this. If there is anyone here who is going to file for a I-129F visa and plans to have an attorney I recommend him. Here is his website: www.gurfinkel.com

Thanks guys and best of luck for us that are still waiting for our NOA2. God bless.

  3. Kits_24_Faith, I was just checking in on you to see if you've heard anything about your case (RFE) yet? They said it could take up to 30 days and 30 days has now passed, so what are they telling you now?

    V.

Congratulations on your very quick approval. Did you make it already to NVC? Keep us posted. Well, when I called back in early September the person I talked to said it usually takes 30 days before they can get it out off their desks. I know it sais on the update that the time period they gave is 60 days from the RFE response that the case has resumed. I will call this Friday if I do not have my NOA2 yet and tell them that it's been more than 30 days. I will keep you posted and thank you very much nyblubird for the concern. I really appreciate you a lot and it feels good to have someone that do care. I wish you the best and God bless.

  4. Thanks Scott.. but I have another stupid question to ask.. um will the officer ask me who is my lawyer if I made that up? Like if I said my lawyer said dah dah dah dah.. will the officer ask about my lawyer? Coz I do not have any.. thanks..I'll call them if by Friday I still don't hear anything or atleast a touch. Thank you.

No one will ask for you to prove it...the only reason for saying that is to play like an innocent little lamb gone astray from the heard and you can't find your way back :crying::crying::crying: It seens as though when you play dumb and are extremely nice they go out of their way to help and inform you...(just my opinion).

    Best of luck!!

    Scott

Thanks Scott.. so with my situation (look at my timeline) can you kinda help me what should I say to the officer when I call this Friday if still no NOA2? Like what do you think is appropriate to say about what my lawyer said about my case? Since my case has resumed already from a RFE response back in August 22. Thanks for all the help.

I think in your case where you already have an RFE be very honest and very specific about the questions you pose to them. Try to explain details about the RFE and ask about the time frame...and why is it taking as long as it is and what more can be done to expedite the petition. Hopefully the officer you speak to can give you some answers.

    Keep us posted.

    Scott

Thanks Scott again for all the help.. I will call this Friday but I hope I don't have too. I want my NOA2 pls USCIS.. I'll keep you guys updated.

    CONGRATULATIONS on the new approvals!

I'm sure we'll be receiving more this week so that all the May filers will be approved soon.

Kits and Faith, hope you receive your noa2 soon, our fellow kababayan.

    God bless us all!

Hi Beng and Carl.. thanks and I noticed that your fiancee is in Makati.. mine is in Imus..I wish you guys well.. God bless..keep us posted

  6. Kits 24 Faith I notice that on your timeline it says Touched August 22: RFE received and case resumed - How do you know this ? did you receive an email stating this ??

I just dont understand how if it was resumed almost a month ago you have not received your approval. Please let me know what they say if you do call them about how they deal with the RFE,many thanks.

BTW when ever I do the 'REF trick' we normally just ask how the case is going once we get through to someone and make sure it is a woman as there is a guy there also and he is no help at all but the woman normally tells us whats going on. We haven't bothered to say anything about a lawyer just that we had an RFE. - Hope this helps

It sounds like you haven't signed up under USCIS' email notification and on site service. It's free and all you have to do is go to www.uscis.gov and on the left ther's a link to check your status online. Then just follow the instructions on how to make an account and make sure you select Customer instead of Representative if making your account. Me either, it's hard not to complain since we all are just human beings. But really it is giving me and my SO such a hard time because we thought right after the case has resume from the RFE, we will have our NOA2 in less than a month. I have seen others here that had a RFE got their NOA2 in days or after a week or two. I guess we just have to stay positive and trust God that some things are not in our control. God bless on your speedy journey and I hope we can get out of this long wait already.

  7. We just now got an email from Cris saying we got an RFE AGAIN !!!

Seems insane to me that they could have had it for this long without looking through it and listing what they need

OH well have to just pick ourselves up and move on and try to look at this as a step forward.

CONGRATS AGAIN AND HOPE MORE APPROVALS COME THROUGH

Andrew...call CSC again (don't get fowarded to the national call center...speak only to and officer) and explain again your situation..how long you've been waiting and hopfully you can get the info you need to expedite your RFE. Just don't forget that you remain top on the list until your case has been adjudicated !!! No worries !!!

    Scott

Thanks for the advice Scott......and HUGE CONGRATS for your GREAT NEWS :dance::dance: .

I really am happy for you because we ALL deserve to beat this crappy system of waiting for so long for this approval to start the real process of getting our visas.

We are trying to console one and another and waiting for the letter and we will keep you informed. We just hope that, as you say, it wont slow us down too long. We would call CSC but they will not talk to me as the recipient and my fiance the petitioner really does not want to speak to them at this time which is understandable really.

Best wishes Scott and have a few drinks for me in celebration you both deserve it :thumbs:

    Scott

Hi Scott..first of all congratulations.. 2nd is can you tell me how can you actually speak to an officer instead to a USCIS customer rep? As far as I am aware most of us that had tried the RFE trick ended up speaking to someone who doesn't really know a thing. Thank you.

  9. I wish everyone their NOA2s..and after that no more long delays.. Sometimes I've tried so hard to move on and stay busy but my SO is always in my mind and never was a moment that I don't think of her.. and whenever I do think of her, i just want her so bad to be here already and be together for the rest of our lives. It really doesn't have to be such a complicated process.. it's just taking such a long time.. which really makes it hard to bear but must face the test and challenge.. Sometimes its so hard to keep telling my SO the same thing over and over.. that it will be alright.. it will come soon...that they have't forgotten us.. when I know it's all on me because I'm the one who is so far away and putting her in this situation..and nothing I can do to speed things up even for just a bit.. I always remind her that if the road ahead may not be so easy, my love for her and our love for each other will lead the way.. and see things through.. to everyone.. WISH YOU GUYS THE BEST..and a SMOOTH JOURNEY..

  10. Congratulations!

Hi jessel..heard anything from NVC yet?

Hello kits_24_faith actually didn't update forum signature but I updated my timeline. NVC received our packet Aug.30 and left Sept 4. I got my schedule for medical and interview. DeeZee and I are having the same schedule.

    Medical - Oct 30

    Embassy - Nov 7

I'm hoping to have yours so soon....

Congratulations... it's possible that you can be together before Christmas..

  11. Many thanks Scott, and to others who gave very kind words of comfort.

We are both a bit devastated at the minute and even called them back and got the same woman again, this time she said that on her computer our case reads as an RFE however she says the officer is still working on the case...........

Seems very strange as the only 'touch' we got was last Friday. Does that mean hes been working on it all week, could he still say its approved , I have no clue.......

Oh well, in the mean time, with what all of you kind people say as a guide, we are trying hard to stay positive and gaining solace from knowing that once we provide whatever it is that they might request, that it will continue straight away.

MANY MANY THANKS well try keep our spirits up with the help and support of you all.

It usually is faster to get your NOA2 after your case has resumed due to a RFE. But as for me, if you look at my timeline it's going to be a month now after my case has resumed and still no NOA2. I did a search awhile back for some members here that had RFEs as well and theirs only took between days or a couple of weeks. I don't want to discourage you because you can get your NOA2 quicker than what I am going through now. I just really hope I get mine before this month ends. I was really anticipating a quick NOA2 after the update because of others' timelines here in VJ with a RFE, and for the fact that it stays in the officer's desk and that RFEs are the first things they work on when they go to work. I guess some just really get it hard and have to wait longer. I wish you luck my friend. I hope you don't have to wait longer than I have been waiting. God bless.

Based on what evidence ? so you are saying its better to make a mistake in your petition , therefore get a RFE, then you get a speedy approval, would love to see the evidence to support this, i have seen many posts thats clearly shows a RFE can add months to getting your approval. I think before you throw out wild statements like you did, you need to have solid evidence to support it. Good luck

Sup buddy..slow down there a bit and and no need to be so rude.. I wasn't even saying that it's faster to get a NOA2 if you get a RFE.. who wants a RFE anyways? Would you like to have one? If I could I'll pass mine to you hehehe lols. I was just saying that the ones I found that had a RFE took days or a couple of weeks that's all.. I wasn't able to find some members here that took a long time after a RFE, so maybe I just didn't search well enough and only found the ones that got it quicker. Ok, I'll do a search and see if I could find those that had it quicker ok but don't be so rude.. besides you filed back in July and in the right track.. I wish you luck on your application and hope you have a smooth journey..no bumps here and there.. God bless and sorry if you thought my post was wild.

  12. Many thanks Scott, and to others who gave very kind words of comfort.

  13. what is the quoted timeframe for the I-129F? is from the day you filed or from the NOA1? can someone post an updated list of folks that are still waiting? if we are supposed to include the day we filed it's been 184 days for me and 158 if from the NOA1..so what is the quoted timeframe?

Zoomer posts the lists and he is on vacation. He will be back the middle of next week.

I think the USCIS 6 month clock starts running on the Received Date on the hard copy of your NOA1. Unfortunately this does not apply to you since you had a RFE. USCIS says that the 6 month committment does not apply if they need to request additional information.

A follow up. I was too slow with my edit.

Your petition is obviously out of its box and on an adjudicator's desk. Do you have any idea why you have been touched so often? The adjudicator must be having a difficult time with your petition for some reason.

    What was the RFE for?

If you don't want to answer, just tell me to mind my own business. :)

Ok..so it is 6 months or 180 days.. if the count starts on the day of NOA1 I am now in my 158th day.. and with the RFE when i got the confirmation that the case has resumed it sais 60 days.. so which means 180 plus 60 days equals to 240 days.. but what i really don't understand is the members that I have found here that had RFEs took only days or two weeks to get their NOA2 after their cases has resumed due to an RFE.. mine is just taking longer.. i hope my officer is not on vacation.. we all know for the fact that officers work on RFE first thing before any other cases because they just have to finish it or try to get rid of them first in their desk or wherever they put them..i'll put it this way, I SHOULD HAVE MY NOA2 BEFORE OR ON MY 240TH DAY!!! THIS REALLY SUCKS!!!

  14. After reading the article..howcome not all March filers got a RFE? Especially those who have filed after March 6? Just curious..because it sounded like they were saying that whoever filed on or after March 6 automatically gets a RFE.. can anyone correct me? I'm just confused..and also I've noticed that most of the members here that had received a RFE got their NOA2 in less than 2 weeks or just days.. and mine is about a month now and still no NOA2 after the case has resumed.. poor me and my fiancee.. huhuh...keep us in your prayers

  15. Have a little empathy. I see from your timeline you did not have to wait 140 days plus for approval and that you are almost at the end of your journey. Kits_24_faith is still waiting to move on. Do you really believe he should be less stressed because he will not be bringing his fiancee here until January? Maybe I am missing something!

you are missing something! If you can't see that i was trying to calm him down a bit, then i don't know what to tell you. It doesn't matter if he's 140 days or I'm 120 days, the fact is we are all still waiting, right? My plans of having my SO here has come and gone, his plans are still in the future, so what don't you understand about this? Read again what i wrote, carefully this time, before you question my empathy and maybe you'll understand how i was trying to make him see the bright side.

Another fact remains that some might get there NOA2 quicker than others but in no way does that mean his SO will come into the states quicker. Kits SO could very well come before somemone who has already gotten an NOA2, nothing in this process is set in stone and at any givin time your case could be held back.

    Harout

Umm.. I'm not really trying to argue.. um I wasn't so sure what you mean by calming me down because when you replied to what I posted I wasn't even in a rage or in any angry way.. this is what I said and to where you replied, "Thank you ladywhite.. I just thank God for all the blessings even though me and my fiancee are going through tough times due to the long wait. I know it will come..and we are praying for the NOA2 and also for lots of patience and leave it to God.. our timing and the USCIS's timing may not be perfect..but God's timing is always perfect..not too early or too late.."

I sounded calm there and even thanking God.. hehehe.. oh well I guess just a misunderstanding..

  16. Thank you ladywhite.. I just thank God for all the blessings even though me and my fiancee are going through tough times due to the long wait. You know, i read somewhere else that you planned on bringing your love in January 2008 ( After Christmas) if thats your plan anyway, i would not worry so much about not getting approved yet. you have nearly 4 months till that time to come, so why worry? you will be approved by then.

I want my baby to come to me now! and as soon as she gets her visa, she is coming the next day! so obviously were more on edge at waiting. But you have time cause thats what you wanted anyway. Right? so don't worry or get stressed out.

    Harout

Sorry buddy..most of us here, if not all, know before we all have filed for this type of petition that we have made plans and have expected dates to have your SO here. Like we all have a good idea that it takes atleast 6-8 months from filing to the arrival of SO here in the US. Unfortunately there are some that have to go through the hard way by waiting longer. Not everyone gets through this journey smoothly like most others have. I filed back in March and after 5 months got an RFE instead of a NOA2, which I can understand. But after the case has resumed it is still taking a lot of time even though for the fact that officers work on RFE first thing when they get to work. I have also searched some members here that had a RFE and took just days or a couple of weeks to get their NOA2. So you see, me and my fiancee are just having it the hard way, unfortunately. I'm already waiting 6 months for my NOA2 to come and I am aware as well that another 3-4 months before she gets here. NVC, medical, interview.. etc.. because of the wait that we are going through we have to keep pushing things back. I am very happy for those that had gone through this process the way it's suppose to be, withouth the extra long wait. A little encouragement wouldn't hurt and would be greatly appreciated. I was really expecting her to be hear around October because her birthday is in that month, or atleast before the end of the year. Well, I guess I go back and just keep waiting and praying. Thanks for those who have given me their understanding and encouragements.

  17. kits_24_faith:

    I do feel for you.

I myself experienced a strong sense of helplessness last week while waiting for my transcript to arrive. I was closer and closer to lose my sanity waiting for only one week. I can't imagine how you have been able to get through the lengthy wait with all the senses intact. I admire you so much for your strength and patience.

I will keep you in my prayer. (F)(F)

Thank you ladywhite.. I just thank God for all the blessings even though me and my fiancee are going through tough times due to the long wait. I know it will come..and we are praying for the NOA2 and also for lots of patience and leave it to God.. our timing and the USCIS's timing may not be perfect..but God's timing is always perfect..not too early or too late..

  18. Hi guys.. I've been here in VJ for quite some time and I never saw this part of VJ.

Can anyone here assure me how long does it take to get the NOA2 after getting the update from USCIS that they have received my RFE reply and the case has resumed? The only reference I have are the other timelines from different cases that had RFEs and noticed that it only took days or upto two weeks to get their approval. Until now I don't here anything yet and I have called a few days ago and nothing either. I guess we're one of the couples that have it hard and have to wait much longer while others sails through smoothly. I filed back in March and I was really anticipating her to be here this year even with an RFE. Thank you guys.
