Hey Timona,
1. I had neither plus my wife wouldn't apply for ITIN for me.
2. 2020 HoH 2021 Single.
Hello Oko, has there been any update? I also got the same letter which stated that my claim has been disallowed because my spouse’s SSN was issued after the return was due and I cannot retroactively file MFJ.

How soon after the DV denial did they divorce?
USC spouse needs to get on board with finding a lawyer as they are the ones who will have to show moving to your friend’s country will be a hardship and all the other issues they will encounter if your friend cannot move to the US.Thank you. They divorced prior to meeting his current wife. He married the current wife in 2019.

I have seen many people successfully put together a Waiver Package without a Lawyer, however none that have had a friend ask for them if they can do it themselves.
So I am going to assume they need a lawyer.
What happened to his first marriage? Did they divorce?
Thank you.Yes. They divorced.

Hello,
A friend went for a spousal interview and was given a paper with section 212(a)(6)(C)(1) marked as the reason for the refusal. He is eligible for a waiver. In 2011, his then girlfriend won the dv Lottery and they got married after. The CO denied the visa because she didn’t believe they were genuinely married resulting in a section 212(a)(6)(C)(1). Does he need an immigration lawyer to file the 601 waiver or he can do it himself? Thank you.

I see . USCIS did not need the divorce to establish relationships between Pet and Benef, so they did not RFE…but as you know consulate wants everything.
You can have them do a simple one page and upload it on CEAC . Title it “ Addendum to I-130 / DS-260 Request for Record Update/ Correction” . Kindly note the correct date of Ben divorce is xyz, as evidenced by the enclosed Divorce Cert. Please update item #x on I-130 and item # y on DS-260 . The error at filing was unintentional “
This way consulate has a heads up. It’s not a problem at all…since it is not a marriage based petition
Thank you so much.

Upload divorce decree to CEAC. ..presumably it’s the same document that was submitted with the I-130 . At the interview have the beneficiary state there was an error / date mix up during I-130 and DS-260 filing and ask the Officer to kindly update the record.
Was it an “innocent “ mistake ? Did petition get mixed up w different dates on the document? You know they are tough at Ghana ..cause they see many creative documents 😂
Lol. Thank you. So the petitioner is filing for the mom and asked the dad for the divorce date. A divorce certificate was not submitted with the I 130. USCIS didn’t catch that. NVC requested for the divorce certificate and that’s how the petitioner realized there was a mistake with the date when petitioner reviewed the divorce certificate. Since it is Ghana, I suggested an affidavit to proof the correct date is the one on the divorce certificate and the one on the I 130 and ds 260 was a mistake when the mom goes for the interview.

Interview Date : 2022-07-18
Submit Review
Visa Received : 2022-07-29 US Entry : 2022-08-13 Beneficiary is in the U.S. now, and presumably has a gc in hand.
Marriage (if applicable): 1. Why are you asking about CEAC when beneficiary is in the U.S.?
2. When was the couple married?
3. When was the final divorce decree issued?
4. Did the CO see the divorce decree?
This is an IR-5 case not IR-1. Asking for relative. Thank you.

This is unnecessary. A spousal I-130 where the U.S. citizen spouse dies will automatically be converted to an I-360 at the consular interview. The beneficiary is also now exempt from the I-864 requirements and should bring an I-864W to the interview.
The beneficiary can email either NVC or the consulate, depending on where the petition is, to let them know, but this will be done automatically when they show up for the interview.
Thank you!

No need to file I-360…I-130 automatically converts .
You should also update those on CEAC and send message to NVC
Thank you !

Thank you. However, On the USCIS website, it states the filed I -130 automatically turns to I -360. No idea how to go about it. Who should be contacted at this point ? NVC? The embassy?

Yes. What must the applicant do?

Hello,
An applicant’s petitioner passed away after they received an interview letter. The child of the petitioner was a joint sponsor. What has to be done now? Thank you.

How will your mother get a passport without a birth certificate? The same documents she will use to get passport will be accepted. My advice is get the passport and then use the passport and the documents you used to obtain the passport as proof. Usually that includes two affidavits from people who know when and where she was born (old respectable people), a letter from the birth registry confirming they do not issue birth certificate to people of that age, and a notarized letter from her stating she’s a citizen.
Thank you for your response. I just uploaded the same thing I did previously and included a screenshot of what the travel.State.gov stated about Birth certificate for applicants over 60 for Ghana. The case has been documentarily qualified.

Hello everyone
I am filing a petition for my mom.my mom does not have a birth certificate and the issuing authority in Ghana stated they do not issue birth certificate for people above 60. We got an attestation to state that. NVC rejected it. Anyone with a similar experience? If so what was presented to NVC? Thank you.

Hello,
please is anyone in a Ghana whatsapp group for CR-1/ IR-1 visa? If so could I please be given a link? Thank you!

Hello everyone,
Anyone with an immigrant visa who couldn’t travel from Ghana to the U.S. contacted U.S. embassy in Accra to extend their visa for one month based on the Department of State statement on July 24th? I know Ghana’s borders are still closed and I think they might not grant that extension due to that. Thank you.

They make up prices sometimes depending on who you know so who knows what the "real" price is. I honestly forgot how much it was for my spouse but I'm pretty sure it was less than 400cedis. Obtained May 2019.
Thank you for your response.

@Karay Hello, our visa process is taking place in Accra also. My question is, have you been able to schedule an appointment?
I am still in the process of obtaining all civil documents.if you mean an appointment at the US embassy; no. At this time the embassy is closed. Appointments will be scheduled when they are opened. You can follow them on Instagram to know when they are open or check their website regularly.
