  1. it does happen https://www.justice.gov/archives/jm/criminal-resource-manual-1948-marriage-fraud-8-usc-1325c-and-18-usc-1546 the U.S. citizen is paid to marry the alien in order to entitle the alien to obtain status as a permanent resident of the United States; the parties do not intend to live together as man and wife. A legal issue arises where the parties tell the INS they are married, and they subjectively believe they are telling the truth because they have complied with state marriage requirements. There have been situations where a bona fide marriage turns sour but the alien induces the U.S. citizen spouse to maintain the marriage as a ruse only as long as necessary for the alien to obtain status as a permanent resident alien. There is a line of cases holding that the viability of the marriage, if initially valid, is not a proper concern of the INS. United States v. Qaisi, 779 F.2d 346 (6th Cir. 1985); Dabaghian v. Civilleti, 607 F.2d 868 (9th Cir. 1979), and cases cited therein. However, the Immigration Marriage Fraud Amendments of 1986, 8 U.S.C. § 1186a, were designed, inter alia, to eliminate the Qaisi type loophole by establishing a two-year conditional status for alien spouses seeking permanent resident status, and requiring that an actual family unit still remain in existence at the end of the two year period.
  2. Divorce and move on let a good divorce attorney handle your issues you did a lot to prove relationship was real for K1 and then married so immigration (they see this a lot) will allow her to use divorce waiver to ROC and stay in USA also understand that both parties are subject to the following according to ICE https://www.ice.gov/sites/default/files/documents/Document/2016/marriageFraudBrochure.pdf Penalties An individual will be charged with marriage fraud if they entered into a marriage for the purpose of evading U.S. immigration law. This felony offense carries a prison sentence of up to five years and a fine of up to $250,000, and applies to both foreign nationals and U.S. citizens who perpetrate this crime.
  3. Other posts says grandfther or grandmother petitioned / they can not so who petitioned for who ? direct sponsorship of a grandchild is not possible under immigration law. However, if you are a U.S. permanent resident then you can sponsor your unmarried child for a green card, and their child (your grandchild) may in some cases be able to be included as a derivative on your petition.Jul 5, 2023
  4. If immigration officer does the oath you can also submit a court document showing name change at interview according to USCIS i posted In general, a Certificate of Naturalization includes an applicant’s full legal name as the name appears on the applicant’s Form N-400.[6] Before naturalization, the applicant may present a valid court order or other proof that the applicant has legally changed his or her name in the manner authorized by the law of the applicant’s place of residence. If the applicant submits such evidence, then USCIS will issue the Certificate of Naturalization in the new name. If judge does the oath, name is changed right then
  5. what country? depending on country/embassy AP can be weeks , months or a year Please do a timeline/ it helps VJ with your queries and others from your country who need info also
  6. In our case judge presided over the oath and people (even men who wanted to hyphenate wife's name to theirs ) was changed per the judge's court order https://www.uscis.gov/policy-manual/volume-12-part-k-chapter-3https://www.uscis.gov/policy-manual/volume-12-part-k-chapter-3 swearing-in ceremonies are routinely held at a USCIS office—sometimes right after the naturalization interview. In such a case, your request for a name change on Form N-400 cannot be acted upon. You will need to follow the name change procedures provided under your state's law, which most likely involve filing a name change petition with the state court. After the court grants your name change, and assuming you have already become a U.S. citizen, you will need to apply to USCIS for a new certificate of naturalization, using USCIS Form N-565.

  11. there is no reason for moroc man to seek aslyum no war, famine or gang wars
  12. Filed recently? When? Please do a timeline
  13. After doing all things legal for immigration legally to be here and taking 6 years from July 2009 till September 2015 costing both of us lots of money, i see on my Facebook another Moroc man who went to Guatemala then to Mexico and crossed into US as asslyum seeker. Moroc does not have famine, war or threats from drug gangs. this Moroc man was bused to New York city and has . work permit in 2 weeks. i thought he lied so i looked it up on USCIS https://www.uscis.gov/newsroom/alerts/uscis-streamlines-process-for-refugee-employment-authorization-documents#:~:text=After USCIS approves a refugee's,vary%2C depending on delivery times. USCIS has begun implementing a streamlined process for Form I-765, Application for Employment Authorization, to provide Employment Authorization Documents (EADs) more efficiently to eligible refugees after they are admitted into the United States. This streamlined process shortens the wait time for an EAD to approximately 30 days instead of several months. All individuals admitted into the United States as refugees on or after Dec. 10, 2023, will receive EADs pursuant to this new process. this is not fair and i know immigration is not fair as we see on here all the time but this is wrong and we should all be upset

  17. After loosing my husband i joined a penpail site i finally quit it after being bombarded by scammers some using same photo as others my house phone was still active and in my name and one guy looked my number up his call showed UK number but that was explained to me by a girl i met that told me "scammers from anywhere can have a friend in another country send a SIMS card like from the US and the number will show as UK" if u get messages or talk online to anyone here's some hints 1. don't let someone call u baby that's so they don't have to remember who they are talking to at any moment as scammers talk all day 2. don't send photos thru emails as there they can copy and use them to create new profiles 3. don't fall for the i am alone (no parents, spouse died and i have 1 child) A very popular profile 4. learn what country (state) the person is in and ask about it / if it takes time to answer , they are looking it up 5. ask simply "what time is it there now?" and again , know what time it should be and hesitation means they are looking it up 6. when scammers give u a song to listen to as its a favorite , its a way of keeping u busy as another prospect has come online 7. online scammers will not talk on cam 8. don't send money or gifts of any kind and read the Secret Service warnings or the following put out by NY State https://dos.ny.gov/news/consumer-alert-new-york-department-states-division-consumer-protection-alerts-new-yorkers-1 https://www.secretservice.gov/investigations/romancescams
  18. Depending on the country all ours had to be original IRS transcipts and same for most of the doucments but showing fiancee US residency can be a copy of state ID or DL but, again, this seems to be embassy dependent

So, u r not talking (as u say) as 1st offense / u r talking about a continuous series of unlawful behavior all of which show this behavior would threaten the US And u say living in Sweden not i am a Swedish citizen which , itself should be noted as if u r just a resident there , u committed these acts in a foreign country and could do the same in the US , if allowed in.
