It seems unsure to me whether they are considered visa holders before they are admitted the first time by CBP? Can anyone advise their experiences or how we can answer this?     if you have a greencard, you can be a resident alien for the entire year if it makes your tax return more favourable. Your husband should try various ways to see what is best.  Married filing separately has some drawbacks.

    We've already explored that, but with other financial stuff he has going on, it's just not feasible for us to do jointly this year, sadly. Better to keep our stuff separate for now. 

  3. Hey everyone!

     

    I have a couple of questions.

     

    I moved to the USA in July 2020 on my CR-1 visa and need to file taxes as a dual-status alien (we can't do married filing jointly, as it would affect other payments my husband has).

     

    I have two questions:

     

    1) Can I claim the $1800 rebate as I only became a resident in July?

     

    2) Does anyone have tax preparer recommendations in Georgia or virtually that has done this?! I used a certified accountant who said he had experience in this and he messed it up twice before I had to tell him to stop. 

     

    I am also wondering if it's worth me using TurboTax to prepare the July-December portion and then just write out a form 1040nr on my own and write dual status alien across the top, because I'm so exhausted dealing with this already, but I know it can get a bit complex and is worth using a professional who actually knows what they're doing.

    Hey! I hope they're a bit more clued up now with how long this has been going on but just in case, I took:

     

    - a print out of the presidential proclamation with the spouse exception highlighted

    - copy of my marriage certificate and husband's US passport

    - CR-1 visa

    - a printout from https://www.iatatravelcentre.com/passport-visa-health-travel-document-requirements.htm after filling in the info, again, highlighting the spouse exemption at the end

     

    It was overkill in Glasgow, though stressful - they were reluctant initially but all they looked at was my CR-1 visa to let me through. 

     

    If in any doubt, ask them to call CBP in Amsterdam and check. There's a US agent there checking documents before anyone is allowed to board, where they do ask for proof you're married (CR-1 visa should suffice, or if you're travelling on ESTA, copy of marriage certificate + spouse's US passport). Amsterdam is easy though, they're VERY clued up on exceptions so it's a breeze, they're just checking!

  5. I entered a month ago on a CR-1!

     

    I landed from the UK & Schengen area (Glasgow - Amsterdam - Atlanta) and was not even asked to quarantine, though Georgia are notoriously not doing as much they could to stop the spread of the virus and no one seemed too fussed. I filled out a form before leaving the plane swearing I'd had no symptoms and it was checked by someone I presume was from the CDC right at the mouth of the airplane before waving me on.

     

    I did quarantine for a while, but was never directly told to — I think I was given a leaflet that suggested it though. 

     

    And yes, as the spouse of a US citizen, you are exempt from the travel bans and can come straight from any banned countries into the USA. 🙂 

  6. I entered the US last week as a spouse, but on a CR-1.

     

    I did Glasgow-Amsterdam-Atlanta. Checking in at Glasgow was stressful—Glasgow has no flights to the USA atm and they weren’t clued up on the travel ban exemptions. It took a little convincing. If anyone’s leaving from a smaller airport, print the presidential proclamation and take it with you.

     

    They were far more clued up in Amsterdam. I actually was not asked for any proof; I told them I was travelling as a spouse and that was that.

     

    Flight was empty, border control was dead, getting through on my CR-1 took all of ten mins. They just verified my address and sent me on my way.

     The contact I posted is not the courier website. It is the contracted site for the embassy to schedule interviews and make courier arrangements. Seems like they could sort you. Typically that is where you can log in and change delivery options. Since yours is considered already delivered I doubt the online change will work, but customer service might be able to help.

    Dealing with the courier now but they actually did say they need the embassy to authorize an address change (or at least, their contact at the embassy) so I think I'm just waiting. Was just curious to see if anyone else had the same experience. 🙂

    I'm at a different stage in the process to you but I still have some hurdles to get over, apparently the processing time for my current stage is 800+ days! That's what, over two years to process a few pieces of paper. What the...

    I don't have an option unfortunately. I can't pick it up because they have no reopening date, and it was an expedited interview because my husband is having surgery, I need it in my hands ASAP.

    Oh boyyyyy.

     

    I got my visa issued this week. Yay. It was delivered to the depot today, as I opted for pick up. However, the tracking wasn't showing ready, so I called them and they said, "oh, you can't pick this up, our depot is closed to customers because Scotland is in COVID-19 lockdown still." Okay... fair, but I wish they'd told me that before? I said okay, can it be delivered to me, I'll pay the extra? They said no, because they need authorization from the embassy, but can contact them to see if they can get it.

     

    That was this morning. Still claiming they've had no reply from the embassy so nothing they can do.

     

    I'll fill out the embassy's contact form (it's down atm, just my luck) and try seeing what they can do, but right now I'm very stuck and it was an expedited appointment bc of my husband's surgery so I need to be there ASAP. Wonderful.

     

    Wondering if anyone has any past experience getting it delivered after it was at the depot, or anything? And how they managed it?

    They give you a form called a 221G and tick off a box saying "Refused pending..." and then specify what's pending. So for me, it was medical, and she told me everything else is fine (other options on the form include needing a co-sponsor, etc.). 

     

    Even if they don't confirm, if they keep your passport, you know they're expecting that it's about to be fine and they're about to put the visa in it.

    Thanks! Yeah, I guess it was that, I only panicked because the one other person who'd had a lateral view done ended up being delayed for the TB testing. I know very little about x-rays, so in my mind, it was going to be the same result. I spiralled a bit, lol! 

     

    I was not asked for a DS-5540! Not even mentioned, though I had prepared it just in case.

    It was an expedited interview, there were no medical appointments available beforehand. 🙂

     

    I did, but I can't book the courier, because it's asking me for an interview date and won't let me select one as soon as the one I had (or in the past now). Site doesn't work for expedites that go that quick, I guess.
