  1. Thanks Mrs. Jib! Everything the embassy said was totally wrong and I have evidence to back up everything. They were working daily since receiving my evidence on July 30 on both I-130 and K-3 until Aug. 4 and I thought I would receive the final decision since all work ceased from that day, but I only received the notice of decision about the K3. They have not worked on anything since and that kind of worries me, but I will keep the faith and see it through. I will start calling again once it gets closer to Sept. 30.

  2. My husband was interviewed for K3 visa back in Aug of 2008. We were put in AP for background investigation. He was re-interviewed in Dec. 2008 and was told that our petition would be sent back for possible revocation. Our petition made it back in March 2009 and I was presented with a NOIR at the beginning of July. I sent back the evidence required to dispute consular findings on July 27. Received email notice that the case processing had resumed on July 30, 2009. I received a notice of decision in the mail today that really confuses me.

    It says, " This notice is in reference to the Form I-239F, petition for an Alien Fiance, filed for ************ pursuant to section 101(a) (15) (K) of the Immigrationand Nationality Act, as amended. The petition was approved on January 9, 2008, and was forwarded abroad to a United States Embassy/Consulate with a validity period of four months. Subsequently, the petition has been returned to the United States Citizenship and Immigration Services with a finding that the beneficiary was not issued the requested K3 visa. Since the period of validity has now expired, the petition will not be revalidated. Therefore, in accordance with 8 CFR 214.2 (k) (5), all USCIS action on this petition is concluded as of the date of this notice. However, the petitioner may choose to file a new Form I-129F, Petition for an Alien Fiance (e) for the beneficiary."

    First of all, I have an approved I-130 petition that was approved on the same day as the K3. Secondary, we have been married for over two years, so I could not reapply for a new I-129F for both reasons. Thirdly, I never received a letter stating that it was revoked or was reaffirmed, so I am not sure what to do. My question is can I now push the approved I-130 to the NVC?

    It means K3 and your I-129F are dead in the water. You can contact NVC about your I-130 and press forward for the IR1 visa. USCIS has only notified you of their decision about the I-129F. Just ignore everything in the boilerplate language that appears after "will not be revalidated".

    Thanks Pushbrk! I had figured that out already about the K3. I called USCIS this morning. What I was told was the Notice of Decision on the I-129F is them signing off of that because no more work will be done on the K3 because it is beyond its validity. The NVC returned the I-130 which has not been processed at the NVC because of the return of the K3 for possible revocation. It is now sitting on a reviewer's desk waiting to be reviewed and I am to wait until they make a decision on it. They have 60 days from the day they received my evidence which is July 30 when case processing resumed which would be September 30. Of course, I was also told that I am calling too soon. Now I have my answer. Thanks a lot for your help!

    Yes, it is good to hear from you again. How are you doing?

    My K3 is the one that ended up at the embassy per my request. They sent it back because they claim his mother said we were not married which was not the truth. She didn't answer any questions besides she was my husband's mother and that he lived with her. My mother-in-law asked her several times who she was and why was she asking about her son's personal business and she would never answer her. Just kept telling her to answer the questions, so she refused to answer any more. The investigator decided she would lie and say she told her we were not married. They said neighbors didn't know anything about us being married, but of course, they wouldn't, we didn't get married in Lagos, we got married in Abuja, so they wouldn't have knowledge about our marriage. They completely left out his youngest brother who also was interviewed and did tell her that he was aware of our marriage and who I was. Interestingly, that was left out completely. They said my husband told them that he paid for all my travel to Nigeria but knew little detail about my income. He was never asked any details about my income. He was only asked what I did for a living and he told them a medical transcriptionist which is correct. Lastly, they said I didn't provide an affidavit of support which I did. This is supposed to be asked for before they interview and he said they never did ask for it at any time before or after the interview. When he told me that, it gave me the impression that they had every intention of denying the visa before he was ever interviewed, so I made sure I kept a written record of what questions were asked of him and the answers he gave, and by the way he answered all questions he was asked 100% correct. I also kept record of the name of the fraud investigator who interviewed me along with all emails we wrote to each other a month after the interview. It has all come quite in handy as her own words are going to bite her in the butt as I turned in all the emails that she wrote to me lying to me about different things along with the fact that she made the statement that her job was to show me that my husband was scamming me which I thought very inappropriate.

    Hello, Good to see you , but not on these turms.

    I do not have any good answer for you. But like the above poster said, will you run into the same problems with the CR1 interview and AP information?

    What were the exact reasons for the denail. I know because they think the marriage was fraud, but did they give reason and proof?

  6. No worries! I don't know how you keep up with everything. There are so many people to keep track of. Thanks for everything and will return when I hear one way or another. They are still working on our case.

    Long time! This is Deb (kelly1290) and I would like to give an update. On the chart, you have us as denied when actually our petition was returned for further review. It is now being reviewed by USCIS right now after we sent in the evidence to dispute the investigation findings. They have resumed processing our petition as of July 30, 2009. Once a decision is made one way or another, I will come back with an update. The findings mentioned were fabrications by the Nigerian investigator and the other was an embassy error. Hopefully, they will not take long to make their decision.

  8. When my husband was waiting for the date of his second interview after AP, I wrote the embassy once a week for an entire month and the only response I ever got was the auto response. I had eight phone numbers that I could try, all of which were never answered. I even tried their fax number which never picked up the fax. The way I finally found out the date of the interview was to call Department of State. They have access to what is going on with your case.

    Your welcome! They should also be able to tell you the exact date and time of his interview. They have access to that information as well. That was the only way I found out because the embassy had told my senator that they had sent my husband an email with the date when they didn't.

  9. When my husband was waiting for the date of his second interview after AP, I wrote the embassy once a week for an entire month and the only response I ever got was the auto response. I had eight phone numbers that I could try, all of which were never answered. I even tried their fax number which never picked up the fax. The way I finally found out the date of the interview was to call Department of State. They have access to what is going on with your case.

  10. I can't speak for everyone else, but I can speak for myself. Any comment I made here about Galaxy was not based on assumptions, but on my own personal experience with him on VJ and outside of VJ. My husband is a Nigerian and I have been with him for four years in addition to having myriads of Nigerian friends and I personally have never heard any of them refer to their country men using the words "I" or "My". I have, however, heard them refer to their fellow countrymen as "brother". The only mixup I have seen them have is with regards to gender e.g., using he for a woman and she for a man.

    I had one conversation with him outside of VJ where he was asking for help for his interview of which I obliged. After I gave him the help, he wanted to continue by asking personal inappropriate questions. To say the least, I felt uncomfortable and I referred him to my husband for any further help. Not only this, but Galaxy caused the near destruction of the marriage of close friends of ours. Galaxy was told by her husband to not chat with her anymore, but he ignored him and did anyway. He does not display appropriate behavior for a happily married man. There are other examples of his odd behavior, but I think four people that have come to the same conclusion about him based on his behavior are enough. I believe he shows you only one side of himself. Four plus people who have had similar experiences with him can't ALL be wrong.

    Ok so as everyone knows I do not post very often but I feel I do need to post to this. I just would like to inform everyone that Galaxy and his WIFE are friends of mine and my husbands and for the attacks towards him I just want everyone to know that he is NOT who everyone is depicting him to be. His questioning is for the man whos wife had him moved from one homeless shelter to another then into her ex husbands house. So for those of you who do not know this man and just autmatically assume hes who you think he is NOT please just take a look at his previous posts as to how he speaks before judgement is cast upon him.

    Also when ones speak of how he said "I" also remember the country they come from and if you know your significant others like I assume you all do they you will remember that alot of times they speak in that term when refering to there countryman. So I just please ask for this attack to stop on a man who is just here to help others who are going through this journey of immigration as all he wants to do is help. Thank you!!   12. If this is true, then an apology is in order, but in your original post, you did say "I want to confirm the procedure of divorced while I am still on 2 yrs green card." There was nothing mentioned about a brother, just the word "I" was used. Using "I" refers to one's self, not another person. By the way, you were not being judged by your word alone, but by actions that were observed in past months.

  13. Sylvia: I feel for you. I am about cried out now. Now I have to tighten up my boot straps and get down to business on the next steps to take. My husband's denial had nothing to do with fraud of any type, but with his mother refusing to answer questions. When I really think about it from the embassy's point of view, that can look like there was something to hide. I know the real reason as being that the embassy official did not identify herself so she didn't want to answer questions about her son without knowing. She called very upset asking me to invite the woman back because she felt she ruined our chances of being together. I didn't think it would be that big a deal since she did get a successful interview from my husband's brother, but apparently parents hold a lot of weight in determining the validity of a marriage. I am not sure how we will overcome this, but I will work to find a way.

    2Hearts: I am willing to bet that his wife has no clue that he is about to hit her with the fact that he is wanting a divorce. I am also willing to bet that she doesn't know that he is conspiring behind her back.

    Totally unreal !! I kinda figured this was going to happen. It appear to me that this lovely lady was used.

    If your marriage fell apart in that short period of time it must have been an explosive issue that only can be remedied by divorce. But... if that is not the case..read below:

I have known him from a group I belonged to where he made several female members uncomfortable by asking personal questions that should not have been asked if he were truly in love with his wife like he claimed. I only had one conversation with him and that was enough to raise my antennae that something was not quite right with him and I see my intuition was correct. He got a CR1 visa and in Nigeria, those almost always go into AP, especially when there is a big age difference as in he and his wife's case. This makes me even more angrier. And then he wonders why people speak in the manner they do about his fatherland?

    You only arrived a couple of months ago. I think you would have a heard time proving the bonifide marriage especially coming from a country that is already tagged for a high fraud rate.

    and he was upset about the previous post I made?? HMMMMM go figure??

    Gosh if you read his historical posts you see him desperately asking about getting that magic 10 year green card as soon as he landed in the US. I makes me mad that relationships like this just slide through the interview process while completely valid ones get caught in visa hell. He arrived the 18th of November and is talking divorce already.

  15. Syliva, everything you describe is exactly how I think and feel. Nothing on here means anything when you have made the journey and get slapped back down. The thing that is really angering me is that they found not one ounce of fraud in my husband's background which is why they are to deny a visa. They denied him because his mother refused to answer questions because the embassy official refused to identify herself. They got a successful interview with his brother confirming our marriage. Is there more weight in a what a mother knows than a brother? I just don't get it. The only thing they should deny for is finding a wife and kids or is a terrorist. I hope once our petition makes it back to USCIS that they find this ridiculous and they send it right back with a recommendation to give my husband a visa. It may take another 6 months to a year or more for us to make a rebuttal to the consular officer's thoughts. I am married to my husband who I was intelligent enough to take my time getting to know and investigated him myself to the best of my ability. I have the right as an American to marry anyone I choose and this man is my family, and they are telling me because his mother wouldn't answer some questions, he is not welcome in my country? How messed up is that? This should be my choice to make, not the embassy's. I am sorry for going on and on, but I have gone from devastated to outright angry :angry:

    I was married for 22 years before my present husband. This husband saw fit to hit me, beat me, and stomp me in the face for years and years. Now I have someone who has respect for me, shows plenty of love toward me, and treats me very kindly, and now because someone doesn't answer some questions, I am not allowed to live my life with my husband? We followed all their rules and did everything by the book. He answered every question about me 100% correct at the first interview, but because there is an age difference, he couldn't possibly love me, he could only be scamming me because that is what they come across often, but that doesn't mean EVERYONE is like that. I am intelligent enough to know what scammers are about and the tactics they use. My husband does not fit into that category at all. I better quit before this becomes a novel, but I just had to get it off my chest.

    But when you first get the news it's like you've been hit over the head with a two by four.

    You are confused, disoriented and wonder what the heck just happened. You feel you are stuck in a nightmare.

    Later you regroup, focus and analyze your options..........once you even know what they are in the first place.

    The pain fades though it never goes away. I can't tell you how many wedding plans I made and now I lost all joy to even plan them anymore.

    It's whatever.....just get here ! Then and only then can we exhale .......for now it is waiting to exhale......I'm turning blue :clock:

    There is no way to know the pain of this if you haven't been there. You loose interest in time lines on here. Things that gave you hope become absurd. I cried to the point my oldest son wanted to help me figure out how to move there. You look for answers, file complaints, send emails and make phone calls. Then you learn how little these agencies really respond. I got my best response from my employer who took a report on the embassy actions and filed a complaint. I just hope that someday this is just a story of how we got together although at times it doesn't seem like it. So many what ifs fly through my head that at time I need to sort through them to see if any/all of them are still viable. You see couples pass right through the process and then return to say that they really don't want to be together and you wonder why they throw away a life you aren't even getting a chance to start. You look at the patterns and see how biased and unfair it is. That certain places the US government puts you through hell to be together and others they let you visit and come with no hassles. From it you learn more about how the government really behaves in other places and you come to understand why we are thought of as arrogant snobs. It is highly educational in a very sad way.

  16. Yes, Omoba, it hurts like hell and it hurts even more trying to figure out what to do from here. I do appreciate each and every link you provided me. Your extra work to help me is so appreciated. Some of it was extremely helpful. I am pretty sure I cannot afford to get a lawyer to help me with this, so I am going to have to figure out what to do on my own as I have through this whole process. Reading and researching on VJ has been more than helpful. We would have made so many mistakes if I had not done this, and even with me being so meticulous, it still didn't work out. Apparently, parent's opinions or comments about their son's marriage hold a lot of weight because that was the reason for their denial even though they had a full interview with his brother who confirmed our marriage and who I was.

    Sylvia and others that have extended your best wishes, I really appreciate it. After the dust settles, my husband and I will sit and discuss what would be best for us to do. I have already spent thousands of dollars on 3 trips to Nigeria, visas for myself, the price of the petitions, price of his visa, any expenses related to immigration. I just can't do too much more. I still have my son to take care of. My daughters are all living on their own, but I know I can't afford lawyers. At this point, I don't know what to do or which way to turn.

    I sadly have to inform you that my husband was denied his visa today on the basis that his mother refused to answer the investigating officers questions about our marriage. She did not answer the lady's questions because the officer did not identify herself as am embassy official and the officer was asked at least twice to identify herself and she would not. She only told my mother-in-law to answer her questions, so my MIL told her no she would not. My husband's brother was interviewed by this same woman who did answer her questions and said yes, his brother was married to a lady from the United States. He was asked why the neighbors didn't know of the marriage and he told her that they don't shout family business in the streets. The fact of the matter is that we were married in Abuja and not Lagos, so neighbors wouldn't be aware that we were married. I have contacted my congressman and I have spoken with Department of State. Department of State told me to call them tomorrow as the embassy has not updated the computer. I wanted to lodge a complaint as that is not a good reason to deny a visa, especially when you had a successful interview with another family member who said yes, he was married. If anyone else has any suggestions as to what else I can do, please feel free. I can use all the help I can get.

    Wow Deb. So sorry to hear all this.

    Normally I can see why the CO would find some aspects of fraud in a case, but in yours it is totally bizarre. The person who did the field investigation is, for lack of a better word, stupid. Why would she assume that your MIL would just start talking to a perfect stranger about her son's marriage? It makes no sense. Plus, she got the info she wanted from your BIL.

    I would definitely get all your elected officials on this ASAP.

  21. My husband and I were put on AP and they didn't take our AOS papers either, but he has been called back to the embassy and has his second interview this Monday, so I am sure everything will work out okay.

    At the conclusion of my husbands interview the CO gave my husband back both my and my mothers affidavit of support papers? Do they normally do that?

    And does anyone know what they check for on Administrative processing? Do they check credit history or just background check?

    Unless things are different in Pakistan it's NOT normal to give back AOSs. Definitely NOT a good sign. He should have got a 221g or some kind of explanation if denied or on AP.

  22. Just checking in to see if Michael arrived in one piece to Boston. Be careful on the roads. Snow is not as bad as ice to drive on. I know because I spun out last weekend in an unexpected ice storm. Keep us posted! I will check again when I get up early in the morning to work.   23. Missy, I am as excited as you are!!! I am so happy Michael is on his way home. I hope there will be no delays to Boston as the ice storm we had last night is headed your way, so lets pray that he makes it before that arrives because it is quite a mess. Keep my Mike in your prayers throughout the weekend as his interview is on Monday at 1 p.m. I will be glad when this is finally over.
