Like I mentioned above single filler and married filling separately has same tax bracket so your spouse was paying same amount of tax either way. Immigration has nothing to do with it. Yoo can take that income.tax return at the interview. And once you are done with your interview your wife can amend that status from single to married but filling separately.

My interview done before just send them affidavit of support I-864 with transcripts. But this year taxes 2021 accountant file as Single just was worry about that. My wife submitted form 1040X to IRS for amend status correct

Yes we leave that accountant and we found a new accountant. He amend for filling status single to Married Filling Separately. Just wondering should we submit transcript as Single because other transcript will be take time 16 weeks

OK, so you are trying to resubmit i864 with your wife’s 2021 income info instead of joint sponsor, hoping that would be enough.

Then what’s you should do. Once her 2021 taxes are filed, she should send the revised i864 with all relevant attachments. As @arken suggested, include latest pay stubs to prove her current higher income. If there was an offer letter that accompanied her raise that could be included as well.

Yes she filed her taxes in 07th March 2022. Now almost her transcript is come as well but accountant was filed her taxes single not married filling Sperately. We found a new accountant he said, he will amend it today. I will attach 1040X with 2021 transcript with new Affidavit of support I-864. Yes she have paystubs Yes my wife current annual income is $37,582 and she don't have any dependent. She and me only household. Pray for us.

What amount did she put as current annual income in i864? This should very likely be good enough. Make sure to include several latest paystubs as well.

Her current annual income is $37,582 as per her salary and employer letter mention also. Yes we have pay stubs.

Please fill your timeline, so we know what stage you are in the process.

My interview was held in US embassy Islamabad Pakistan 05 July 2021. They required me joint sponsor and unfortunately we didn't found anyone with eligible in families. My wife made enough in 2021, $24,778 for 2021. Currently her annual income on employer Employment verification letter $37,582. We'll submit documents when 2021 transcript come in our mail box

You only need SSN/ ITIN to file “married filing jointly.” Your wife can file “married filing separately” in the absence of your SSN/ ITIN.

I recommend your wife fire the current accountant if they haven’t advised her this already. Find someone competent.

Regardless, as others have said, this won’t affect the immigration process.

Yes we found a another accountant he said he will amend our filling status by 1040-X should we submit 1040x with documents which we ready to send embassy

    Come again?

Married people filing taxes as single are not lawfully paying taxes.  This is tax evasion.

We amend it soon as possible. We submit embassy 1040X with current 2021 transcript is it good or not. In few days we got our 2021 tax return. Our new accountant is said he will amend it submit 1040-X to IRS and take 2-4 months get processed. Embassy time also over next month. Should be enough amendment form which we'll send IRS in few days.

She could have just emailed you the transcripts for you to print there.

She send me signed affidavit of support and employment paychecks and employer letter and transcripts via FedEx to Pakistan. Just was worried about her 2021 transcript as a single status

Don't worry for now, no need to amend at this time. Your wife's tax return filing as single is an IRS issue, doesn't impact your visa processing. All the embassy wants to see is the petitioner is paying taxes lawfully.

It would take almost 3-4 months or more during these time for the 1040x to be processed. When you immigrate to the US and get SSN, then amend it to married filing jointly if that gives you tax benefits. For now just relax.

I really so worried about my wife taxes. I keep international calling our accountant about taxes. Accountant said, can't file married until you present in USA get have SSN and ITIN. Really crying now 😭 about this situation

    Accountant is wrong

when married u file as married

when spouse is nonresident you file W7 with the supporting evidence (marriage certificate always and it has to be original with English translation) plus photo proof of ID

open this site ,  print out the page and make the accountant redo taxes with a 1040X

and don't pay him for this

    https://www.irs.gov/individuals/international-taxpayers/nonresident-spouse

That account is said you don't have any SSN and ITIN. Last time my wife file taxes from another account he filed married filling Sperately.

Guys, can you tell me how much take time get amend 1040x and transcript

  11. Hello to everyone,

you interviewed July 2019 so income would have been for 2018 and then she could verify with 2019 tax returns when they asked for new medical (per your posts) as she would have done a new I 864 with 2019 income

CO has looked at income for not just 2020 but for previous years as "totality of circumstances "

covid and 2020 should not have affected this that much as we all suffered in 2020

but if her income was too low for the years prior ,  then she should have been thinking joint sponsor long ago

and now,  you can not come up with one so i would suspect CO to return case to US office

She can reapply if her 2021 is showing the needed income

Did i see you also needed 601 waiver?

Hello friend, i was have interviewed in july 2019 and embassy put my case in adminstrative proccesing then in November Wuhan china viral carona virus whole world. Pakistan got first covid case reported 22 February 2020. Us embassy closed all visa services in February 2020 and they reopen embassy in april or may 2021. I did that time all our completed enough income IRS transcripts and i 864 with all documents my july 2019 interviewed before. After covid i got call from embassy in 4 july 2021 for renew medical and gather all Documents which is mentioned on NVC original welcome letter. Co was looked all documents and taxes too he said your wife haven't enough income 2020 because they rescheduled my interviewed in 17 july 2021. On interview when he saw my wife income is low then he said submit joint Sponsor. They was already returned my case in 2018 on my first interview and we give evidence to uscis then uscis reaffirm approved our case and forward to embassy for issuance visa processing in 10 april 2019 embassy got my case from NVC then they held my interview in july 2019 and then covid affect on 2020 whole year then again they called for another interview in 17 july 2021. Again i mentioned my wife income 2017 and 2018 and 2019 income was enough for sponsor me. But 2020 is low. Now my wife is keep working on her job 2021 income will be enough also. Just try ask can she able to be sponsor me if she maintain her current year 2021 income

  15. Dear Friends,

I had attend my interview last month july 2021. My visa catagary is IR1 spouse visa during interview visa officer is saw my application and all required documents. He looked at my wife most recent taxes papers also. My wife is didn't earn enough income in 2020 by covid-19 she lost job twice times. Officer required me submit joint sponsor she tried find there her friends and also didn't earn enough income 2020. We tried find but couldn't get anyone yet for become joint Sponsor. I want to ask all of you dear friend. If my wife keep working in and earn enough for 2021 so my wife can sponsor me in January 2022 she will file her taxes. Reply me and tell me this can be possible..

    Regards Imran
