    How many trips I made. She said 2. She also said we got married on the third trip(she thought the third trip was the second because she forgot about the first.) She was technically right we got married on the second trip.

    1. Ask for an expedited USCIS processing of the review ( get your NOIR faster) 

    2.  Lodge a complaint of CO abuse of discretion

    I was introduced through her sister who lives near me. I met and befriend my now wife's brother in law. He introduced me to the rest of the family and we became good friends. We applied for cr1 and it took a long time. We are almost 4 years into processing. It took a year to book a 221g appointment.

    Yeah they asked that. I was shocked but they said it would greatly help the case to answer. She's not good with that kind of pressure and those kinda questions. I'll mention it to uscis.

    What questions were each of you asked at 2nd “ separated “ Stokes interview? 
     

    USCIS will send you a NOIR and you will have a chance to address and overcome each point.

    If you have the means, go there ASAP, to spend time as a couple, amass a boatload of Evidence of Marriage and Relationship …stay as long as you can or go as often as budget permits. ALL of this you will use in the NOIR ( Notice of Intent to Rescind) 


     

     

    We communicate in english and both interviews were also in english. I thought our case was very strong. I submitted way more than they asked for when they gave a us a 221g. I visited 3 times between 2018 and 2019. Obviously covid stopped us after that. Guess I'll be booking a flight soon.

    Yeah it seems they decided it was real. Our 4th anniversary is coming up on Nov 18th. To think we have to celebrate it with this looming over it.

    Generic ones like how many trips did I make out there. What happened during each trip. Marriage anniversary and which trip we got married on. There was questions about first kiss and how often we were intimate. I answered all 100% accurately but she admitted the officer corrected her on a few and she was very nervous. I guess that did it.

    If petition is being returned, you will get either NOID (Notice of Intent to Deny) or NOIR (Notice of Intent to Revoke). You will be told the denial appoints and a chance to address each issue.
    So now you have to wait for response from USCIS and that can take a year to get back to USCIS and they get to it and respond to you.
    If you address all the issues with evidence and other things and they approve USCIS will reaffirm your case and send it back to embassy for 2nd interview.

    She is 29 and im 31, No age gap. So we will receive a notice of denial when uscis gets it back? Then we will get a chance to fight it. But that could take a year or more. 

     

    Like I said she admitted to be nervous and missing questions. Questions she should of answered correctly.

    No it was a phone interview for us both separately. I guess they compared our answers. This was 5 months after our 221g. We gave theme everything they asked for from the 221g.

    Seems like the interview. She admitted being very nervous and missed a few questions. They were questions she shouldn't of missed.

    Nope it just says after the interviews we had 2. The most recent was March and a phone interview for us both.  That after the interviews they looked at the facts of the case and decided it was best to send it back to USCIS.

  12. My case was denied after almost 4 years of processing. Delayed by covid and 221g appointment taking a year to schedule. Got word today from my senator who was helping with my case. The visa has been returned from embassy to USCIS and will be closed. I need to know what my options are...and ask for any advice. Right now it seems like moving to vietnam is the only option to try and build a life together.

    I was able to get one for my wife. Her 221g appointment is tonight due to the time difference. I was able to schedule last Thursday at 8am PST.

    I just hope this means more slots open for others. Hopefully the consulate will be back to normal. Everyone here deserves to be with their significant others. This process is horrible to say the least.

  15. Just posting an update!!!!!! We got our 221g appointment!!!!! I confirmed it this morning! 3 weeks before our dead line we finally got one!!!! I hope everyone is able to get one!

    I wish there was a way to expedite. I have been married to my wife for 3 years almost. I havent seen her since December 1st of 2019. We had our first interview on November 20 2020, and they gave us a 221 (g). We have been trying to schedule a new appointment ever since.

     

    Our dead line ends in one month and they have been closed for soooo long. Im not even sure I can get an extension of some kind. We are losing our minds with fear of having to start all over.

After the class action, they decided they would start processing K1 visas.  This Consulate is very poorly managed.     He didn't even say it was an option. I will look into more. But I need them to give us an appointment for our CR1 visa. I dont want them to decide our case until we have our appointment. Hopefully another attorney will say its an option. I'll update as I talk to more attorneys.

     

    But this whole thing is just ridiculous. We have been married 3 years and going through process for the same amount of time. I haven't seen her in two years almost. Good luck everyone.

    So the Lawyer said it would cost $2,000 and that the best he could do is keep trying to get us an interview by contacting them over and over. I'll keep trying other lawyers. 

  19. It has been awhile has anyone had any luck? My cases dead line is November. Its getting closer and closer. I know its closed but if they don't re open anytime soon what will happen to cases that pass their deadlines. I really don't want to have to start over from USCIS again. Could we possibly do an emergency appointment?

    Yes, it will help because you will get an appointment. They have no choice. Waiting is not a good strategy. I don’t believe that the Consulate has enough appointments for everybody, especially the K visas. 

    I'm a little confused, I will try contacting one today. My wife already had her interview. We are trying to schedule a day for her to turn in evidence. I definitely do not want them to decide my case without the additional evidence.

    This is a 221g thread so I imagine everyone here was given a 221g.  The fact that we got them means they did not believe us in some form or another.

I'm afraid you will be waiting too long. My honey met a woman at Cho Ray, who was getting her medical. The poor woman said that she was there to get a second medical, because her first had expired--she couldn't get an interview appointment. There's no excuse for the Consulate treating people the way they do. Good luck, folks. 

    Any updates on the Writ? Can it actually help? How long does it take to write one of these?
