    Anyway, what's most important now is to submit the document requested in the 221g ASAP.

     

    She said she's going to get a lawyer to help write a statement but at this point, I don't know if writing a statement will help or make it worse. Do you know if the DS260 expires? She thought of waiting it out and refiling. Is that even an option?

     Thank you for your reply. If that was your situation, Would write a statement pointing out the mistake and apologize or just leave it and give them what they want and wait? 

  3. Asking for a friend.

     

    Her mother had an IR5 interview last month, the consulate asked for court record which she forgot all about the arrest but remember in time and explained to the consulate. She got 221g requested for court record. 

     

    Her mother used to live in the States and got into trouble in 2002. Not her fault but was with a friend that stole. So she had retail theft on her record(non-traffic). The consulate saw her record through fingerprint(maybe?) but when completed ds260 Have you ever been arrested or convicted for any offense or crime, even though subject of a pardon, amnesty, or other similar action? it was checked "No" 

     

    She already got the court record and ready to upload to ceac but because it was checked "NO" will it considered as misrepresentation? Is there anything she do/change the answer to yes? she competed her mother's DS260 it was unintentional. Is this something you get ban for life?

     

  4. K-1, U.S. Embassy of Colombia

    Interviewed January 2020 missing i-864,  221g was given and asked to send i864 and passport. We sent an i864 and passport to the Embassy the same week. 10-11 months passed, Got an email from the Embassy this week 12/21/2020 asked to redo the medical exam because it's expired and police certificate by January 15, 2021 but the problem is the U.S Embassy still has my passport and I live in Venezuela. The land border is currently closed between Colombia and Venezuela and I have to have a passport to get a medical exam.  Can anyone relate and help? Thank you. 

  5. Hi everyone, does anybody from colombia bogota who have file for k1 visa knows how to gt an interview date ? I have followed the packet instructions for the site where you pay your interview fee And set up appointment but when i click to pay visa interview fee it wont let me and it also says no appointments available at the moment. I been checking for a week and still nothing .

     

    im going nutz! Is this normal?

    Thank you so much for the replies and be so kind about it. I got a letter from the court from 1301 Filbert st stating "no pending criminal cases or prior convictions exist" (I noticed you're from Philly too) but USCIS wants certified copies of all court and police records showing the charges and the disposition for every arrest or conviction. Do you know how or where I can get my records unexpunged to get the details from the courts of what had happened and the conviction? 

     

    *Trying to get a lawyer too at the moment.

     

     

     
  7. Applying for K1

    Got RFE stating:

     

    You must submit certified copies of all court and police records showing the charges and the disposition for every arrest or conviction. You must do so even if your records were sealed, expunged or otherwise cleared and regardless of whether anyone, including a judge, law enforcement officer, or attorney, told you that you no longer have a criminal record. 

     

    Got DUI 6 years ago and its expunged. Could not get any certified copies of court or police records showing the charges. Got a criminal background checked and it's clear but the uscis wants police records showing charges. I went to a law enforcement but there is no record also. Anyone knows how to get all this documents they are asking?

  8. I'm going file i130 for my father and mother. they never got married but has 3 kids including me. my mom did got married to someone else many years ago and got divorce. my parents are together now but are not married. 

     

    1. Do I send her divorce paper with i-130 for wait for NVC stage? 

    2. If they were never married, Do uscis still want civil marriage certificate for my father?
