No, all the income is in the return. but for those trust dividends there are no 1099 forms attached. there are 1099 forms of all social security benefits, pension payments, and bank interests though. But the tax returns were prepared by a qualified accountant, so I guess they are correct. I will quiz her anyway to make sure.

Sure it could.
If you think about it - you present the sponsor's tax return to the consulate officer. They look at the 1040 and the slips and the income on the slips is not sufficient to show what is on the return. You are providing a key piece of evidence for the I-864. It is important that you provide all the pieces.
Either provide more slips or have the co-sponsor explain it in a note - at the very least you need to understand why so you can explain it.

It's not consulate specific it's the Law as stated in the AFM copies of return OR transcript it actually tells you NOT to send originals unless requested
This is the DCF forum - the OP will be taking the information with him TO the consulate, not sending it.

Well this sounds like an easy one, but what is the different between a green card issued by uncle Sam (to the permanent residents) and the passport (issued to the, well, us USCs), in terms of visa requirement to visit foreign countries?
Basically you just need to look up the requirements for each country before you visit. With Canada, the green card will suffice, if you are crossing a land border, but they may ask for the passport as well. Most airlines will not let you board without a passport anyway, if you are flying.
But the bottom line is, if you previously needed a visa to visit Canada, you will not with the green card.

Some of that income may not be taxable thats why it won't show on a return, your OK just explain if there's an issue the consul are pretty profcient in tax issues
Rob should not be the one explaining to the consul, in my opinion - the co-sponsor should explain it, in the form of a note attached to the I-864.
I'm sure it's not fun to quiz your co-sponsor on exactly where all their income comes from, but that's what you need to do. If the officer at the consulate asks you, you want to be able to respond confidantly. It's clear from what you are posting here that you don't understand their return and why the numbers do not match up. If there is non-taxable income in there your co-sponsor should be able to explain that and then you will know.

Yeah, i asked whether the joint sponsor must submit a tax transcript or the form 1040 is enough.
the primary sponsor won't have a tax return because she has no income since she is a full tiem student.

When I said "did you ask the joint sponsor" - it was because you stated that the slips do not match the income earned. I meant, did you ask her/him why - if you are missing a slip.
I had also mentioned that you were interpreting the instructions incorrectly (re the W2s) - but no matter!
I don't know if photocopies are acceptable or not, so I can't answer that, it's probably consulate specific anyway.

Well that's up to you really. I mean it depends how much travelling you want to do and how much money you want to spend. Personally I would just wait a couple of weeks to see if the visas arrive.

Yes, this is for my mom. He makes about 55,000 and our previous taxes were average 90,000 per year. I stopped working from January. I own my car but just one. I own a land which is worth 35,000 and some savings.....I have one child and one step child too.
You should check out the poverty guidelines.
You will fill out an I-864, your Husband (as the joint sponsor) will fill out the I-864A, because he is your household member. His earnings of 55k annually, for your household which will equal 5, should be fine.

Do you have a cell phone? Perhaps you could call forward your regular phone to your cell phone. Maybe you could explain the situation to the person who is observing the exams and let them know that if your cell phone rings you will have to answer it.
Another idea, if you have voice mail on your phone, change the message to something like - If this is the Montreal consulate calling, please call me on my cell phone at <number> - or if no cell phone, then say, If this is the Montreal consulate calling, I have already sent our passports to you in a separate envelope - then give details of the date they arrived at the consulate.

If my wife gets an enhanced DL, do you honestly think she would be able to cross, or will her name come up flagged as being in the process of getting her VISA, and therefore refused entry into the US?
Has anyone actually tried this?

Actually it doesn't state that. What it says is if you send a tax transcript from the IRS, you do not need to send any slips but if you send the completed 1040 then you must include any and all slips to prove the income on the 1040.
Where is your joint sponsor's income coming from? Are they using assets or retirement income? Did they file a tax return last year?

Right, AP. Well that's pretty rare in Montreal. I remember one person who was in AP, Husband had to submit his resume' so they could check him out, I believe he was a scientist.
That only took a few weeks to go through, but Montreal was a bit faster at that time.
Your situation is pretty unique, not much historic info here to go by.

Yes, you can change your name to your married name on your greencard.
The form is the I-90 and the fee is $280 plus a biometrics fee of $80.
It would probably be much simpler (and cheaper) to get a new passport now.

My Husband's passport was expiring in 5 months when they interviewed him, they asked if he was ok with them issuing the visa with a validity of 5 months - he said sure - so that's what they did, no problem.

Standard wait to receive the visa, if approved at interview, is 1-2 weeks.
I meant after the interview. I figure when someone goes for an interview, at any consulate, they should anticipate that they may need to submit a document or provide some further information. I don't think the interview is the end of the visa process.
So in light of that and the fact that it takes so long for them to get back to you, I was just saying a person should probably anticipate that they may have another 3 or 4 months they may have to wait before moving.
The last person I can think of that had to submit paperwork after the interview and has received their visa now is coraliesolms - she interviewed on February 8th, sent paperwork in March, so she "only" waited 4 weeks.

Who are you petitioning for, your Husband? Where does he live?
If you are petitioning your Husband and you want to use assets you need 3 times 125% of the poverty guidelines amount for 2 people, which is $18212.00. So if there are just the two of you that would be $54636.00 USD
If you are petitioning someone else, it would be five times the $18,212.00 that you would require, in assets.
You cannot use your car as an asset, unless you own two.

The actual tax implications of that will vary depending on your situation. But basically they will deduct witholding (the bank) right off the top.
Depending on your personal situation, the result - ie: what you will really pay, will differ.
A couple of things to consider. If you do withdraw your RRSPs now, you may be eligible for a reduction in tax by electing under section 217

If you want to withdraw them but would prefer that the witholding amount be reduced - you can fill out a Form NR5, Application by a Non-Resident of Canada for a Reduction in the Amount of Non-Resident Tax Required to be Withheld.
Certainly worth looking in to.

Hi, my wife and I are at the 7 week mark now... the thing that frustrates me the most is that there is no way to even talk to ANYONE and find out what is happening with your case. When I was still going back and forth a lot, I actually went to the consulate for answers, but they pretty much turned me around and said keep waiting. So now my wife has to stay with her parents and we have no clue how much longer we will need to be apart.
We are all prisoners of the Montreal Consulate.
Another person in the same boat - that's too bad, I wonder how many there are out there?
I guess, in light of this new torture Montreal is putting people through, normally, when you go to the interview you should always anticipate a wait, in case further documents are needs, however, in the case of the Montreal consulate, everyone should anticipate a 3-4 month wait will be required, before moving, in case they need a piece of paper or two.

Yes, if you provide transcripts you don't need slips.
The IRS will even fax that transcripts if you request it and have a fax handy.
