we have read the notes provided with the form and proving intent to reestablish domicile for NVC and the I-864 is not a problem, but from reading this thread it is clear that in the past Montreal has interpreted the domicile issue much more stringently than other consulates. You posted about your recent experience and I was hoping that others in similar situation would post their experiences.

From what I have read, things haven't changed much. Montreal is very stringent about the domicile/reestablishing domicile issue but the most important thing is that many people were trying to prove the wrong thing - you have probably already realized that by reading this thread.

What they will want you to prove is that you are moving back - however you prove that can be different for everyone.

Things like servering ties in Canada will - a letter from an employer stating the employee has quit their job or will upon approval of the visa. A letter from a landlord or documents proving you have put your house on the market. Since you are unable to come up with an accomodation letter for the U.S. - where exactly do you plan to stay? Hotel? Relative? Short term rental while you house shop? Have some proof of that available.

If you provide enough evidence with the I-864 and if the interviewer has gotten around to reading it beforehand - then they may not ask for anything else.

Wow, that sucks I have to list all my stuff. Granted I won't be bringing a bunch. Do I have to list everything, like every CD I own, every movie title?

No, it doesn't have to be that specific - you can list in 'general' - like - box of kitchen items - value 30 dollars, box of CDs - value 50 dollars etc.

Moving to Canada - even as a Canadian citizen - does have a few requirements. When you move to the U.S. they are very blasé about your goods, although everyone advises everyone to have a list of items they are bringing in (which is a good idea) they rarely, if ever, look at it.

Not so with Canada. Even as a Canadian you absolutely MUST have a list of goods you are bringing in, with values. You need a form for all the goods crossing the border with you and a separate form for items you are shipping separately. You need 2 copies of each. One you keep, one the border officer will keep, you present these forms at your point of entry. The form is here:

If you are also going to import your U.S. vehicle, there are lots of hoops to jump through, not like taking your Canadian car to the U.S. at all - there are inspections and inspections - and fees - all that info is here:

I don't blame you for not wanting to keep doing the timeline, and I'm happy to update my own entry (when/ if I ever do get an interview).

I guess I have just one question. I'll ask it publicly, just because I bet other people need to know too. How do I turn my whole entry GREEN? I'm pretty sure you said previously that the entry is supposed to be green once there's an interview scheduled. Do we turn it back to black once the interview is over?

Good to hear!

When someone gets an interview date I select that particular timeline, then just use the text colour button next to the 'sizes' drop down box at the top of the reply screen - I use the 3rd green one from the top , the colour is 2E8B57, then I bold it as well. Once the interview is done I just remove the html for both the colour and bold from that line

No offense, but you are being very dense about this. To think that on an individual level an insult about someones weight carries the same level of emotional pain as a racial slur is preposterous.

I think you are in the minority to think that using a derogatory term for an overweight person carries the same weight as a racial slur. It may be hurtful, but it simply is not in the same realm.

I never said that, why you feel the need to take one tiny piece of my point and throw it back, I have no idea.

While a racial slur cannot be compared to calling someone 'fatty', because it does not (obviously) have the same connotation - I was talking about on an individual level. I am talking about an individual being hurt by someone elses meanness and ignorance. Whether that is because of a racial slur, calling someone another name - based on them being different from you, or what you consider 'normal' - it's no different in my book. Both hurt a person and both can be avoided by just showing a little compassion and understanding for other people and their feelings, regardless of what you giggle about when surfing the net.

That is absolutely absurd to put calling someone fat in the same category as using a racial slur. The key distinction is that fat people can change their situation whereas ethnic people cannot (Michael Jackson aside). It is childish, yes, but not on par with using a racist slur.

In your opinion it is not. I didn't say racial slur, but if that is what you read in to it, that is fine. People who insult and make fun of people just because they are different than others is reprehensible in my book. Frankly I don't care if you think that is absurd or not. I call it compassion, you call it whatever you want.

You need to check the requirements for each country you are going to visit, with regard to whether a visa is required to visit or not.

You mentioned in your last thread that a supervisor was reviewing your file. It is not unheard of for a supervisor from NVC to call a client.

No one can tell you what will happen on the day, it is 100% up to the border guard that you end up with.

One thing you might want to add, to your proof of ties, is some documentation backing up the fact that you are going to apply for your wife to immigrate to Canada - a letter from the lawyer perhaps.

What do you think I should do, then? I do know that the consulate has refused to expedite my case. I basically think August is hopeless, but I'll give them at least a few more days. But once August is really and truly hopeless do you think I should contact Montreal via email? They don't really seem to respond. Or should I do what the NVC operator suggested and ask NVC to put my case on hold for Sept?

Should I ask to talk to a supervisor at NVC? Could getting a lawyer help me at this point?

I agree with flames, email and be persistent but polite.

The Dos visa specialist said not to do that. It's NVC that's actually doing the scheduling in any case; Mtl doesn't even have my file until NVC schedules a date for me. An NVC operator said I could *try* to request (in writing) that my case be "put on hold" for Sept...but when I asked him if that would actually work he said he had no idea! The DoS visa specialist seemed to think it was best to let NVC schedule me for whatever date, even if it's an impossible one, because then at least my case will make it to the consulate.

I disagree with what the person at the DOS told you.

First of all it helps you - zero. Secondly Montreal does have a say in when you get scheduled, I mean it isn't like the NVC holds all the cards here. If Montreal wants your file to schedule you in August, then NVC will give them that file.

It is up to the consulate, regardless of who is holding the file.

If he cannot file with me will they accept a copy of his passport or will it have to be a certified copy of his bc? If so, do they need an apostille on the bc or will just a certified copy?

No apostille - they want to see a certified copy from the issuing office - so he needs to request one from the State where he was born - they don't want a photocopy etc.

Of course he could always send you the one he has (if he already has one).

Please help with confusing information. I have read in a few places that my Jamaican fiance has to have a passport that is at least 6 months old, in other words, issued 6 months prior to issue date. Does anyone know if this is true? we have an interview scheduled and I don't want to go if the passport will not get him into the US.

Well, this could be consulate specific, but in general yes, the passport should be good for 6 months as the visa is good for 6 months and they will not issue a visa which is valid longer than the passport (in my experience).

When my Husband went for his IR1 interview, his passport was valid for another 5 months. The CO asked him if it was ok with him if he only gave his a visa valid for 5 months (expired the same day as the passport) - he said sure and that is what the CO did.

All consulates may not be as easy going about that though.

Last week we were sitting in bed watching tv and the fan started to turn on and off and on and off. So I went and unplugged it. Then the night before last my dog started growling and we both woke up and the door to our bedroom opened up. Then yesterday I was sitting in our living room and the kitchen light flicked on, I turned it off, it went on again so I figured someone needed that light on and let it go.

Its stuff that happened all within a week - nothing previous to that and no 'weird feelings' so I told him it's probably just a visitor and not here to stay. Besides the people before us lived there before us for 15 years since the place was built, I just think we're fine.

Some of this stuff is consulate specific, however in general:

- If you send IRS transcripts you do not need to include slips like W2s and 1099s. If you send in the actual tax return(s) then you must send in the slips to support that.

Don't worry too much about 2008. First of all you are only required to send the latest tax return (2009) - however the future immigrant should have the other two years with them at the interview, in case they are asked for.

They just look at past returns if they want an overall picture of your financial history - again, don't worry too much about the 2008 return, your current and 2009 income is more than sufficient.

Go back to the 2008 elections and ask anyone what they knew about Obama.. Hell, you can probably find some rallies where "supporters" were interviewed. It was quite hilarious... Obama in no way was elected by an informed electorate. Obama was elected because he was different, because he spoke well, and because it was the 'thing to do.' - It was literally a homecoming court/prom kind/queen vote...

When you say "they" received their greencards back in 2007, you mean his parents? There are numbers to call for information, where exactly is his application at this point - physically?

You could file for a K1 while he is still in the U.S., he would have to go back to Canada for the medical and interview.

Alternately you could just apply to adjust his status, have a look at the Guides here on VJ (link at the top of this page).
